Spedial meeting of the CitY ~ouncil called by Mayor Middleton to take care
of several items of business.
'i'hose present were ~¥~yor ~lddleton,Prosident Anderson and Councilmen Sembler,
Le~chworth,Elllngsen and Park. All members present.
It was moved by Councilman Sembler and seconded by Oouncilman Ellingsen ~hatvboth
'.'elephone and Electric Light bills be paid by the ~lerk securing the signature of one
of the finance committee and must be approved by the ~lty Council at the next meeting.carried
Sills presented for payment were for John Stillman 21.60

Said bills approved by the finance committee were ordered paid on motion by councilman
Sembler and seconded by Councilman ~lllngsen.Said bills were for labor on shuffle board

On motion by Councilman Park and seconded by oouncilman ~llingsen,Stanley Loncon
who had applied for position as ~ity ~olice Officer,was interviewed and hired on trial for
~hirty days at salary of $175.00 per. month. Carried.

Meeting was called to order by President Anderson.
SemblerThose answering roll call were ~a$or Middleton,President Anderson and Counvilmen
Sembler,Letchworth,Ellingsen and Park. Mr Vocelle City Attorney also present.
Councilman Sembler introduced an 0Edinance entitled, ;'An Ordinance Providing a
manner and method for the casting of votes by any qualified elector of the City of Sebastiaz
Florida at any election or primary election therein who may be absent from said City on the
day of such election or primary election,or who,on account of physical disability,is
unable,W~thout anothers assistance,to attend the polls, and providing penalties for any
violation thereof.
Upon motion made by Councilman Sembler and seconded ~y Councilman Ellingsen,and
Unanimously carried,said Ordinance was read the firet time in full.
Upon motion ~de by Councilman Sembler and seconded by CounciLman Ellingsen and
Unanimously carried,said-Ordinance was read the second time by title only; there being
no amendments offered upon motion made by Councilman Sembler and seconded b~y Councilman
Ellingsen said Ordinance w~as read the t. hird time by title only and placed upon its fina~
passage. The roll being called upon the final passage of said Ordinance,the result was
as follows.
Ayes: Councilmen An~dorson,Sembler,Letchworth,Ellingesn and Park.
Nays: None.
Thereupon said Ordinance having received an affirmative vote of three fifths of all
members of the Council was declared duly adopted and upon being presented to the Mayor
and having received his approval was numbered as Chapter 1~5 of the Ordinances of said
City and thereupon duly posted at the door of the City Hall of the City of Sebastian in
accordance with the provisions of Section 85 of Chapter 1~8 of the laws of Florida,being
the Charter of said City.
It was moved by Councilman Sembler and seconded by Councilman Park to accept reso-
lution on the sale of CiSy Property,said resolution reads,
Whereas: Mr Lyle Ferguson has offered to purchase of and from the City of Sebastian
Florida,at a consideration of $430.00 paying $50.00 dowla and the balance in thirty days,
the following described property,to wit;
Lots S and 4 ~lock 4,School Park Subdivision,according to replat of said
subdivision recorded in Plat ~ook E at page~ Public records in the office of the Clerk
of Indian River County, Florida.
Whereas,said property is not held by the City for any ~ublic or Municipal purpose an
property which has been acquired by said City for non-payment of its tax liens theron an.
is held for sale; and said consideration offered to ~e paid for said property being nos
less than the fair value thereof;and it being to the best intrest of .this Oity so to do;
Therefore, ~esolved that the City of Sebastian sell to the pUrchaser aforsaid the property
described and at the consideration hereinbefore stated,and that the Mayor and ~X~ wA~r~
of said City are authorized to execute,acknowledge and seal with the City Seal deed of
conveyance of said property to said pUrchaSer upom receipt by the City .of the full
~Sideration to be paid therefor as above stated,
Mr Ferguson at this time presented the City Council with request for building permit
together with drawing of home to be built on said property.
Permit was awarded to Mr Ferguson on Motion by Councilman Sembler and seconded bp
~ounc ilman Elllngsen.Carrled.
Mr Nash applied permission to do light repair work at his garage at his residence
on North Central Ave.The Clerk was instructed to issue license to cover same ~n the
new occupational licenses go into effect on October 1,1950,said license will be issued
with the foX,wing restrictions, Mr Nash is not to handle gas and oil retail or wholesale
except what is needed in conjunction with his repair of Automobiles,air cooled motors and
lawn mowers and will be allowed to have no more than three cars undre repair a~ any one
time and will be able to operate as long as there are no complaints from his neighbors.
Said permission was granted by motion by councilman Sembler and seconded by Councilman
Elllngsen.Carried.
Bills approved by ~he finance committee were ordered paid on motion by Councilman
Sembler and seconded by Councilman Letchworth. Carr&~d.
Mayor Middleton recomanded Officer Hughes be made Chief of Police of the 01ty and
salary raised to $22~.00 per month to start after 30 days of service.
Councilma~'moved recomendation be accepted and that .Mr Hughes receive 'his raise in salary
on nex~ check,same was seconded by Councilman Park and Carried.
Councilman Sembler also moved that Officer Loncon'$.salAry~be-'raised to $200.00 per
month after 30 days of service and to receive check for same first pay after 30 days
have passed,said motion seconded by Councilman Park and Carried.
Councilman Ellingsen introduced"an Ordinance defining CommUnism, Expressing A Clear
And Present Danger Therefrom And Fixing Penalties ~'or The Advancement Thereof.
Upon motion made bp Councilman Ellingsen and seconded by Councilman Sembler and
unanimously carried,said O~dinance was read the first time in full.
Upon motion by Councilman Ellingsen and seconded by Councilman Sembler and unanimously
carried,said Ordinance was read the second time by title only; there being no amendmants
offered upon motion made by Councilman Eliingsen and seconded by Councilman Sembler s~id
Ordinance was read the third by title only and placed upon its final passage of said
0~dlnance the result was as follows:
Ayes: Councilmen Anderson,Sembler,Letchworth,Ellingsen and Park.
Na,vs: None.
Thereupon said 0~dlnance having received qn affirmative vote of three-fifths of qll
members of the Council was dec;ared duly adopted and upon being presented to the Mayor
and having received his approval was numbered 126 of the Ordinances of the City and was
thereupon duly posted at the door of the City Hall of the City of Sebastian in accordance
with the provisions of section 8§ of Chapter 16683 of the laws of Florida,being the
Oharter of said City.
It was moved by Councilman Letchworth and seconded by Councilman Sembler that the
Clerk keep $ 350.00 in cash on hand. Carried.
Dniforms and equipment approved by the Police Committee and presented to the Council
for their approval was passed on Motion by Councilman Sembler and seconded by Councilman
Letchworth.The equipment being, Chief Hughes
