PRESENT: COUNCILMAN FRANK OBERBECK, COUNCILMAN RICHARD VOTAPKA, COUNCILMAN GEORGE SCHUM, CITY ATTORNEY DANIEL KILBRIDE AND VICE MAYOR EVERETT T. GASS, ABSENT: MAYOR PAT FLOOD, JR. ( EXCUSED, AWAY ON OFFICIAL BUSINESS) VICE MAYOR GASS REPORTED THAT MAYOR FLOOD WAS IN WASHINGTON PRESENTING THE CITY'S APPEAL REGARDING THE LOCATION OF THE POST OFFICE SINCE, IT WAS THE POSTAL AUTHORITIES INTENTION TO CONSTRUCT A POST OFFICE NORTH ON Uo S. #1 BEYOND THE CITY LIMITS. HE STATED THAT MAYOR FLOOD IS REQUESTING THAT THE POST OFFICE BE PLACED IN ANOTHER LOCATION IN THE CITY. VICE MAYOR GASS ANNOUNCED THAT A SPECIAL MEETING WOULD BE HELD REGARDING THE APPEAL OF MR. DE CARLO, A LOCAL CONTRACTOR, ON AUGUST 25, 1982, AT 7:00 P.M., IN CITY HALL. VICE MAYOR GASS REPORTED THAT HE MET WIHT FLORIDA POWER AND LIGHT REPRESENTATIVES TO DISCUSS THE CHANGE OVER OF STREET LIGHTS TO 9500 LUMENS AND IT WAS INDICATED THAT THIS PROCESS WOULD BEGIN WITHIN THE NEXT MONTH OR SO. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, THAT A RESOLUTION RESCHEDULING THE WORKSHOP AND REGULAR COUNCIL MEETINGS BE MADE AN AGENDA ITEM. CARRIED. ATTORNEY KILBRIDE READ IN ITS ENTIRETY A RESOLUTION OF THE COUNCIL OF THE CITY OF SEBASTIAN ING THE MEETING DATES, TIMES AND PLACES FOR THE REGULAR MEETINGS OF THE COUNCIL; ESTABLISHING FFECTIVE DATE. ON BY COUNCILMAN VOTAPKA, SECONDED BY ILMAN SCHJM, PT A RESOLUTION OF THE COUNCIL OF THE CITY OF SEBASTIAN SETTING THE MEE?ING DATES, T~M~S AND PLACES FOR THE REGULAR MEETINGS OF THE COUNCIL; ESTABLISHING AN i~F~IVE DATE. CARRIED. ATTORNEY KILBRIDE REPORTED THAT THE HEARING~S L~'~D C0~ERNI~ THE PROPOSED CHARTER CHANGE AND THAT THE JUDGE DID RULE THAT THIS CHARTER CHANGE BE IMPLEMENTED AND THAT THE COUNCIL TAKE STEPS TO CONCUR WITH THE STATE LAW. HE EXP~D T~THE COUNCIL CAN EITHER INSTRUCT HIM TO CONCUR WITH THE THE CLERK REGARDING THE SURETY CF ~i-LING WITH THE DEPARTMENT OF STATE AND HAVING THE PROPOSED CHANGE INCORPORATED INTO T~E C~AR~R ITSELF OR WHETHER TO APPEAL THIS RULING SINCE, THE WRITTEN RULING HAS NOT BEEN H~NI~ED~OWN AND THE COUNCIL HAS BEEN GIVEN TO SEPTEMBER i9S2, TO COMPLY. | VICE MAYOR GASS STATED THAT THIS MATTER BE DISCUSSED FURTHER AT THE NEXT REGULAR COUNCIL MEETING, SEPTEMBER 8, 19~2.,~ . ~ ~ ~ ,_ SINCE ADDiTiONAL iNFOR f~l,~ CLP~iFY[N~REIU]~St F~{ ~-'--"~ ~ ~ PROPOSAL TO TRIM AND SHAPE TREES WITH A FIVE MAN CREW AT AN HOURLY RATE OF $25.00 PER HOUR INCLUDING EQUIPMENT. AFTER SOME LENGTHY DISCUSSION, COUNCILMAN OBERBECK FELT THAT A DESIGNATED AREA SHOULD BE iIFIED AND THAT A TOTAL ANTICIPATED AMOUNT OF HOURS AND FEE BE ESTABLISHED. ICILMAN VOTAPKA AGREED BUT REQUESTED MR. BOB DOHERTY, SUPERINTENDENT STREET DEPARTMENT I0 A COST COMPARISON BETWEEN ARISTOCRAT SERVICES AND THE CITY CREW DOING THE WORK. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN SCHUM, THAT DANNY MULLEN, ARBORIST, ARISTOCRAT SERVICES, MEET WITH MR. DOHERTY, QUOTE US A PRICE, TAKE CARE OF THE TREES ON CITY PROPERTY, IMMEDIATELY EAST OF CITY HALL, INCLUDING THE PARK AREA AND THE ALLEY EXISTING TO THE EAST AND THE TREES ON THE SOUTH SIDE OF THE BUILDING. IF HE WANTS TO ABIDE BY HIS $35.00 PER HOUR, HE SHOULD GIVE US A BALL PARK FIGURE ON MAN HOURS. CARRIED. VICE MAYOR GASS INSTRUCTED THE CITY CLERK TO CONTACT MR. MULLEN AND TO HAVE HIM COME INTO CITY HALL ON MONDAY, AUGUST 25, 1982, BETWEEN 10:00 A.M. - 11:00 A.M. VICE MAYOR GASS REPORTED THAT REAPPOINTMENT OF GREG PALMER, CHRIS KIRRIE AND DON LANGLOIS NEEDED TO BE MADE TO THE SEBASTIAN CONSTRUCITON BOARD. SINCE THE POLICY HAS BEEN TO CONTINUE TO REAPPOINT MEMBERS, COUNCILMAN OBERBECK RECOMMENDED THAT THE POLICY BE CHANGED AND THAT THE CITY ADVERTISE AND SOLICIT FOR PEOPLE WHO MAY BE INTERESTED IN FILLING THOSE POSITIONS. MOTION BY COUNCILMAN VOTAPKA, THAT WE REAPPOINT THE THREE PEOPLE WE HAVE BEFORE US. MOTION DIED FOR LACK OF A SECOND. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN SCHUM,.THAT WE ADVERTISE IN THE LOCAL NEWSPAPER FOR APPLICATIONS FOR A PLUMBING CONTRACTOR, AIR CONDITIONING CONTRACTOR AND CONCERNED CITIZEN AND THAT THE INCUMBENTS FILL OUT AN APPLICATION AND REAPPLY FOR THE POSITION. ON AMENDED BY COUNCILMAN OBERBECK, SECOND AMENDED BY COUNCILMAN SCHUM, THAT THE CUT OFF BE SEPTEMBER 8, 1982, WITH APPOINTMENTS MADE ON SEPTEMBER 15, 1982, TAKING EFFEC UPON THE VACATING CONSTRUCTION BOARD MEMBERS ON SEPTEMBER 30, 1982. CARRIED. REGULAR COUNCIL MEETING - AUGUST 18, 1982 MOTION BY COUNCILMAN SCHUM, SECONDED BY COUNCILMAN VOTAPKA, THAT WE DO ALLOW THE SEBASTIAN VOLUNTEER FIRE DEPARTMENT TO USE THE COMMUNITY CENTER, FREE OF CHARGE ON NOVEMBER 6, 1982. CARRIED. COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, THAT THE SEBASTIAN VOLUNTEER FIRE DEPARTMENT GIVE ASSURANCE TO THE SEBASTIAN CITY COUNCIL THAT THEY HAVE COMPLIED WITH THE LETTER OF THE LAW FOR OPERATING A LAS VEGAS NIGHT AT THE COMMUNITY CENTER ON NOVEMBER 6, 1982, AND THAT THEY REPORT BACK TO THE CITY COUNCIL BY SEPTEMBER 8, 1982. CARRIED. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, THAT WE GRANT THE ALCOHOLIC BEVERAGE REQUEST CONDITIONALLY UPON THE PRECEEDING MOTION. CARRIED. MOTION BY COUNCILMAN SCHUM, SECONDED BY COUNCILMAN OBERBECK, TO BRING TO THE FLOOR A DISCUSSION REGARDING THE SWIMMING POOL COMMITTEE. CARRIED. COUNCILMAN SCHUM REPORTED THAT HE RECEIVED A COPY OF THE LATEST RULES AND REGULATIONS TO FOLLOW REGARDING LICENSING OF SWIMMING POOLS AND THAT THE NEXT MEETING OF THE COMMITTEE WILL BE TUESDAY, AUGUST 24, 1982, at 7:30 P.M., IN CITY HALL. IN RESPONSE TO COUNCILMAN VOTAPKA'S QUESTION REGARDING THE COMPLETION OF THE BIKE PATH, EARL MASTELLER, CITY ENGINEER REMARKED THAT HE FELT COMPLETION SHOULD BE BY THE END OF THE MONTH, ONE WEEK AFTER SCHOOL STARTED.
