SECTION I: CLARIFICATIONS • N/A SECTION II: QUESTIONS • Question 1: I was still unclear on the 5% bid bond and the 10% performance bond. I understand that if awarded, we need the 10% bid bond b ut unclear on the 5% bid bond and what form of info do you need with that? Is that a check that won’t be cashed? A note from a surety company saying that they will put the surety bond up or a cashiers check? • Answer: The Proposal Security Form has been included in this addendum. Proposers can submit this form, or a contractor may file an alternative form of security in cash, a money order, a certified check, a cashier’s check, or a domestic corporate bond, note, or debenture as authorized in s. 625.317. The electronic proposal security shall be issued by a company with a registered agent in Florida. Personal or business checks are not acceptable. The successful Proposer's proposal security will be retained until the Proposer has executed the agree ment and furnished the required Performance Bonds, at which point the Proposal Security will be returned. If the successful Proposer fails to execute and deliver the agreement and provide the required Bonds within fifteen (15) days of the Notice of Award, the City may annul the Notice of Award, and the Proposal Security of that Proposer will be forfeited. The City may retain the Proposal Security of any Proposer the City believes has a reasonable chance of receiving the award until the ninety-first (91st) day after the Proposal Opening. If the proposer submits an alternative form of security (cash, money order, a certified check, a cashier’s check), the City will return the security after the ninety-first (91st) day after the Proposal Opening. NOW, THEREFORE: the conditions of this obligation are such that if the Bid is accepted, the Principal shall, within fifteen (15) days after the receipt of notification of the acceptance thereof, execute a contract in accordance with the Bid and upon the terms and c ondition of such Bid, in the form and manner required by the City, and execute a sufficient and satisfactory Public Construction Bond or separate Payment and Performance Bonds payable to the City, in an amount not less than the total contract price, as ind icated by the approximate quantities shown in the Bid, in form and with security satisfactory to the City, then this obligation to be void; otherwise to be and remain in full force and virtue in law; and the surety shall, upon the failure of the Principal to comply with any or all of the foregoing requirements within the time specified above, immediately pay to the aforesaid City upon demand, the amount hereof in good and lawful money of the United States of America, not as a penalty, but as liquidated dama ges.
