(CONTINUATION OF THE PUBLIC HEARING HELD IN CITY HALL ON 9/5/7~)
~HE HEARING WAS CALLED TO ORDER BY MAYOR PAT FLOOD, JR., TO DISCUSS THE PROPOSED AMENDED ORDINANCE SETTING
AN ANNUAL SALARY FOR THE OFFICE OF MAYOR AND SETTING AN EFFECTIVE DATE.
BEFORE THE AUDIENCE WAS GIVEN PERMISSION TO CITE THEIR VIEWS AND OPINIONS, MAYOR FLOOD OUTLINED GROUND RULES
FOR THE MEETING. POLICE OFFICERS WILL BE LOCATED ON EACH SIDE OF THE ROOM TO INSURE THAT EVERYONE WILL BE
GIVEN AN OPPORTUNITY TO SPEAK WITHOUT INTERRUPTION. THOSE WHO VIOLATE THIS WILL BE ESCORTED OUT OF THE
BUILDING.
MR. SZELUGA COMMENTED IF THIS NEW ORDINANCE SETTING AN ANNUAL SALARY FOR OFFICE OF THE MAYOR AND SETTING
AN EFFECTIVE DATE IS THE ONE THAT IS TO BE PRESENTED TONIGHT, HE HAD NO FURTHER QUESTIONS AT THIS TIME DUE
TO THE FACT THE PREVIOUS ORDINANCE CALLED FOR ESTABLISHING A POSITION AS A FULL-TIME MAYOR. IT IS UP TO THE
AUDIENCE TO CONVINCE THE MEMBERS OF THE COUNCIL TO VOTF JUSTIFIABLY AND CORRECTLY.
THE CITY CLERK WAS REQUESTED TO READ THE FIRST ORDIN~WHICH HAD BEEN READ AT THE COUNCIL MEETING ON
AUGUST 13, 1979, AND THE PROPOSED AMENDED ORDINANCE WHICH IS BEING PRESENTED TONIGHT.
THE CITY CLERK READ IN ITS ENTIRETY THE FIRST ORDINANCE AS READ ON AUGUST 13, 1979 ENTITLED, "AN ORDINANCE
DECLARING THE OFFICE OF MAYOR A FULL TIME POSITION, SETTING AN ANNUAL SALARY FOR THE OFFICE OF MAYOR, AND
SETTING AN EFFECTIVE DATE."
THE CITY CLERK READ iN ITS ENTIRETY THE PROPOSED AMENDED ORDINANCE ENTITLED, "AN ORDINANCE SETTING AN ANNUAL
SALARY FOR THE OFFICE OF MAYOR AND SETTING AN EFFECTIVE DATE."
MAYOR FLOOD EXPLAINED THE REASON FOR AMENDING THE ORDINANCE. THE COUNCIL CANNOT CREATE A NEW OFFICE BUT
CAN AND DOES CONTROL THE SALARIES OF THE COUNCIL.
A FULL TIME MAYOR WHO, IN ESSENCE, IS THE CITY MANAGER BECAUSE/HE DOES MANAGE THE CITY. HE DID NOT LIKE TO
SEE THE MAYOR SIT ON THE COUNCIL AND BE A~L~_~O VOTE. HE FE~ A CITY MANAGER, WHOSE OCCUPATION IS TO MANAGE
THE CITY, SHOULD NOT BE A MAYOR AND THAT F~EJ SHO~3LD Sir ON THE ~OUNCIL BUT NOT HAVE A VOTE. HE SUGGESTED
AS THE ELECTION TIME APPROACHED, THE CIT~CQ_~LD C~ UP A~EFERENDUM TO GO TO A CITY MANAGEMENT CHARTER
AND AT THAT TIME CHANGES MIGHT BE MADE. HE HAD NO ARGUMENT AGAINST THE ORDINANCE READ TONIGHT, BUT THAT HIS
PROPOSAL OF A REFERENDUM MIGHT BE CONSIDERED FOR FUTURE USE.
COMMANDER F. W. CAMPBELL CLARENDON QUESTIONED tHE HOU ENT BY THE MAYOR IN ACCOMPLISHING CITY BUSINESS
AND SUGGESTED PERHAPS THE COUNCIL WAS NOT DOIN3 ITS JOB-~R THAT THE MAYOR WAS NOT DELEGATING RESPONSIBILITY
CORRECTLY.
MRS. MARY PISANO, A NEWCOMER TO THE AREA FROM A RDALE, COMMENTED THAT DURING THE SHORT PERIOD SHE
HAS BEEN HERE SHE HAS SEEN THE CITY GROW VERY RAPIDLY IT IS SPROUTING AND IT CANNOT SPROUT WITHOUT PROPER
MANAGEMENT. SHE WHOL~O~U~~OD ~ULL~
THE CITY EMPLOYEES WERE OVERPAID.

MRS. JANIE BLOUIN PRAISED MAYOR FLOOD FOR THE JOB HE HAS DONE. SHE FELT HE HAS DONE A TREMENDOUS JOB AND
DESERVES TO BE PAID FOR THE HOURS HE SPENDS ACCOMPLISHING CITY BUSINESS. SHE DISAGREED WITH TSE SUGGESTION
OF A CITY MANAGER.
~. LOUIS PRIORI STATED HE HAS LIVED iN SEBASTIAN FOR THREE YEARS. HE EXPRESSED NO OBJECTION TO THE MAYOR'S
BUT FELT THAT BECAUSE OF THE CITY'S GROWTH, A QUALIFIED MANAGEMENT ORIENTED INDIVIDUAL WOULD BE
PREFERRED OVER A FULL-TIME MAYOR.
MRS. SUE STOKES FELT THE PASSAGE OF SUCH AN ORDNANCE WOULD PRECLUDE THE WORKING CLASS FROM RUNNING FOR
OFFICE OF MAYOR AND IN ADDITION, FELT THE SALARY OF $15,500. WAS TOO HIGH.
AS THERE WERE NO FURTHER COM~4, ENTS FROM THE AUDIENCE, MAYOR FLOOD PRESENTED THE MATTER TO THE COUNCIL FOR VOTE.
THE CITY CLERK READ THE AMENDED ORDINANCE FOR THE SECOND TIME IN ITS ENTIRETY, "AN ORDINANCE SETTING AN ANNUAL
SALARY FOR THE OFFICE OF MAYOR AND SETTING AN EFFECTIVE DATE." ~ ~-.~..i~

MAYOR FLOOD STATED THE CITY ATTORNEY HAD ADVISED HIM TO DISQUALIFY HIMSELF FROM VOTING, ALTHOUGH THE HEAD
OF THE COUNCIL OF THE LEAGUE OF CITIES DISAGREED. MAYOR FLOOD WILL SIGN A CONFLICT OF INTEREST FORM.

',. CRAGG QUESTIONED THAT INASMUCH AS THIS IS A DIFFERENT'~' ORDINANCE, IF IT DIDN'T NEED THREE VOTES.
~R. VOCELLE, CITY ATTORNEY, EXPLAINED AN ORDINANCE WAS PUBLICIZED AT A PUBLIC HEARING. AS HE UNDERSTOOD
IT, THIS IS THAT ORDINANCE AMENDED. IT IS NOT A NEW ORDINANCE, IT IS AN AMENDMENT.
MOTION BY COUNCILWOMAN MC KINLEY, SECONDED BY COUNCILMAN JOACHIM, TO ACCEPT THE THIRD READING OF THE ORDIN-
ANCE AS AMENDED.

MAYOR FLOOD EXCUSED HIMSELF FROM VOTING AND DECLARED THE ORDINANCE PASSED.
MAYOR FLOOD ASKED TO READ A STATEMENT INCLUDED IN MR. GASS'S REMARKS CONCERNING THE ORDINANCE ESTABLISHING
A SALARY POSITION FOR THE MAYOR WHICH HE, COUNCILMAN GASS, HAD READ AT THE PUBLIC HEARING ON SEPTEMBER 5.
***"IF THE COUNCIL IS DETERMINED TO APPROVE THIS ORDINANCE, WHY SHOULD I DEVOTE MY TIME AND MY EFFORTS TO
OBTAIN GOVERNMENT FUNDS?" HE'FURTHER SAID HE COULD NOT GET HUD FUNDS IF THE CITY HAD A PAID MAYOR - OR THAT
WAS A GOOD POSSIBILITY. MAYOR FLOOD SAID HE HAD CHECKED THIS REFERENCE AND WAS TOLD IT WOULD IN NO WAY
INTERFERE WITH THE CITY PROCURING SUCH FUNDS.
IN FEBRUARY 1979, MAYOR FLOOD SAID A RESOLUTION HAD BEEN PASSED AND ADOPTED BY THE CITY COUNCIL WHICH
STATED IN PART THAT "THE CiTY OF SEBASTIAN APPLY FOR A COMMUNITY DEVELOPMENT GRANT AND THAT EVERETT GASS,
CITY COUNCILMAN OF THE CITY OF SEBASTIAN, BE AUTHORIZED TO EXECUTE ON BEHALF OF THE CITY ANY AND ALL APPLi-
FORMS AND ANY OTHER PRELIMINARY DOCUMENTS NECESSARY TO OBTAIN SAID GRANT."
AFTER SOME DISCUSSION, VICE MAYOR GRAY SUGGESTED THIS REOUEST BE HELD IN ABEYANCE UNTIL THE COUNCIL HAS HAD
AN OPPORTUNITY TO REVIEW IT AND TO BRING IT U~'A~A~N ~T~E NEXT WORKSHOP MEETING. MAYOR FLOOD CONCURRED.
MAYOR FLOOD ASKED PERMISSION OF THE COUNCIL TO PASS AN~ERGENCY ORDINANCE ON "ENERGY CODE".
MOTION BY VICE MAYOR GRAY, SECONDED BY COUNCI~W09{A~M2~INLEY, TO APPROVE THE EMERGENCY ORDINANCE ADOPTING
THE CITY OF SEBASTIAN "ENERGY CODE" STATING ALT~i~ATE~OVISIONS TO BE ADOPTED: AND PROVIDING AN EFFECTIVE
