Mayor Conyers called the workshop meeting to order at ?:00 p.m. 2. The Pledge of Allegiance was recited. 3. ROLL CALL Present: Mayor W.E. Non-Agenda Items George Metcalf - Discuss Golf Course Restaurant Bidding Procedures (No Backup) George Metcalf, 425 Pine Street, Sebastian, stated that, in his opinion, City Council should have interviewed the top three proposers. B. Agenda Items Don Grainger, 1340 Barber Street, Dan McCusker, 222 Mensh Avenue, Jim Abelson, 1623 No. U.S. 1, and Jim Hoffman, 117 Landover Drive, all of Sebastian, addressed item 90.198 "Alcoholic Beverages - Prohibited Hours of Sale" and urged the extension of Sunday hours. Mr. Grainger also requested and received the endorsement of City Council for a charity fundraiser which will include community organizations. John Kistler, 105 41st Court, Vero Beach, requested and received from the City Manager a status report on negotiations for the Golf Course restaurant lease. WORKSHOP ITEMS Alcoholic Beverages - Prohibited Hours of Sale (City Manager Recommendation dated 8/29/90, Section 2-4 City Code, Letter from City Attorney dated 8/29/90) Following a lengthy discussion, input from each Councilman and requests for further input from the Chief of Police, Indian River County and the public, the City Manager recommended that the City Attorney be authorized to draft an ordinance so that a public hearing can be held to obtain input. City Council Workshop September 5, 1990 Page Three MOTION by McCollum I move that the City Attorney be instructed to draw up an ordinance, we can have public hearings on it, but I would also like under 4-2 "Prohibited Hours of Sale" the first on Sundays between the hours of 1 a.m. on Sunday and 11 a.m. on Sunday rather than 1 p.m. on Sunday and leave language on New Year's Eve as is and let people request an extension of time. MOTION DIED FOR LACK OF A SECOND. It was decided to place this item on the October 3, 1990 agenda for further input. The City Attorney, at the request of Councilman McCollum and consensus of Council, said he would look into section 4-3 regarding nudity and bring a verbal report back to Council. He also suggested that Council may want to change language regarding "New Year's Eve" to "New Year's Day" in section 4-2. 90.199 Unit 1, Sebastian Highlands Drainage Problems (City Manager Recommendation dated 8/30/90) Mayor Conyers discussed a method of drainage presented to him by FPL and requested staff to look into it. Jerry Thomas commented that local hydrologists say this method will not work except possibly in the area of the sandridge. The City Manager suggested that information may be available from the USDA and St. John's River Water Management District. The City Manager presented a section of drainage plans for unit one on the overhead projector, explained the problems that exist in this area and requested authorization to grade swales in street right-of-way to proper elevations, install side yard reliever ditches where required and work with property owners to install side yard culvert pipes. The Director of Community Development said if side yard culvert pipes are not made mandatory, he would have to recommend a larger setback requirement. 3 City Council Workshop September 5, 1990 Page Four 90.200 The City Manager suggested that the city develop a policy on major ditches in side yards, look at expense, and bring to a workshop for discussion. He further recommended that the city not get involved in fixing driveways unless there is some justifiable reason that the city was negligent in some way. MOTION by Powell/Oberbeck I move we direct staff to prepare a more detailed report on the expense of installing side yard culverts in major drainage ditches. ROLL CALL: Mayor Conyers - aye Councilman McCollum - aye Vice Mayor Oberbeck - aye Councilman Powell - aye MOTION CARRIED 4-0. Mayor Conyers called recess at 8:15 and reconvened the meeting at 8:29 p.m. All Council members present at roll call were present. Palm Lake - Review Final Plat and Phasing (Staff Recommendation dated 8/23/90, Memo from P & Z dated 8/16/90j Memo from TRC dated 7/18/90, Application, Letter from Fischer dated 6/21/90, Letter from Witherby dated 7/12/90, Plat Under Separate Cover) George Metcalf, 425 Pine Street, Sebastian, objected to this item, however, it was noted by the Director of Community Development that Mr. Metcalf was referring tO Vickers Grove and not the subject property. The Director of Community Development explained the request for final plat approval and noted that all Technical Review Committee requirements will be met prior to approval. He said the applicant will be requesting the waiver of the street light requirement which has the approval of the City Engineer and Chief of Police and a waiver of the bond since all requirements will be completed by the time of final plat approval. The City Attorney said final plat revision recommendations he had made had been met with the exception of receipt of a copy of the homeowner association document which will be furnished to him; City Council Workshop September 5, 1990 Page Five 90.201 90.202 said light posts can be made a condition of the final plat and noted a glitch in section 20A-16.4 (c)(4) which requires the final plat to be prepared by a registered engineer instead of a registered surveyor as has been done in the past in the city. MOTION by McCollum/Powell I move we direct the City Attorney to draft a resolution to approve Phase I of Palm Lake subdivision. VOICE VOTE on the motion carried 4-0. Recycling - Report on Solid Waste (City Manager Recommendation dated 8/30/90, Memo from DCD 8/30/90) The Director of Community Development reiterated his report previously distributed to Council on what steps the city has taken and what still needs to be accomplished regarding solid waste disposal. Mayor Conyers suggested that Council invite Sam Harris, Harris Sanitation, to address them on the matter. There were no objections. Alfred Vilardi, 445 Georgia Boulevard, Sebastian, addressed Council on the matter. Report on Buildin~ Activity t~o Justify Part-Time Building Inspector (Staff Recommendation dated 8/29/90, Monthly Reports 9/89 - 8/90, Bar Graph) MOTION by Oberbeck/McCollum I move we approve staff to fill the part-time temporary position Building Inspector. ROLL CALL: Councilman McCollum - aye Vice Mayor Oberbeck - aye Councilman Powell - aye Mayor Conyers - aye MOTION CARRIED 4-0. City Council Workshop September 5, 1990 Page Six 90.203 F. Proposed Language for Fence Ordinance (Staff Recommendation dated 8/29/90, Memo from DCD dated 8/29/90) The Director of Community Development gave a presentation on the overhead pro3ector exhibiting the difference between the current and proposed fence ordinances. Discussion took place on whether a four foot height front yard fence allowance would be preferable to three feet. MOTION by Powell/Oberbeck I move we direct the City Attorney to go ahead and make the ordinance for the front yard fencing and get with Bruce on the four foot. ROLL CALL: Vice Mayor Oberbeck - aye Councilman Powell - aye Mayor Conyers - aye Councilman MCCollum - aye MOTION CARRIED 4-0. 8. MAYOR'S MATTERS Mayor Conyers stated he had received photos showing continued algae problems in Collier Creek subsequent to spraying and requested staff to check into it; endorsed community efforts for a Sebastian Pelican Days' fundraiser; and said new Council members should be given ground rules in the future prior to union negotiations. 9. COUNCIL MATTERS A. Vice Mayor Oberbeck Vice Mayor Oberbeck requested and received progress reports on 1) Solin's involvement in the Comprehensive Land Use Plan, 2) the convenience store security act ordinance, 3) the Little League lease, 4) proposed administrative costs for lot mowing, and 5) the City Manager's priority list. Councilman McCollum Councilman McCollum said he may attend the National League of Cities' conference in Washington, D.C. at his own expense. C. Councilman Powell None. D. Councilman Rondeau Absent. 10. CITY ATTORNEY MATTERS 11. The City Attorney reported on a burglary at Valkaria Airport. Stottler Stagg Z General Release (City Manager Recommendation dated 8/28/90, Letter from Cit~ Attorney dated 8/27/90, Letter from City Attorney dated 7/9/90, Page 7 Contract, Stottler Stagg Invoice dated 5/24/90) The City Attorney said direction is needed to draft a resolution to authorize the Mayor and City Clerk to sign the general release and to remit $2,000 to Stottler Stagg in accordance with the city's contract with them. MOTION by Oberbeck/Powell I move we authorize the City Attorney to prepare the documents and have them done. ROLL CALL: Councilman Powell - aye Mayor Conyers - aye Councilman McCollum - aye Vice Mayor Oberbeck - aye MOTION CARRIED 4-0. CITY MANAGER MATTERS The City Manager stated his intent to reduce the authorized yearly $12,000 airport funds transfer to general fund previously approved to offset personnel costs in regard to the standstill agreement and to evaluate it on a month to month basis. Council concurred. City Council Workshop September 5, 1990 Page Eight 12. The City Manager said certain items in regard to Barber Street Sports Complex will be rebid, therefore, all bills will not be paid by the end of the fiscal year and apprised Council of Indian River County's cooperation relative to their matching funds being carried over into their 91 FY budget.
