however, being no input, he closed it.

The City Attorney explained the City Council's
legal function relative to Mr. Gilliam's appeal,
responded to questions regarding procedure and swore
in Damian Gilliams.
Damian Gilliams, Project Manager, Channel 68
Restaurant and Marina, presented his case to Council
for approval of a modification to his site plan to
allow nine foot parking spaces, citing a need for
additional parking spaces which he stated he had tried
to resolve by attempting unsuccessfully to purchase
adjacent property.
The City Engineer stated his objection to the request
and a lengthy discussion followed.
J.W. Thompson, 125 Main Street, Sebastian,
recommended denial.
Councilman Reid requested that the record show that
the appeal should have cited the uniqueness of the
Riverfront district in regard to limited space and
that development in that area requires flexibility.

J.W. Thompson, 125 Main Street, Sebastian, requested
that staff be directed to amend the code to allow
nine foot parking spaces.
In response to a recommendation that staff amend the
code, the City Manager said amendment to the code
could be initiated by Planning and Zoning.
PUBLIC INPUT ON AGENDA ITEMS
Claudean Silvio, 641 Crystal Mist, Sebastian, spoke
regarding drainage problems.
Mayor Conyers called recess at 8:00 p.m. and
reconvened the meeting at 8:15 p.m. Ail members were

Job Description
Councilman Holyk inquired whether stormwater utility
would fall under the duties of the Utilities
Director. The City Manager responded that that
decision will be made when the utility is set up.

Vice Mayor Oberbeck requested that the item be
deferred so that a salary comparison can be seen.
The City Manager responded that the Finance Director
had prepared support documents regarding salary
comparisons for the agenda packet, however, he had no
problem with deferring the item.

10. MAYOR'S MATTERS
Mayor Conyers recommended, in light of a resignation
letter he received from George Schum from the
Handicapped Self-Evaluation Committee, that Ted
Zamosky be appointed. Board application procedures
were explained to Mr. Zamosky.
Mayor Conyers commended City Clerk, Kay O'Halloran,
for qualifying for sustaining membership in the
International Institutes for Municipal Clerks'
Academy for Advanced Education.
Mayor Conyers read a letter from Indian River County
Chairman, Richard Bird (see attached) regarding the
city's proposed water and sewer franchise and
discussion on the matter followed. The City Manager
advised Council that a meeting between city and
county staff has been scheduled for September 4,
1991.

Councilman Holyk recommended that the public be made
aware of the complexity and magnitude of items
pending before Council, which will be discussed at
the September workshop, and that the public utilize
public input to make Council aware of what it wants.

Councilman Reid requested that a progress report on
stormwater drainage be placed on the September
workshop.

13. CITY MANAGER MATTERS
The City Manager scheduled, with Council's
concurrence, an executive caucus with the city's
unions for August 29, 1991 at 9:00 a.m.
The City Manager brought a request from Superamerica
to locate a construction trailer on the CAVCORP
property. The City Attorney advised that staff
require insurance coverage and verify compliance of
the city's landlord. The City Manager said he will
report back to Superamerica and advise them to comply
with the City Attorney's recommendation. Discussion
ensued on charging a reasonable rent, as recommended
by the City Attorney.

15. OLD BUSINESS
Police Station Negotiation (City Manager
Recommendation dated 8/22/91, ADG Letter dated

Subsequent to a brief history of events in regard to
negotiations for the police facility construction and
recommendation by the City Manager to hire an
independent estimator to verify that the city is
receiving fair credit for all proposed reductions in
the pro3ect budget a brief discussion took place.
Motion was made by Councilman Holyk and seconded by
Vice Mayor Oberbeck to direct the City Manager to
find an independent estimator to look the contract
over and make sure the city is getting its money's
worth, however, the City Manager said he had the
spending authority since it would not cost over $2000
and the motion was withdrawn.

Council, by consensus, directed the City Attorney to
draft an addendum to the J & S Aviation Lease in
concurrence with the City Manager's recommendation
dated 8/22/91 (see attached).
The City Manager advised Council that dollar figures
for the lease would come back to them for approval.
Waive Bid Procedure and Authorize Engagement of
Hoyman, Dobson & Co. to Assist in Selection of
and Negotiation with Computer Systems and
Software Vendors - Not to Exceed $6,000 (Staff
Recommendation dated 8/22/91)
In response to the City Manager's recommendation for
engagement of the city's auditors at an hourly rate
to assist staff in selection of computer systems and
software, motion was made as follows.

I move we grant a waiver of the bidding procedure
and authorize the engagement of Hoyman, Dobson & Co.
to assist with the cap on fees of $6,000.

I move to adopt Resolution No. R-91-31.
The City Attorney said he had recommended to Attorney
Cloud several minor changes including the addition of
a new Section 5 in the actual agreement which he read
into the record and requested those revisions be
included in the motion.
Vice Mayor Oberbeck and Councilman Holyk agreed to
add to their motion, "include the revisions as
brought to our attention by the City Attorney".

sewer legal counsel.

Golf Course Consultant Selection - Approve
Proposal from Professional Golfers' Association
(PGA) - $6,000 (Staff Recommendation dated
8/22/9T, PGA & NGF Proposals Under Separate
Cover)
Discussion took place on the merits of each proposal
and the 100% difference in costs. The Golf Course
Manager said PGA bid on what the city asked for and
that if the city was now requiring more they should
have another opportunity to bid.

I move we engage the PGA Association for $6000.
Vice Mayor Oberbeck said he'd like to see PGA bring
back some of the additional scope that has been
brought to Council's attention.
