CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA ALL PROPOSED ORDINANCES AND INFORMATION ON ITEMS LISTED BELOW MAY BE INSPECTED IN THE OFFICE OF THE CITY CLERK, CITY HALL, 1225 MAIN STREET, SEBASTIAN, FLORIDA Mayor Votapka called the special meeting to order at 1:00 P.M. 2. The Pledge of Allegiance was recited. Mayor Votapka dispensed with roll call and requested that each bodies' secretary show those present. PRESENT: Mayor Richard B. Votapka Vice Mayor Peter Vallone Councilman George Metcalf ALSO PRESENT: Commission Chairman, Don C. Scurlock Commission Vice Chairman, Gary Wheeler Commissioner Carolyn Eggert Commissioner Margaret Bowman Commissioner Richard Bird ABSENT: Councilman Kenneth Roth (excused) Councilman Robert McCarthy (excused) Mayor Votapka stated that the purpose of this joint meeting was to discuss numerous items, gather information which will enlighten the City of Sebastian on County projects and foster better relations and cooperation between the two governments. 4. AGENDA MODIFICATIONS (ADDITIONS AND/OR DELETIONS) Vice Mayor Vallone requested discussion of joint cooperation regarding utilization of the County Building Department for building inspections and city planning. This was added as item M. MOTION by Metcalf I move we delete items A, B, C, D, I and K. Councilman Metcalf said he had listed his reasons for his request for withdrawal of these items in a memo dated August 29, 1988. MOTION died for lack of a second. Commissioner Eggert requested an update on the City of Sebastian proposed ordinance to allow a library in multiple family zoning. This was added as item N. 5. AGENDA ITEMS Joint Cooperation Of Indian River County And The City of Sebastian In The Repair Of Barber Street In Sebastian Through the Efforts of Indian River County Public Works Director, Jim Davis And Sebastian City Manager, Robb McClary Mayor Votapka said Barber Street south of Joy Haven and the southern extension of the city portion of Schumann Drive are being repaired through the joint efforts of the Indian River County Commission, Sebastian City Manager, Robert McClary and County Public Works Director, Jim Davis. He thanked all those involved in the project. Jim Davis gave an update on the paving project. He said there has been communication be%ween the field people involved, said he felt the project would be forthcoming in September and would take approximately two weeks depending on the weather. When questioned by Mayor Votapka about the possibility of using gas tax funds for a bikepath in conjunction with the paving, Jim Davis said local citizen groups in the County are holding fundraisers to raise money for bikepaths since there is no County revenue source at this time. Mr. Davis said the approximate cost for bikepaths is $7.50 to $10.00 per foot. 2 Commissioner Bird said the joint County/City Bikepath Committee had the day before approved the master plan for a Countywide master bikeway system and would start to prioritize sites for bikepaths. He noted that gas tax funds can be applied to the construction of bikepaths in conjunction with new road construction. Mayor Votapka said he would contact the PTA, General Development and other Groups who may assist with funding. Future Coordination Of Improvements Between Sebastian And Indian River County I__qn Regard To Transportation; Specificall~f, The Paving Of Powerline Road From Barber Street South To County Road 510; Improving All Or Portions Of Louisiana Avenue And The Southerly Extension Of Cross Street In Conjunction With The Widening Of County Road 512; Future Of Old Dixie Highway South Of County Road 512. After a brief discussion on ingress and egress to County Road 510 and explanation by Jim Davis regarding the procedures for obtaining road right of way, Mr. Davis assured the Council that the County is not *actively pursuing the paving of Lateral A (66eh Avenue Powerline Road) at this time since the daily traffic count for Schumann Drive Extension (66th Avenue) shows only 2900 vehicles which is well below capacity, capacity being 10,000 to 12,000 per day. Mr. Davis said acquisition of road right of way can be as much as fifty per cent of the total project cost. Jim Davis said, regarding Louisiana and Cross Streets, the interconnections between the twin pairs concept for CR 512 are included within the scope of the work of the CR 512 project, would be discussed in approximately two weeks, and may include these streets. He said the County would be turning to the City for input. Mr. Davis presented graphics on the CR 512 project, beginning at U.S. #1 and terminating eight hundred feet west of Roseland Road. In answer to question by Mayor Votapka, Mr. Davis said the twin pairs project would involve a traffic signal nine hundred feet north of the existing signal on U.S. #1 and another railroad crossing. Mr. Davis said, regarding Old Dixie Highway, that the County has the option to either improve Old Dixie or abandon the existing railroad crossing as a substitute for the CR 512 twin pairs additional crossing. *amended at the September 28, 1988, Regular Meeting 3 Status Report On The County Road 512 Project And Pro3ected Timetable For Improvements Mr. Davis presented a cross section of a proposed median type four lane CR 512 with a bikepath on the north side which is expandable to six lanes, storm water management to the north side, signalization of major intersections and marginal access accommodation in the commercial property to the south. Terry Pinto, County Utilities Director, said that water and sewer lines will be installed along CR 512 under this project out to Roseland Road for which sufficient right of way exists. When questioned by Mayor Votapka, Jim Davis replied that this pro3ect would cost approximately Si,000,000 per mile and that to date $1,000,000 has been generated in district three impact fees funds to begin. He went on to explain that the pro3ect may take four years since construction permits will be issued in increments of Si,000,000 each until the pro3ect is complete. Commissioner Scurlock requested that jim Davis relate the proposed impact fee increases. He said an increase from approximately $750 to $1113 for a single family residence is anticipated on September 13, 1988 for the Sebastian area. Payment For The Extension Of Roseland Road South By The Developers Of Sebastian Lakes In Lieu Of Use Of Transportation Fees. Sebastian Building Official, Bruce Cooper, reported that the developers of Sebastian Lakes have submitted plans for revisions which include the library site and which change from preliminary PUD to conceptual, which still show the extension of Roseland Road and improvement of Laconia. He said they may request credit toward impact fees for this. Commissioner Scurlock replied that impact fees are never waived as credits allowable under specific provisions. Mayor Votapka recommended discussing item N Public Service Zoning at this time. Bruce Cooper said there should be no glitches in the proposed ordinance which is set for public hearings on September 14 and 28, 1988, which if approved would allow the library in PUD zoning. Commissioner Eggert said she was hoping for a February 1989 groundbreaking for the North County Library. 4 Development Of The County Sandmining Ordinance And Relationship To Sandmining In Sebastian Along The Atlantic Coastal Ridge. Mayor Votapka questioned how much time was put into the adoption of its sandmining ordinance, changes in elevation and why the County deleted the final section regarding fill in its approved draft. Bob Keating, Indian River County Planning, said the County during its review discovered that the final decision on the depths of mining on the Atlantic Coastal Ridge was a difficUlt issue to resolve and the outcome was that for those projects that come under St. Johns River Water Management District review, the County would impose no additional requirements on them. Commissioner Scurlock explained that the deletion of the fill section of the ordinance was due to the fact that the Commission got bogged down trying to establish a process of identifying the cause of road damage on a non-discriminatory basis. Bob Keating said the County staff would be happy to work with the City in the adoption of it sandmining ordinance. Current Status And Projected Timetable Of Sanitary Sewer And Water Distribution Systems In The North County Area Terry Pinto said the design phase of the project is going along well, approximately 4920 units have signed up so far, 400 units within private franchises which the County has funds in escrow for. He said an assessment program based on impact fees which will be multiplied by those units needs to be established to pay for the construction of the system and that a letter of intent had already been received to issue the permit for the effluent disposal. Mr. Pinto went on to say that one hundred thirty easements needed to be secured for the collector system, but they had received only minimal cooperation from the railroad, particularly in the U.S. 1 area where they had hoped to use the parallel railroad easements but where unable to. He said bidding on * e~ee~n~ ~es~§~ construction could begin in early spring or possibly earlier and assessment roll hearings possibly this October. *amended at the September 28, 1988, Regular Meeting. 5 Joe Baird, County Finance Budget Officer, said the target date for the bond validation hearing was March 1989. Mr. Pinto said the County has embarked on the construction of a sludge septic treatment system which the part of the design will have to be approved by the DER and EPA as to where the sludge goes. This system will be located at the Gilford Wastewater Treatment Plant. Upon questioning by Vice Mayor Vallone, Mr. Pinto replied that the County would be looking into what legal right they have to force the hand of General Development Utilities in cooperating with the County. He said he would be looking at their Sebastian franchise in the near future. Mr. Pinto closed by saying a master plan for water had been completed and selection was done for engineering design, and he hoped that it would be design engineered by 1989. Mayor Votapka called recess at 2:35 p.m. and recalled the meeting at 2:45 p.m. Ail members present at recess were present when the meeting was reconvened. Possible Joint Cooperation__In Regard To Drainage Improvements In The City Of Sebastian Through Contacts For Service And/or Equipment. Councilman Metcalf noted the Sebastian River watershed was a sub3ect of intense activity, which north prong is currently rated fair to good but losing its class 3 status and which south prong is in poor condition and contaminated. He explained that Vero Lakes Estates set up a Municipal Service Taxing Unit and in cooperation with Jim Davis prepared a drainage study. He said Sebastian had received proposals for a drainage study. Jim Davis explained the process used by Vero Lake Estates for a drainage study. He suggested that Sebastian consider a stormwater utility or tax assessment to implement a program. He assured Sebastian Council that the County would be willing to work with them. Chairman Scurlock said he hoped the various entities in the County could coordinate their stormwater management programs. Councilman Metcalf advised all on the function of the Watershed Committee. 6 Vice Mayor Vallone requested cooperation from the County on commitments for contract services on drainage. Chairman Scurlock said the County cannot solve all problems but there are areas of cooperation that do exist. He suggested that the City Manager and County administrative staff work together to reach areas of planned cooperation on a day to day basis. Recreation - The New Indian River County Recreation Plan And How Sebastian Will Benefit If It Becomes A Participant In The Plan. Commissioner Bird had handed out a revised draft of recommendations for a county-wide recreation district dated June 12, 1988 and gave a brief history of the implementation of the County Parks and Recreation Committee beginning in 1980. He said the final outcome, of a committee of local citizens formed in 1983 to look into future recreation, was the 1985 report. He stated that the political climate is right for this plan to be looked at again. He said the proposal is to set up a governing board for the Countywide Recreation District made up of eleven members, which would recommend a formula for funding for each district. Me said with the interlocal agreement the philosophy would be that each municipality would own their own base facilities and the County would provide the staff and programs. Mayor Votapka said the Sebastian City Manager would have to look into the proposal for an interlocal agreement but would not rush into it. Jim Davis reported that the County has done quite a bit in the past five years, i.e., purchased $11,000,000 of ocean front property, done a study on user fees for appropriate recreation programs which go into effect October 1, 1988, developed aggressive capital improvement programs and is currently looking into an impact fee of approximately $300 per residential unit. Tourist Tax - Discussion On This Possible Tax And Effect It Will Have On Sebastian If It Becomes A Participant Commissioner Wheeler gave a brief history on how the two cent Tourist Tax was being implemented at this time and went on to explain uses of the tax, i.e., beach cleaning, beach maintenance, Indian River County Chamber of Commerce Tourist Development, all funds in district two toward Golden Sands Park north Wabasso Beach. He said he would research what these funds 7 could be used for within the City of Sebastian. He explained that up to June $280,000 had been collected, the two year budget period would end April 1989 and then start to run concurrently with the County budget. He noted that the Commission can by a ma3ority plus one raise the tax to three cents. Joe Baird explained how the districts were set up by zip code using mailing address for sales tax of business which is not always the physical address. Mayor Votapka again requested that the County research what funds could be expended for Sebastian and thanked the County for the $6000 for the emergency repair to the Main Street dock. Co-operation With Indian River County In Utilizing The Sebastian Clivus Multrum Restroom Facility For Use In A County Park in Exchange For A Sanitary Sewer Connection TO The North County Sewer System. Mayor Votapka said the City of Sebastian would like to eliminate the Clivus Multrum in Riverview Park in exchange for connection to the north county sewer system. Terry Pinto said the Clivus Multrum could be used on one of the islands or in some other remote area. He said the wastewater facility being designed will service Riverview Park and there are impact fees which will fund it. He said a possible solution would be for the recreation department to pay the impact fees and then take possession of the Clivus Multrum. Recommendation To The County For The Possible Acquisition Of The Kroe~el Homestead O__n South Indian River Drive For Historical Preservation Purposes. Mayor Votapka said he had attended an April 24, 1988 open house at the 3.9 acre homestead and recommended that the County look at purchase due to its historical significance. Bob Keating replied that he had an agenda item for the September 6, 1988 County Commission meeting requesting for an historic survey grant. Commissioner Bowman recommended that the County try to have the homestead designated a national monument. 8 Barber Street Sports Complex - Current Status And Proposed Plan Mayor Votapka explained that the County has appropriated $40,000 to the Sports Complex, the City has appropriated 821,000 and that the City has been working closely with the Little League, Sebastian Panthers and Exchange Club. City Manager, Robert McClary, explained he had met with Commissioner Bird, Pat Callahan and Jim Davis and agrees that the city is at a crossroads regarding recreation. He said his assessment is that whatever path is chosen be done so in cooperation with Indian River County. Mr. McClary expressed appreciation to North County Recreation for funding for the Sports Complex. He noted that it was his hope that the complex be completed in the upcoming fiscal year. Co-operation with Indian River County i__n Buildin~ Department Inspections and City Planning Vice Mayor Vallone said his concerns regarding this item had been satisfied by Chairman Scurlock's comments that the administrative staffs from the County and City meet to discuss joint cooperative efforts. Mayor Votapka thanked Vice Mayor Vallone for his idea to hold a joint meeting and all those in attendance and involved with the meeting for their participation. Former Mayor Everett Gass recommended future joint meetings involving public input. Mayor Votapka adjourned the meeting at 4:00 P.M. Adopted as amended at the September 28, 1988, Regular Meeting.
