GASS, (HOSPITALIZED) THE CITY CLERK READ A LETTER OF REQUEST FROM THE AMARA SHRINE TEMPLE REQUESTING PERMISSION FROM THE CITY COUNCIL TO DISTRIBUTE A TABLOID IN PUBLIC AREAS DURING THE WEEK OF OCTOBER 18 THROUGH OCTOBER 26, 1982, AT WHICH TIME DONATIONS WILL BE RECEIVED. THIS TABLOID WILL CONTAIN ARTICLES PERTAINING TO THE HISTORY AND ACCOMPLISHMENTS OF THE CRIPPLE CHILDRENS HOSPITAL AND BURN INSTITUTES. THE CITY CLERK READ A LETTER FROM THE AMARA SHRINE TEMPLE, REQUESTING THAT THE CITY PROCLAIM OCTOBER 18-31, 1982, AS NATIONAL SHRiNERS HOSPITAL WEEK. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN SCHUM, THAT WE GO AHEAD AND ALLOW AMARA SHRINERS TEMPLE TO GO AHEAD AND DISTRIBUTE THEIR LITERATURE THROUGHOUT THE COMMUNITY. MOTION CARRIED. THIS INCLUDES THE ENTIRE FIRST FLOOR AND EVERYTHING TO FACILITATE EXTENDING THE ELECTRICAL SUPPLY TO THE SECOND FLOOR IN THE FUTURE. HEATING AND AIR CONDITIONING SYSTEMS, THIS IS ANTICIPATED TO BE LOW. $26,000.00 $49,000.00 EARL MASTELLER, CITY ENGINEER, STATED THAT HE HAS ADDED 20% TO THIS TOTAL COST TO COVER ANY INCIDENTIALS NOT INCLUDED AND RECOMMENDED THAT A TOTAL COST FIGURE OF $60,000.00 BE USED. MR. JOHN VAN ANTWERP, AIRPORT MANAGER, REPORTED THAT THERE HAS BEEN DISCUSSION REGARDING THE POSSIBILITY OF LEASING PROPERTY AT THE AIRPORT FOR A PRE-FABRICATED HOME BUILDING OPERATION AND ALSO SOME EARLY NEGOTIATING FOR A REFINISHING OPERATION. MAYOR FLOOD STATED THT TWO APPLICATIONS HAD BEEN RECEIVED FROM PERSONS INTERESTED IN SERVING ON THE AIRPORT COMMITTEE. MOTION CARRIED. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN VOTAPKA, TO BRING TO THE FLOOR A DISCUSSION RE- GARDING THE VACANCIES ON THE AIRPORT COMMITTEE. MOTION CARRIED. AFTER A BRIEF DISCUSSION REGARDING THE FOUR VACANCIES ON THE SEBASTIAN AIRPORT COMMITTEE AND A BRIEF RE- VIEW OF THE TWO APPLICATIONS RECEIVED, ATTORNEY KILBRiDE.STATED THAT EACH MEMBER WOULD HAVE TO BE APPOINT- ED TO A PARTICULAR TERM. MAYOR FLOOD EXPLAINED THAT SINCE THESE OPENINGS HAVE BEEN AVAILABLE FOR ALMOST A YEAR THAT HE WOULD HAVE TO CHECK FURTHER ON THE THE EXPIRING TERMS. MOTION CARRIED. MOTION AMENDED BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN SCHUM, THAT JOSEPH BARBOLINE AND RENE VAN DE VOORDE BE APPOINTED TO THE LONGEST REMAINING TERM THAT IS VACATED AT THIS TIME. COUNCILMAN VOTAPKA, SUGGESTED THAT THE AIRPORT COMMITTEE VACANCIES BE ADVERTISED IN THE LOCAL NEWSPAPER AND ALSO MENTION THAT THE AIRPORT COMMITTEE WILL BE HOLDING REGULARLY SCHEDULED MEETINGS ON THE LAST TUESDAY OF EACH MONTH, AT 4:00 P.M. HE_BRIEFLY EXPLAINED THAT THE CITY PASSED A RESOLUTION STIPULATING THAT HYATT, WOULD REIMBURSE THE CITY. A~TER~-HE_KING INTO T~]~S/RESOLUTION, THE DEPARTMENT OF TRANSPORTATION HAS REQUESTED A LETTER FROM THE INDIAN RIVER ~OU5TY SCH~O~BOARD, STATING HOW THEY WILL BENEFIT FROM THIS RAILROAD CROSSING. HE ALSO MENTIONED T~ PHE C~TY COUN~L NEEDED TO AUTHORIZE ANOTHER RESOLUTION STATING THAT THE CITY WOULD BE RESPONSIBLE ~ B~UTLD~N__C~ AND ~INTENANOE OF THE RAIL ROAD CROSSING. COUNCILMAN VOTAPKA REMARKED THAT HE HAS DISCUSSED WITH THE COUNTY THE POSSIBILITY OF SHIFTING THE CROSSING TO THE SOUTH TO PROVIDE A BETTER ALIGNMENT~T~ AVENUE. MAYOR FLOOD AGREED WITH THE ALIGNMENT OF THE CORSSING, BUT FELT WE SHOULD STILL PROCEE~_H THErR~QUEST FOR A PERMIT FROM THE DEPARTMENT OF TRANSPORT- ATION SO A PUBLIC HEARING COULD BE SET.MR. SINCE, THE IMPLEMENTATION OF THE COMMERCIAL OFFICE RES- IDENTIAL ZONING WAS RATHER NEW AT THE TIME OF APPROVAL, THE PLANNING!'.RND ZONING COMMISSION OVERLOOKED IT AND GAVE APPROVAL FOR A COMMERCIAL RETAIL SITE PLAN. REGULAR COUNCIL MEETING - SEPTEMBER 8, 1982 AFTER SOME FURTHER DISCUSSION, MAYOR FLOOD REPORTED THAT THE LAND OWNERS WANT TO OPEN A TAKE OUT ICE CREA~ STORE THAT WILL OCCUPY ONE STORE SPACE IN THIS COMPLEX AND HAVE REQUESTED AN OCCUPATIONAL LICENSE. ATTORNEY KILBRIDE STATED THAT SINCE THE LAND OWNER HAS RELIED ON THE DECISION OF THE PLANNING AND ZONING COMMISSION TO ALLOW THE USE OF THAT PROPERTY AS COMMERCIAL RETAIL, PULLED A PERMIT, BUILT THE BUILDING, PROCEEDED IN GOOD FAITH AND BUILT THE BUILDING FOR RETAIL PURPOSES, THAT IT WOULD BE APPROPRIATE FOR THE CITY TO ALLOW AN OCCUPATIONAL LICENSE FOR THAT PART OF THE BUILDING. HE ALSO STATED THAT ONCE THIS OCCUPATIONAL LICENSE IS ISSUED, THAT THE CITY WILL NOT HAVE AN OBLIGATION EOREVER. IF THE USE OF THIS BUILDING CHANGES, IT CAN BE DENIED AND THE CITY WILL NOT HAVE ANY OBLIGATION TO ANY ABUTTING PROPERTY OWNERS AS FAR AS ANY FUTURE SITE PLAN APPROVAL OR PERMITS TO BUILD COMMERCIAL RETAIL IN THIS COMMERCIAL OFFICE RESIDENTIAL ZONING SITE. ED PALUCH, CHAIRMAN, AIRPORT COMMITTEE, REPORTED THAT AT THE AIRPORT COMMITTEE MEETING HELD ON SEPTEMBER 8, 1982, IT WAS RECOMMENDED THAT THE AIRPORT MANAGER BE COMPENSATED A MONTHLY FEE OF $200.00. AFTER A BRIEF DISCUSSION, MR. JOHN DREW, CITY RESIDENT, FIXED BASED OPERATOR AT THE SEBASTIAN MUNICIPAL AIRPORT, REQUESTED THAT MR. VAN ANTWERP NOT BE COMPENSATED A $200.00 MONTHLY FEE AND THAT HE BE REMOVED AS AIRPORT MANAGER, SINCE HE FELT THERE WAS A CONFLICT OF INTEREST. MAYOR FLOOD STATED THAT IF MR. DREW, ~IAD ANY~COMPLAINTS THAT HE PUT THEM IN WRITING AND SUBMIT THEM TO THE AIRPORT COMMITTEE FOR REVIEW. THERE BEING NO MOTION MADE, THE COMPENSATION OF $200.00 PER MONTH FOR THE AIRPORT MANAGER WAS REJECTED. MAYOR FLOOD SUGGESTED THAT THE CITY CONTINUE WITH THE RENOVATION PLANS FOR.
