Klm Fisher, 265 DelMonte Road, Sebastian, addressed
Council on behalf of Mel and Taffi Fisher. He
assured Council that the property owners were willing
to work with the city on exterior design of the
building.

Following a brief discussion motion was made.

I move that we direct the Council to prepare an
ordinance in accordance with Mr. Cooper's memo
June 28, 1991 to Planning and Zoning and to include
the requirements for a permit, a $1 permit fee and
a limit of one sale every six months with the
exceptions that are stated in Mr. Cooper's letter
regarding non-profit organizations and church
organizations.

MOTION by Oberbeck/Powell
I move we that direct staff to prepare the
ordinance regarding garage sales and that we permit
the general public as we have in writing here with
regard to charitable organizations and non-profit
organizations to have garage sales four times per
year and I would suggest to staff a card issued by
city at a cost of $2 the permitting fee and I would
add that the signs be placed on private property with
permission of property owner as stated in this
recommendation.

questioned the administrative costs if permitting is
implemented.

Mayor Conyers announced that since Councilman Holyk's
schedule did not allow him to attend all meetings of
the Indian River Transportation Planning Committee,
Mayor Conyers would take the position and Councilman
Holyk would continue to serve as alternate.

Concerns (Mayor Conyers) (Mayor's Memo dated

Following input from Mayor Conyers relative to
concerns expressed to him by a member of the
Handicapped Self-Evaluation Committee during his
Mayor's forum, the City Manager stated he would
contact the committee to obtain their input.
Discuss Federal Railroad Administration Order Re:
Resumption of FEC Train Whistles Use Between 10
P.M. and 6 A.M. (Mayor Conyers)(FEC Letter dated

Subsequent to a brief discussion, it was the
consensus of Council to send a letter in support of
Indian River County'S appeal to the Federal Railroad
Administration's order overriding the ban on train
whistles between 10 p.m. and 6 a.m.
Discuss Cable Television Franchise - Attorney
General Report (Mayor Conyers)(Datagram 7/23/91)
Mayor Conyers provided information to City Council
regarding the City of Niceville, Florida going into
the cable business and inquired whether Council
wanted to consider doing investigative work to do
likewise. Although Council expressed no urgency,
staff was directed to look into the matter.

The Airport Manager addressed Council and expressed
no concerns for this proposed residential airport in
Veto Beach.

Mayor Conyers read the consent agenda in its
entirety and removed item I - Emergency Management
Committee_- Request Purchase of Cellular Phone for
"EOC" - Communications International, Inc. of Veto
Beach. He said that Bell South Mobility had called
him and offered a $1000 grant to the City of
Sebastian, for purchase of cellular phones,
therefore, this item can be removed. The City
Manager said Bell South has a contract with a
government rate that he is recommending the city
utilize. Council concurred in acquiring two phones,

Vice Mayor Oberbeck withdrew item J - Waive Bid
Procedure to Purchase Pre-School Playground Equipment
- Dominica Recreation Products Proposal - $5,221.00
He questioned why the installation price--was removed
and when did the Council approve this purchase. The
City Manager responded that the intent is to move
certain equipment from Candy Land Park to Riverview
Park and contrary to staff recommendation, he
concurred with Vice Mayor Oberbeck that Dominica
should be responsible for the installation of the
equipment.

I move we remove that (item j) in its entirety
from the consent agenda and then I will with the
approval of the Council bring that up immediately
after we vote on the consent agenda.

Introduction of Business from the Public - John
J. Kanfoush, 1437 Seahouse Street - Accumulation
of Water Since End of May Due to C~nstruction (No
Backup)(Must Work Until 8 P.M. - May Require
Being Moved on Agenda)
John Kanfoush, 1437 Seahouse Street, Sebastian,
requested assistance from Council in regard to water
standing in his rear yard allegedly as a result of
new construction ad3acent to his property and
recommended that Council adopt an ordinance to
alleviate problems such as this. Mr. Kanfoush was
advised that his property was most likely not
correctly designed for proper drainage, that it
probably required additional fill under the direction
of the Public Works Department and Department of
Community Development.

Councilman Holyk initiated a discussion of criteria
used in choosing the placement of legal ads and
suggested a bidding procedure. The City Manager
suggested that staff bring a recommendation to
Council in the new fiscal year.

interest in city government and become more aware of
its inner workings.

matters; status of GDC negotiations; proposals to the
city's three unions; and the status of tanks at the
airport.
