(AND ATTORNEY L. B. VOCELLE.) MOTION BY COUNCILMAN YATES THAT MINUTES OF REGULAR MEETING OF JULY g AND SPECIAL MEETING OF JULY 26, 1973 BE ACCEPTED AS READ. SECONDED BY COUNCILMAN FLOOD. CARRIED. MOTION BY VICE MAYOR CRAGG, SECONDED 8Y COUNCILMAN HOOSE, THAT JULY BILLS IN THE AMOUNT OF $4,771.3,0 be paid. carried. ~ · ! MR. WILLIAM C088, ATTORNEY FOR ROSELAND PROPERTY OWNERS ASSOCIATION, SPOKE TO THE COUNCIL ON THE PROPOSED ANNEXATION ORDINANCE, VOICING OBJECTION. MR. KEPPLER, WHO HAD REQUESTED THE ANNEXATION INTO SEBASTIAN, REPLIED TO SOME OF THE STATEMENTS MADE BY ATTORNEY CDSB. (The following also voicsd comments against annexation - Mr. Fred Hutch (Sebastian River Area Conservation); Richard Thomas, Jr. (Sebestian); Hazel Holtzclaw Baker (Roseland); Dr. Henry Fischer (Roseland)~ Frank Zorc (Roseland); Ira South (Sebastian) - Mr. South also mentioned "Garbage was a part of our taxes and now it is separate. (Incorrect). Georgia Allen (Roseland) commented "it would seem you are goin9 back to the high school level of competition between areas." MOTION BY COUNCILMAN HOOSE, SECONDED BY COUNCILMAN FLOOD, TO ACCEPT REPORT AND FOR THE COUNCIL TO UPHOLD ZONING COMMITTEE DECISION ON THE CHANGE OF ZONING REQUEST TO CHANGE C-1 RETAIL TO C-2 COMMERCIAL FROM MR. CHRISTENA. MR. CHRiSTEN'S REQUEST WAS DENIED. CARRIED· THE QUESTION WAS RAISED AS TO WHETHER REFUNDS ON DEPOSITS OF BIDDABLE BUILDING PLANS WERE PERMITTED. CITY ATTORNEY VOCELLE STATED THAT ACCORDING TO CITY POLICY SUCH DEPOSITS HAVE NEVER BEEN REFUNDED BY THE CITY. (Mr. Langfit, who has asked for such a refund, is to be so advised by the City Clerk.) COUNCILMAN HOOSE REPORTED THAT A NEW SPRINKLER SYSTEM WOULD BE INSTALLED IN THE CEMETERY NEXT WEEK AND THE ROAD WOULD BE PAVED SHORTLY THEREAFTER. PELICAN ENTERPRISES, SEBASTIAN, REQUESTED PERMISSION TO PUT A CONSTRUCTION TRAILER ON CONTEMPLATED BUILDING SITES IN SEBASTIAN HIGHLANDS. REQUEST GRANTED IN ACCORDANCE WITH CHAPTER 25-11 AND 25-12, CODE OF ORDINANCES. MOTION BY COUNCILMAN YATES TO ADOPT RESOLUTION ON ZONING MORATORIUM AS READ BY CITY CLERK. (Copy attached). -'% REQUEST MADE BY THE SEBASTIAN POLICE DEPARTMENT TO HAVE DEPARTMENT OF TRANSPORTATION INSTALL A SOUTHBOUND HOLDING LANE IN FRONT OF THE SEBASTIAN RIVER BANK AS A SAFETY PRECAUTION. ONE SERIOUS ACCIDENT HAS ALREADY OCCURRED IN THIS AR'E'A~. MAYOR ZIMMER AGREED TO WRITE LETTER TO DEPT OF TRANSPORTATION ON THIS REQUEST. MOTION BY COUNCILMAN YATES, SECONDED BY COUNCILMAN HOOSE, THAT ORDINANCE ON ANNEXING KEPPLER PROPERTY BE READ FOR THE FIRST TIME IN ITS ENTIRETY. (Complies with Fla Stat. 171.16) ROLL CALL VOTE: AYES - VICE MAYOR CRAGG, COUNCILMEN HOOSE, YATES AND MAYOR ZIMMER. NAYS - COUNCILMAN FLOOD. CARRIED. MOTION BY VICE MAYOR CRAGG THAT COUNCIL ACCEPT THE GENERAL DEVELOPMENT CORPORATION REQUEST FOR REPLAT j OF PORTION OF UNIT g AND PARTIAL PORTION OF UNIT 16. THIS IS TO INCREASE LOT SIZES AND EXTEND WATER AND SEWER LINES TO THIS AREA. SECONDED BY COUNCILMAN FLOOD. CARRIED. CONTINGENT UPON UNDERSTANDING THAT MR. BEVAN (GDC) WORK OUT CORPORATE BOND FIGURES WITH OUR CITY ENGINEER. MR. 8EVAN AND MR. DOHMAN MENTIONED REMOVAL FROM THE FIRST REPLAT OF UNIT 13 REGARDING DELETION OF LOTS 12 THRU 19 INCLUSIVE AND LOTS 22 THRU 24 INCLUSIVE IN BLOCK 321, SEBASTIAN HIGHLANDS UNIT #13, AS THESE LOTS ARE NOT SUITABLE FOR BUILDING. (Too low and mucky - these lots were shown on p~eliminary pla submitted to the City.) MOTION BY VICE MAYOR CRAGG THAT CITY ATTORNEY PREPARE RESOLUTION FOR ADOPTION OF THE CHANGE OF FISCAL YEAR FROM NOVEMBER I TO OCTOBER i IN COMPLIANCE WITH STATE LAW HB-11?6, SEC. 218.33, 1-4. SECONDED BY COUNCILMAN HOOSE. CARRIED. DISCUSSION WAS HELD REGARDING ORDINANCE COVERING PERMIT FEES. CITY ATTORNEY WAS ASKED TO PREPARE A REVISED ORDINANCE TO BECOME EFFECTIVE BEGINNING THE NEW FISCAL YEAR i OCTOBER, IF AT ALL POSSIBLE. MOTION BY VICE MAYOR CRAK. G TO DENY REQUEST FROM MR. COPP at ux TO A8ANDON ALLEY AT REAR OF HiS PROPERTY. SECONDED BY COUNCILMAN HOOSE. CARRIED. MOTION BY COUNCILMAN HOOSE, SECONDED BY COUNCILMAN FLOOD, FOR FIRST READING IN ITS ENTIRETY OF ORDINANCE GIVING PLANNING & ZONING COMMITTEE THE AUTHORITY AND ADDITIONAL POWERS TO APPROVE SITE PLANS. ROLL CALL VOTES - AYES - VICE MAYOR CRAGG, COUNCILMEN HOOSE, FLOOD, YATES AND MAYOR ZIMMER. NAYS - NONE. CARRIED. MOTION BY ViCE MAYOR CRAGG THAT COMMITTEE (Pat Flood, Chairman) REVIEWING BUILDING REGULATIONS FOR THE CITY OF SEBASTIAN BE GRANTED UP TO S500 FOR SECURING PROFESSIONAL ADVICE ON REVISING PRESENT BUILDING CODE OR ADOPTING NEW CODE. SECONDED BY. COUNCILMAN HOOSE. CARRIED. THE CITY ATTORNEY WAS REQUESTED TO DRAW UP A REVISION TO ORDINANCE 6-1 THRU 6-4 "ANIMALS AND FOWL" TO PROHIBIT KEEPING AND MAINTAINING AND ROAMING AT LARGE OF ANY TYPE LARGE ANIMAL INCLUDING LIVESTOCK AND FOUL, DUCKS, GEESE, ETC. (excluding houeehold pete euch ae cate and doge) ~ITHIN THE CiTY LIMITS. MOTION BY VICE MAYOR CRAGG TO AUTHORIZE THE CITY CLERK TO REPRESENT THE CITY OF SEBASTIAN AT ~VERNMENTAL ACCOUNTING MEETING IN LAKELAND ON 29~'30 NOVEMBER AND i DECEMBER AND SECOND SESSION 14-16 MARCH WiTH REGISTRATION FEE OF $15.00 TO INCLUDE BOTH SESSIONS.
