Mayor Firtion opened the public hearing at 7:05 p.m. and the City Attorney read Resolution No. R-94-44 in full. The City Attorney advised city Council on procedures to follow. The City Manager publicly stated the (go to tape). The City Manager stated that the rollback rate was computed at 6.9678 mills and the proposed levy is 6.9 mills. Keith Miller, 961 Riviera Avenue, Sebastian, suggested people get involved in county budget adoption relative to landfill fees. The city Clerk reiterated that the motion is to tentatively adopt the millage resolution. The City Attorney read Resolution No. R-94-45 in full, and Mayor Firtion opened the public hearing at 7:13 p.m. Ed Gilcher, 661 Wimbrow Drive, Sebastian, reported on successful acquisition of radio equipment from the current fiscal year budget; and said he was in favor of hiring two new Police patrol personnel. The City Manager said if City Council desired, subsequent to the 93/94 audit report, it could be determined whether there are sufficient funds for two new personnel without amending this proposed budget. Special City Council Meeting September 7, 1994 Page Four 94.221 5. Mayor Firtion closed the public hearing at 7:20 p.m. City Council discussion ensued. The city Manager noted that there is one new officer in this proposed budget. A consensus was reached to concur with the City Manager's recommendation relative to additional police personnel. MOTION by Corum/Freeland I move the tentative approval of Resolution No. R-94-45 and to set the public hearing and adoption for 9/21/94. WORKSHOP ITEMS Planning and Zoning Recommendation Re: Amending Comprehensive Land Use Plan - Non-Conforming Mobile Homes (Director o__f Community Development Transmittal dated 8/31/94, P & Z Memo dated 7/26/94, CLUP Policy, Torpy Letter dated 6/28/94, LDC Section 20A-9.7) The City Attorney advised that in his opinion this item is a quasi-judicial matter, therefore it be sent back to staff for it to come back in that form with proper notices. City Council concurred. Planning and Zoning Recommendation Re: Amending General Marine Commercial Zoning District - Building Heights (Director o__f Community Development Transmittal dated 8/31/94, P & Z Memo dated 8/18/94, LDC Section 20A-3.12.E.3.) The Director of'Community Development reiterated the recommendation of Planning and Zoning to amend GMC zoning relative to building height on the west side of Indian River Drive to 35 feet. City Council discussion followed relative to the possibility of changing the zoning designation for the subject parcel. City Council Workshop September 7, 1994 Page Three MOTION by Oberbeck/Damp I would move to approve the City Attorney draft an ordinance to amend Section 20A-3.12.E.3. pertaining to the maximum building height for GMC zoning district in the Land Development Code. ROLL CALL: Mrs. Corum - aye Mrs. Damp - aye Mr. Freeland - aye Mr. Oberbeck - aye Mayor Firtion - aye MOTION CARRIED 5-0 94.122 Planning and Zoning Recommendation Re: Tree Ordinance (Director of Community Development Transmittal dated 9/1/94, P & Z Memo dated 8/24/94) Earl Shroyer, 416 Columbus Street, Sebastian; Wally Kramer, Micco; and Wayne Tozzolo, 858 Kirk Avenue, Sebastian, addressed City Council. The Director of Community Development reiterated recommended language amendments as submitted and expressed concern for language relative to the criteria for removal of trees. A lengthy City Council discussion followed. TAPE I - SIDE II (8:15 p.m.) The discussion continued relative to including specific reasons for removal of trees beyond the five foot footprint, a suggestion to conduct a survey of tree nurseries to ascertain costs based on caliber and height, concern for property owner rights, addition of pines to the prohibited trees list, suggestion to place the matter on a ballot, the City Attorney's concerns relative to delegating to staff the discretion to determine the validity of reasons for removal of trees, and whether there were any other differences between this proposed language and that which is currently in the Code. 3 City Council Workshop September 7, 1994 Page Four 94.224 It was the consensus of the majority of City Council to direct staff to revise the current ordinance to require seven trees with a minimum 1-1/2 inch caliper, and retention of the credit system, and to have them conduct a survey of tree costs based on caliper and height, and continue with the homeowner information packet. Mayor Firtion called recess at 8:47 p.m. and reconvened the meeting at 8:53 p.m. Ail members were present. Vice-Mayor Carolyn Corum Vice Mayor Corum inquired about demolition of the restrooms at Easy Street Park; reported that the Land Acquisition Committee will not recommend acquisition of single family lots in Sebastian for scrub habitat, and suggested the City Manager be directed to draft a letter to the County, to which the Director of Community Development responded that a letter was faxed today; reported that a portion of the Fey property will be included in the Habitat Conservation Plan; discussed crumbling road shoulders and suggested feathering on corners.
