MINUTES OF REGULAR MEETING OF JULY 14, 1975 WERE APPROVED AS WRITTEN. MOTION BY COUNCILMAN FLOOD, SECONDED BY COUNCILMAN KINARD, TO PAY JULY BILLS AMOUNTING TO $6,638.77. MRS. META C. BOLINGER WAS PRESENTED WITH AN ENGRAVED SILVER BOWL IN HONOR OF HAVING BEEN QUEEN OF THE CENTENNIAL PLUS TEN CELEBRATION. MR. KENNEY, A MEMBER OF THE AUDIENCE, DISCUSSED THE PROPOSED TENNIS AND BASKETBALL COURTS ASKING THAT THEY BE SEPARATE ENTITIES, EVEN THOUGH THEY MAY BE LOCATED IN THE SAME COMPLEX. HE HAS TALKED TO COUNCILMAN FLOOD ABOUT THE RECREATION PROGRAM AND CONGRATULATED HIM FOR THE FINE WORKHE HAS DONE FOR THE CITY. HE URGED MORE PEOPLE CONTACT COUNCILMAN FLOOD AND GIVE HIM THEIR VIEWS ON THE RECREATION PROGRAM AND WHAT THEY WOULD LIKE TO SEE DONE. COUNCILMAN FLOOD WILL HAVE AN OPEN MEETING ON THURSDAY EVENING, AUGUST 14, 1975, AT 7:30 P.M IN CITY HALL, TO DISCUSS THE PROPOSED RECREATIONAL PROGRAM. EVERYONE IS URGED TO ATTEND. COUNCILMAN FLOOD ADVISED THE PERMIT HAS FINALLY BEEN RECEIVED FROM THE CORPS OF ENGINEERS TO CONSTRUCT A PIER AND EXCAVATE A CHANNEL AT THE CITY PARK AT THE END OF MAIN STREET. BY THE END OF THIS MONTH HE WILL KNOW DEFINITELY ONE WAY OR ANOTHER IF THE CITY IS TO GET A GRANT FROM THE STATE OF FLORIDA FOR THIS PROJECT. IF IT IS RECEIVED IN SEPTEMBER, COUNCILMAN FLOOD ASSURED THE COUNCIL THAT WORK WILL BE STARTED IN OCTOBER. THE SWIM LAKE IN SEBASTIAN HIGHLANDS IS OPEN AGAIN - NO ALLIGATORS HAVE BEEN SEEN RECENTLY. COUNCILMAN FLOOD IS PLEASED WITH THE EXCELLENT TURNOUT FOR THE WOMEN'S SOFTBALL TEAMS. THERE ARE PRESENTLY SIX TEAMS IN THE AREA AND THE VIEWING STANDS ARE PACKED ON SATURDAY NITE~ THE POLICE CHIEF REPORTED 176 COMPLAINTS DURING JULY, NOT INCLUDING TRAFFIC STOPS. THE BUILDING DEPARTMENT HAS ISSUED PERMITS FOR NEW CONSTRUCTION, REMODELING AND ADDITIONS, BOTH RESIDENTIAL AND COMMERCIAL, FOR A TOTAL OF $102,000 DURING THE MONTH OF JULY. THIS IS THE BIGGEST MONTH WE HAVE HAD THIS YEAR. MR. FLUCK ANNOUNCED AN ICE CREAM SOCIAL WiLL BE HELD AT THE COMMUNITY CENTER ON SUNDAY, AUGUST 17TH, STATING IT IS THE FIRST OF A SERIES OF FUND RAISING EFFORTS TO SUPPORT THE "MISS SEBASTIAN" CONTEST TO BE HELD IN MARCH 1976. THE FRANCHISE FOR THIS PROGRAM CALLS FOR A 75 MILE RADIUS FROM STUART TO TITUSVILLE AND EVERYONE IS ENCOURAGED TO PARTICIPATE IN THIS ANNUAL AFFAIR. THE COMMITTEE IS ENDEAVORING TO CONDUCT THIS CONTEST WITH NO COST TO THE CITY. TICKETS ARE $1 FOR ADULTS AND 75¢ FOR CHILDREN. THE COMMITTEE WILL APPRECIATE ALL THE SUPPORT IT CAN GET AND TICKETS ARE AVAILABLE AT CITY HALL. MOTION REGULARLY MADE AND SECONDED TO ACCEPT TREE ORDINANCE #0-75-3 AS READ BY TITLE ONLY. ROLL CALL VOTE AYES: NAYS: COUNCILMEN FLOOD, GRAY AND KINARD, AND MAYOR CRAGG. NONE. CARRIED. THE COUNCIL DISCUSSED AT LENGTH THE UNSATISFACTORY AIR CONDITIONING SYSTEM AT THE COMMUNITY CENTER. TEN TONS OF AIR CONDITIONING WERE INSTALLED, AND APPARENTLY 20 TONS ARE REQUIRED TO COOL THE BUILDING WHEN THERE ARE ABOUT 185 PEOPLE PRESENT. MAYOR CRAGG REFERRED TP A LETTER OF JULY 22, 1975 FROM MR. TAYLOR ENCLOSING PLANS, EQUIPMENT DETAILS AND A PROPOSAL FROM TROPIC-AIR FOR THE ADDITIONAL AIR CONDITIONING DISCUSSED PREVIOUSLY WITH MR. TAYLOR AND MR. BUCHANON OF TROPIC-AIR AT THE WORKSHOP MEETING ON JULY 9. TROPIC-AIR'S PROPOSAL FOR INSTALLING TWO ADDITIONAL 5 TON UNITS AMOUNTS TO $4,074. THE COUNCIL FELT THIS WAS EXTREMELY HIGH AND ASKED MR. VOCELLE'S OPINION AS TO HOW TO HANDLE THIS MATTER. MR. VOCELLE SUGGESTED THE CITY ADVERTISE FOR BIDS AND THAT HE BE AUTHORIZED TO REPLY TO MR. TAYLOR'S LETTER OF JULY 22ND ALONG THE LINES THAT THE CITY HAS RECEIVED HIS LETTER AND IS ADVERTISING FOR BIDS FOR THE LOWEST AND/OR BEST BID, AND THAT THE CITY HOLDS HIM FULLY AND LEGALLY RESPONSIBLE. THE CITY WILL OFFER HIM THE OPPORTUNITY TO RECTIFY THE PROBLEM AT HIS EXPENSE OR, IF NOT, A DETERMINATION OF HIS LEGAL RESPONSIBILITIES BY JUDICIAL PROCESS. MOTION BY COUNCILMAN FLOOD, SECONDED BY COUNCILMAN GRAY, TO ADVERTISE FOR BIDS FOR AN ADDITIONAL TEN TONS OF AIR CONDITIONING FOR THE COMMUNITY CENTER. BIDS MUST BE SUBMITTED TO THE CITY BY 4 P.M., AUGUST 22, 1975, AND oPENED AT A SPECIAL MEETING ON TUESDAY, AUGUST 26TH AT 7:30 P.M. CARRIED. MOTION BY COUNCILMAN FLOOD, SECONDED BY COUNCILMAN GRAY, THAT THE CITY DONATE $500 TO THE COUNCIL ON AGING, INC. TO START THEIR PROGRAM OF "MEALS ON WHEELS" IN THE SEBASTIAN AREA. CARRIED. THE COUNCIL ON AGING, INC. WILL SUPPLY THE VOLUNTEERS TO DELIVER THE MEALS. REGULAR MEETING - AUGUST ll, 1975 (CONT'D) THE CITY CLERK WAS ASKED TO ADVERTISE FOR BIDS FOR THE RADIO EQUIPMENT FOR THE POLICE AND STREET DEPARTMENTS. BIDS MUST BE IN CITY HALL NOT LATER THAN 4 P.M.. AUGUST 22, 1975 AND WILL BE OPENED AT THE SPECIAL MEETING ON AUGUST 26. A LETTER HAS BEEN RECEIVED FROM UNITED NATIONS ASSOCIATION OF UNITED STATES ASKING THE CITY TO APPOINT A CITIZEN IN THE CITY OF SEBASTIAN TO CARRY THROUGH ON A CELEBRATION OF UNITED NATION DAY ON OCTOBER 24, 1975. AFTER DISCUSSION, MAYOR CRAGG AGREED TO TABLE THE SUBJECT UNTIL COUNCILMAN GRAY HAS AN OPPORTUNITY TO TALK TO MRS. IRENE MENSER OF THE COUNTY'S BICENTENNIAL COMMITTEE TO SEE IF ANYTHING IS BEING PLANNED FOR THAT DATE. IN RESPONSE TO A LETTER OF REQUEST FROM MRS. DARGEL, PRESIDENT OF THE FLORIDA SOCIETY COLONIAL DAMES XVII CENTURY, INDIAN RIVER CHAPTER, MOTION WAS MADE BY COUNCILMAN FLOOD AND SECONDED BY COUNCILMAN GRAY, TO ALLOW THE GROUP TO USE THE SEBASTIAN COMMUNITY CENTER, WITHOUT CHARGE, ON TUESDAY EVENING, NOVEMBER 11, 1975 FOR A PATRIOTIC TOWN GET-TOGETHER. CARRIED. DISCUSSION OF THE PROPOSED RETIREMENT PLAN FOR CITY EMPLOYEES WILL BE TABLED UNTIL THE NEXT REGULAR COUNCIL MEETING. COUNCILMAN KINARD HAS RECEIVED THE PAPERWORK FROM THE STATE CONCERNING ITS PLAN FOR CITY EMPLOYEES, BUT HE WOULD LIKE TO MEET WITH THE FINANCE COMMITTEE TO DETERMINE IF THE CITY IS ABLE TO FINANCE IT, BEFORE PROCEEDING ANY FURTHER. MOTION BY COUNCILMAN GRAY, SECONDED BY COUNCILMAN KINARD, THAT MICHAEL A. KENNEY, 567 SW WIMBROW DRIVE, BE APPOINTED TO THE ZONING & PLANNING COMMITTEE EFFECTIVE THIS DATE. CARRIED. THERE MAY BE ANOTHER OPENING ON THIS COMMITTEE, HOWEVER, THIS WILL HAVE TO BE TABLED UNTIL THE SPECIAL MEETING ON AUGUST 26 UNTIL MR. DAN O'BRIEN IS CONTACTED. MOTION BY COUNCILMAN FLOOD, SECONDED BY COUNCILMAN GRAY, TO INCREASE THE AIRPORT COMMITTEE TO FIVE MEMBERS. CARRIED. MOTION BY COUNCILMAN GRAY, SECONDED BY COUNCILMAN KINARD, TO ADVERTISE FOR BID ON A SMALL TRACTOR. CARRIED. WITH REFERENCE TO THE SURVEY TO BE MADE AT THE AIRPORT BY THE CITY ENGINEER, COUNCILMAN GRAY ASKED THAT THIS MATTER BE TABLED UNTIL SUCH TIME AS HE IS ABLE TO GET TOGETHER WITH THE CITY ENGINEER TO GO OVER A 1959 AIRPORT MAP MADE BY A FORMER CITY ENGINEER, MR. JAMES W. DARLING. THE REQUEST TO RELOCATE THE CHAMBER OF COMMERCE BUILDING ON CITY PROPERTY WILL BE HELD IN ABEYANCE PENDING A RULING FROM THE ATTORNEY GENERAL. A RECENT ISSUE OF "DATAGRAMS" STATES THAT "ASSUMING THAT THE CHAMBER OF COMMERCE WOULD NOT BE CHARGED A RENT OF FULL MARKET VALUE, IT IS NOT A PROPER PUBLIC PURPOSE FOR THE CITY TO ALLOW THE CHAMBER OF COMMERCE TO UTILIZE A PORTION OR ALL OF A MUNICIPALLY OWNED BUILDING. NOR MAY THE CITY DONATE MONEY TO THE CHAMBER FOR GENERAL PURPOSES." IT IS NOT KNOWN AT THIS TIME IF THIS WOULD INCLUDE CITY PROPERTY AND COUNCILMAN GRAY ASKED THAT IT BE BROUGHT UP AT THE AUGUST 26 MEETING. THE CITY CLERK READ A LETTER FROM RALPH HAIMOWITZ, PRESIDENT OF THE MISS SEBASTIAN PAGEANT ASSOCIATION, INC., IN WHICHHE EXPLAINED THE ASSOCIATION IS A NON-PROFIT ORGANIZATION OF CITIZENS WHO HAVE TAKEN IT UPON THEMSELVES TO CONTINUE THE MISS SEBASTIAN PAGEANT ON AN ANNUAL BASIS. ALL FUNDING REQUIRED FOR THIS ACTIVITY WILL BE RAISED BY THE ASSOCIATION WITH THE EXCEPTION OF THE REQUIRED RRANCHISE FEE. BECAUSE THE MISS FLORIDA OFFICIALS REQUIRE A GOVERNMENTAL OR SERVICE C~UB ORGANIZATION SPONSORSHIP TO OBTAIN THE NECESSARY FRANCHISE, THE ASSOCIATION IS ASKING THE CITY FOR THIS SUPPORT. MRS. PHELAN HAS FORWARDED A LETTER OF REQUEST FOR THE 1976 FRANCHISE TO THE MISS FLORIDA OFFICIALS IN ORLANDO. THE COUNCIL APPROVED THE TEEN CLUB'S REQUEST TO CHANGE THEIR FRIDAY NIGHT DANCES TO SATURDAY NIGHTS FOR THE PERIOD SEPTEMBER 13, 1975 UNTIL JANUARY 1, 1976. THE POLICE CHIEF ADVISED COUNCILMAN GRAY THAT THE AUTOMATIC CHANGE OVER OF THE SEBASTIAN POLICE DEPARTMENT TELEPHONE TO THE SHERIFF'S DEPARTMENT HAD BEEN INSTALLED AND IS IN SERVICE. MAYOR CRAGG EXPLAINED FOR THE BENEFIT OF THE PUBLIC THAT WE NOW HAVE A SET-UP IN CITY HALL THAT WHEN THE POLICE ARE NOT IN CITY HALL, TELEPHONE CALLS WILL AUTOMATICALLY BE TRANSFERRED TO THE SHERIFF'S DEPARTMENT WHO, IN TURN, WILL CONTACT THE SEBASTIAN POLIC~ BY RADIO. IT TAKES ABOUT 4-1/2 SECONDS FROM THE TIME THAT THE FIRST RING IS MADE UNTIL PICK-UP BY THE SHERIFF'S DEPARTMENT. COMPLAINTS WERE RECEIVED FROM TWO RESIDENTS IN THE AUDIENCE REGARDING GROWTH ON LOTS IN THE AREAS OF THEIR HOMES. MAYOR CRAGG EXPLAINED THAT GDC HAS NOTIFIED THE CITY THEY WILL DISCONTINUE MOWING CERTAIN LOTS IN UNIT #1. Discussion continued as to whether the City SHOULD TAKE OVER THIS PROJECT AND DO THE WORK THEMSELVES OR CONTRACT IT TO PRIVATE ENTERPRISE IT WAS GENERALLY AGREED BY THE COUNCIL, HOWEVER, THAT THE AMOUNT OF WORK iNVOLVED WOULD -2- VERO BEACH PRESS-JOURNAL. MAYOR CRAGG STATED THAT AT ONE TIME GDC THOUGHT THEY COULD GET THEIR HEADQUARTERS TO WRITE A LETTER TO THE PEOPLE WHOSE LOTS THEY HAD BEEN CUTTING,ADVISING THEY ARE NO LONGER GOING TO DO IT. MR. VOCELLE, 'CITY ATTORNEY, REFERRED TO CITY ORDINANCE #199 PROHIBITING WEEDS, GRASS OR UNDERGROWTH TO GROW ON ANY LOT, PARCEL, OR TRACT OF LAND WITHIN THE CITY OF SEBASTIAN, TO A HEIGHT OF TEN INCHES OR MORE FROM THE GROUND, OR TO PERMIT RUBBISH, TRASH, DEBRIS, DEAD TREES OR OTHER UNSIGHTLY OR UNSANITARY MATTER TO REMAIN THEREON. MRS. PHELAN, CITY CLERK, EXPLAINED THAT WHEN A COMPLAINT IS RECEIVED THAT A VIOLATION EXISTS, A LETTER IS WRITTEN TO THE OWNER GIVING HIM 15 DAYS IN WHICH TO COMPLY WITH THE ORDINANCE. IF THE OWNER ELECTS TO HAVE THE CITY DO THE WORK, A BILL IS SENT TO HIM. IF THE BILL IS NOT PAID, A LIEN CAN BE FILED ON THE PROPERTY BUT TO DATE THIS HAS NOT BEEN NECESSARY. MR. VOCELLE SUGGESTED THE PEOPLE IN THE AUDIENCE FILE THEIR EXISTING COMPLAINTS WITH THE CITY CL~RK. SHE IN TURN WILL WRITE TO THE OWNERS. HE SUGGESTED A MEETING WITH GDC TO BE HELD ON THIS SUBJECT AND MAYOR CRAGG ADVISED MR. BEVAN WOULD BE INVITED TO THE SPECIAL MEETING ON AUGUST 26, 1975. MAYOR CRAGG WILL CALL A MEETING WITH THE CITY ATTORNEY AND CITY ENGINEER ON THE STREET SITUATION iN SEBASTIAN HIGHLANDS IN REGARD TO TAKING OFF THE BONDS.
