MEETING WAS CALLED TO ORDER BY MAYOR PAT FLOOD, JR., AT 7:00 P.M.
PRESENT: COUNCILMEN EVERETT T. GASS, J. RANDY JOACHIM, CITY ATTORNEY L. B. VOCELLE AND MAYOR
PAT FLOOD, JR.
ABSENT: COUNCILMAN CLIFFORD HOOSE, VICE MAYOR LEWIS GRAY.
PUBLIC HEARING WAS CALLED RE CHANGE OF ZONING FROM C-2 TO R-2, LOTS 10 AND 11, BLOCK 2, EDGEWATER
PARK SUBDIVISION. SINCE THE PREVIOUS HEARING HELD ON THIS MATTER WAS NOT PROPERLY ADVERTISED
ACCORDING TO THE LAW, IT WAS NECESSARY TO RE-ADVERTISE AND CALL ANOTHER PUBLIC HEARING.
THIS PROPERTY (OWNED BY ELSIE HEEN NORTHRUP) IS ADJACENT TO THE POST OFFICE AND THE ZONING AND
PLANNING COMMISSION HAS RECOMMENDED THAT THE REZONING BE PERMITTED.
THE CITY CLERK READ BY TITLE ONLY AN ORDINANCE AMENDING ORDINANCE NO. 202, AS AMENDED, THE
ZONING ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA.
MAYOR FLOOD REQUESTED THAT MEMBERS OF THE PUBLIC SHOULD NOW VOICE THEIR OPINIONS RE THIS ZONING
CHANGE. SINCE THERE WAS NO OPPOSITION FROM THE PUBLIC, MAYOR FLOOD ENTERTAINED A MOTION TO
ACCEPT THE RECOMMENDATION OF THE ZONING BOARD.
MOTION BY COUNCILMAN GASS, SECONDED BY COUNCILMAN JOACHIM, TO'ACCEPT THE MOTION OF THE ZONING
AND PLANNING COMMISSION TO REZONE FROM C-2 COMMERCIAL TO R-2 MULTIPLE DWELLINGS, LOTS 10 AND 11,

THE MINUTES OF THE REGULAR COUNCIL MEETING, JULY 10, SPECIAL MEETING, JULY 31, AND SPECIAL HEARING
AUGUST 9, 1978, WERE APPROVED.
MOTION BY COUNCILMAN JOACHIM, SECONDED BY COUNCILMAN HOOSE, TO PAY JULY BILLS IN THE AMOUNT OF
$16,963.71. CARRIED.
MR. CRAGG BROUGHT TO THE ATTENTION OF THE COUNCIL THE FACT THAT THE CEMETERY IS ONLY ABOUT HALF
LAID OUT. IN THE FUTURE, WHEN THE REST OF IT IS LAID OUT, IT WILL MEAN THERE WILL HAVE TO BE
AUXILIARY ROADS. HE THOUGHT THE CEMETERY OUGHT TO BE LAID OUT FIRST BEFORE ANY NEW ROAD IS PUT IN,
AS IS NOW PROPOSED.
MR. DONALD SWARTZWELDER, 301 COLUMBUS AVENUE, STATED THAT HE HAD MADE TWO REQUESTS FOR A STREET
LIGHT AND BEEN TURNED DOWN. COUNCILMAN HOOSE EXPLAINED THAT WE CANNOT HONOR ALL SUCH REQUESTS,
BUT EACH IS JUDGED ON ITS OWN MERITS. WHEN IT WAS LEARNED THAT THERE WAS A STREET LIGHT IN
EXISTENCE ON A CORNER NEAR MR. SWARTZWELDER THAT WAS OF NO BENEFIT TO ANYONE, COUNCILMAN HOOSE
PROMISED TO SEE IF HE COULD GET THIS LIGHT RE-LOCATED.

WITH REFERENCE TO THE AUXILIARY POLICE PROGRAM, CHIEF CUMMINS STATED THAT AFTER A FEW DAYS, HE

ON THE BOARD - MR. GERALD PETRIE AND MRS. BETTY BOCK.
MR. CANDELET REPORTED THAT THEY HAVE APPROVED SITE PLANS FOR SEVERAL NEW BUSINESSES.
THEY APPROVED A REQUEST FOR REZONING OF 3 LOTS FROM C-3 TO R-2. THE REQUEST WAS WITHDRAWN AND
THE FEE RETURNED. THE COMMITTEE FELT THAT ANY FEE THAT IS PAID FOR FILING A CHANGE OF ZONING
OR A PETITION FOR REZONING SHOULD NOT BE REFUNDED IF IT IS WITHDRAWN AND THE FEE CHARGED SHOULD BE
PLUS ANY ADVERTISING COST.
AT THE WORKSHOP MEETING MR. CANDELET SUGGESTED A MORATORIUM ON C-1 AND C-2 AND DURING THE DISCUSSION
THAT FOLLOWED THE CITY ATTORNEY RECOMMENDED THAT AN AMENDMENT TO THE ORDINANCE BE DRAWN UP INSTEAD
OF HAVING A 6 MONTH MORATORIUM. MR. CANDELET THOUGHT THE BOARD COULD GET SOMETHING TOGETHER IN
ABOUT 2 MONTHS THAT WOULD COVER THE SITUATION. THiS WOULD BE PLUS ANY ADVERTISING TIME AND PUBLIC
HEARINGS.
THE COMMITTEE VOTED TO ASK FOR EXTRA TERRITORIAL PLANNING POWER FOR 6 PARCELS OF COUNTY OWNED
LAND IN AND ON THE FRINGES OF THE CITY LIMITS. DAVID MARSH OF THE COUNTY PLANNING OFFICE HAS
SINCE SUGGESTED A 3-WAY EFFORT WITH THE COUNTY, FELLSMERE, AND SEBASTIAN FOR FUTURE LAND USE
PLAN WORKED INTO OUR COMPREHENSIVE PLAN, AND THE PETITION WAS WITHDRAWN.
ONE VIOLATION OF THE ZONING CODEHAS BEEN RESOLVED. THIS WAS INSUFFICIENT PARKING SPACES. THE
HAS AGREED TO PUT IN MORE. ~.-~.~3
MAYOR FLOOD ASKED MR. CANDELET ABOUT A SAND DIGGING OPERATION THAT HAD BEEN GOING ON. HE REPLIED
THAT MR. VOCELLE HAD TAKEN CARE OF THE MATTER BY WRITING A CEASE AND DESIST LETTER.
MAYOR FLOOD ANNOUNCED THAT WORK HAS BEGUN ON THE BUDGET AND IT APPEARS THAT IT WILL BE NECESSARY
TO RAISE THE MILLAGE. THE PUBLIC WAS INVITED TO ATTEND THE MEETINGS OF THE FINANCE COMMITTEE.
A PUBLIC HEARING WILL BE HELD ON THE PROPOSED INCREAS£IN MILLAGE AND ALSO THE FINALIZATION OF THE
BUDGET.
COUNCILMAN GASS ANNOUNCED THAT WITHIN THE NEXT 10 DAYS THE INSTALLATION OF THE SPRINKLER SYSTEM
WILL BE COMPLETED AT THE FOOTBALL FIELD.

COUNCILMAN GASS REPORTED THAT THE CULVERT ON LAYPORT STREET EAST OF FLEMING WILL BE INSTALLED
WHEN THE TEMPORARY ELECTRIC INSTALLATION iS REMOVED.
COUNCILMAN GASS REQUESTED THAT BECAUSE OF THE MANY WATER AND DRAINAGE PROBLEMS WE HAVE AT THIS
TIME, PEOPLE SHOULD REFRAIN FROM ASKING US TO MOW EMPTY LOTS. FOR VARIOUS REASONS AT THE MOMENT
WE HAVE A SHORTAGE OF MANPOWER. WE ARE KEEPING A RECORD OF ALL COMPLAINTS AND WILL TAKE CARE OF
THEM IN DUE TIME.
COUNCILMAN JOACHIM ANNOUNCED THAT A PLAN,"THE VIAL OF LIFE", HAD BEEN IN~ATED BY THE POLICE
DEPARTMENT, WHEREBY A PERSON'S MEDICAL HISTORY IS PLACED IN A CONTAINER IN THE REFRIGERATOR.
IN CONJUNCTION WITH THIS, THE PERSON'S HOUSE WILL BE INSPECTED TO DETERMINE IF IT IS REASONABLY
BURGLAR-PROOF. ALSO, AS SOON AS ENOUGH VOLUNTEERS COME FORWARD, THE POLICE WILL INAUGURATE A
TELEPHONE REASSURANCE PLAN TO CALL PEOPLE WHO LIVE ALONE AND HAVE NO ONE TO LOOK AFTER THEM AND
MIGHT BE IN NEED OF ASSISTANCE. MAYOR FLOOD ASKED FOR VOLUNTEERS TO HELP WITH THIS PROGRAM.
COUNCILMAN HOOSE STATED THAT ALL STREET LIGHT REQUESTS HAD BEEN TAKEN CARE OF.
THE CITY CLERK READ A LETTER FROM MR. CONSTANTIN DIAMOND THANKING ALL THOSE INVOLVED IN THE ~
BUILDING AND INSTALLATION OF A SAFETY LADDER AT THE END OF THE PUBLIC PIER. HE ESPECIALLY THANKED '
ARTHUR MAYER, THE BUILDING OFFICIAL, FOR HIS EFFORTS AND REQUESTED THAT HE BE PUBLICLY COMMENDED
AND THE LETTER BE MADE A PART OF HIS PERFORMANCE RECORD.
A LETTER WAS READ FROM MR. L. B. VOCELLE, THE CITY ATTORNEY, ADVISING THAT HE HAD CONTACTED MR.
WAYNE ALLEN, GENERAL DEVELOPMENT CORPORATION, IN REGARD TO THE FIRE HYDRANTS AND WATER FRANCHISES
IN THE SEBASTIAN HIGHLANDS AREA, AND REQUESTED THAT THEY SHOULD BE BROUGHT UP TO THE STANDARDS OF
THE NATIONAL BOARD OF FIRE UNDERWRITERS.

SO THAT NEXT YEAR'S CELEBRATION WILL BE EVEN BIGGER AND BETTER.
MAYOR FLOOD ADVISED THAT THE MARKER HAS FIWA~N~IVED FOR THE DOCK AND DEDICATION WILL BE
HELD SATURDAY, AUGUST 19, AT 3:00 P.M. MR. JAMES VOC~E HAS BEEN ASKED TO BE THE SPEAKER. MRS.
BOLINGER, THROUGH THE CITY CLERK, EXTENDED AU iNVITAT~ TO ALL THE MEMBERS OF THE COUNCIL AND
TO ANYONE ELSE WHO WOULD LIKE TO ATTEND.
BY A YOUNG MAN WHO WAS CAUGHT IN THE ACT. HE WAS CHARGED WITH RECKLESS DRIVING AND HE IS GOING TO
BE'ASKED TO MAKE FULL RESTITUTION. MAYOR FLOOD ADDED THAT IT WAS A SICKENING SIGHT BECAUSE IT WAS
IN PERFECT SHAPE TO ALLOW THE LAYING OF SOD, BUT IT WOULD NOT INTERFERE WITH THE INSTALLATION OF
THE SPRINKLER SYSTEM.
THE BID FOR THE SOD WAS OPENED AT THE WORKSHOP MEETING ON AUGUST 9. THERE WAS ONLY ONE BID RECEIVED
FROM THE FLORIDA SOD COMPANY. THE BID WAS FOR $2160 iF CITY EMPLOYEES LAID THE SOD AND $2700
IF THE COMPANY DID THE JOB. IT WAS DECIDED THAT ALL THINGS CONSIDERED IT WOULD BE BETTER FOR THE
COMPANY TO DO IT.
MOTION BY COUNCILMAN GASS, SECONDED BY COUNCILMAN HOOSE, THAT WE ACCEPT THE BID FROM FLORIDA SOD
COMPANY TO INSTALL 36,000 SQ. FT. OF ARGENTINA BAHIA SOD FOR THE FOOTBALL FIELD AT A TOTAL COST
OF $2700., DELIVERY AUGUST 31, COMPLETION WITHIN 10 DAY OF DELIVERY. CARRIED.
COUNCILMAN JOACHIM HAD A QUESTION PERTAINING TO THE BID FOR THE ROAD IN THE CEMETERY. HE ADVISED
THAT ONE BID WAS RECEIVED BY 4:00 P.M. WEDNESDAY, AUGUST 9, AND ANOTHER RECEIVED TODAY, MONDAY,
AUGUST 14, BASED UPON THE CONTINGENT THAT AT THE TOP OF THE PUBLISHED REQUEST FOR BID BY THE
RIGHT HAND SIDE IT SAYS "BY THE 14th." THE BIDDER READ THAT MUCH AND THOUGHT HE HAD UNTIL TODAY.
MR. VOCELLE STATED THAT THROUGH SOME MISUNDERSTANDING THERE WERE TWO NOTICES TO BID PUBLICIZED
AND ONE OF THEM DOES SET 4:00 P.M. WEDNESDAY, AUGUST 14. OF COURSE, AUGUST 14 FELL ON MONDAY, NOT
WEDNESDAY. PURSUANT TO THE NOTICE TO BID, THE BIDS THAT WERE RECEIVED IN CITY HALL BY 4:00 P.M.
ON WEDNESDAY, AUGUST 9, WERE OPENED THAT NIGHT AT THE WORKSHOP MEETING. MR. VOCELLE RECOMMENDED
THAT SINCE THIS SITUATION WAS NOT FAIR TO ANY OF THE BIDDERS AND THE NOTICE SPECIFICALLY GAVE THE
CITY THE RIGHT TO RE~CT ANY OR ALL BIDS, THIS IS WHAT SHOULD BE DONE AND THE BID RE-ADVERTISED.
MOTION BY COUNCILMAN HOOSE, SECONDED BY COUNCILMAN JOACHIM, TO REJECT THE BIDS FOR A ROADWAY IN
THE CEMETERY AND RE-ADVERTiSE. CARRIED.
MAYOR FLOOD SUGGESTED AND COUNCILMAN JOACHIM AGREED THAT THE BID SHOULD INCLUDE "ON A PER YARD
BASIS" FOR THE LIMEROCK.
MR. VOCELLE PRESENTED AN ORDINANCE REQUIRING THE FENCING OF SWIMMING POOLS. HE READ THE NEW STATUTE
WHICH STATES THAT A PROPOSED ORDINANCE MAY BE READ BY TITLE OR IN FULL ON AT LEAST TWO SEPARATE
DAYS AND SHALL AT LEAST SEVEN DAYS PRIOR TO THE ADOPTION BE NOTICED ONCE iN THE NEWSPAPER. IN
OTHER WORDS, THERE WOULD BE A READING TONIGHT BY TITLE ONLY, THEN A PUBLIC HEARING SET, AND THEN
AN ADVERTISMENT PLACED SEVEN DAYS PRIOR TO THE FINAL ADOPTION. MAYOR FLOOD REMARKED THAT THIS

A PUBLIC HEARING AT THE NEXT WORKSHOP MEETING AND FINAL PASSAGE AT THE NEXT REGULAR MEETING. THE
CITY CLERK THEN READ THE ORDINANCE BY TITLE ONLY. COUNCILMAN HOOSE INQUIRED IF THIS ORDINANCE
WOULD BE READ iN ITS ENTIRETY AT THE WORKSHOP MEETING, BECAUSE HE WOULD LIKE TO SEE ALL ORDINANCES
READ IN THEIR ENTIRETY AT LEAST ONCE. MR. VOCELLE AGREED THAT WHILE IT WAS NOT NECESSARY, IT WAS
A GOOD IDEA AND SHOULD BE READ IN ENTIRETY AT THE PUBLIC HEARING WHICH WAS SCHEDULED FOR SEPTEMBER 6.

ONLY OF AN ORDINANCE REQUIRING FENCING OF SWIMMING POOLS, RESTRICTIONS AS TO DIVING BOARDS AND LADDERS,
AND PROVIDING AN EFFECTIVE DATE.

SOUTHBOUND U.S. 1 AND 2ND STREET. THE LETTER WAS WRITTEN ON BEHALF OF THE SOUTHEAST BANK OF
SEBASTIAN, REPRESENTATIVES OF WHICH WOULD LIKE TO MEET WITH MAYOR FLOOD AND POLICE CHIEF CUMMINS
TO DISCUSS POSSIBLE OTHER ALTERNATIVES. MR. VAN DE VOORDE WAS PRESENT AT THE MEETING AND REQUESTED
THAT MAYOR FLOOD ARRANGE A MEETING WITH THE CITY COUNCIL, AN ENGINEER REPRESENTING THE SOUTHEAST
BANK, AND A REPRESENTATIVE FROM THE DEPARTMENT OF TRANSPORTATION, INORDER TO DISCUSS ALTERNATIVES,
BUT ADMITTED THAT AT THIS TIME HE DID NOT HAVE AN ALTERNATIVE. CHIEF CUMMINS STATED THAT HE DID HAVE.
MAYOR FLOOD AGREED TO SET UP A MEETING, BUT ADVISED THAT IT WOULD HAVE TO BE HELD SOMETIME LATER
IN SEPTEMBER AFTER THE BUDGET HEARINGS WERE OUT OF THE WAY.

COMPLETED. HE HOPED THAT IT WOULD BE ADOPTED AT THE NEXT REGULAR MEETING SO IT OUGHT TO BE A
30 DAY MORATORIUM.
MOTION BY COUNCILMAN HOOSE, SECONDED BY COUNCILMAN JOACHIM, TO PLACE A MORATORIUM UNTIL 5:00 P.M.,
SEPTEMBER 12, ON ANY NEW SUBDIVISIONS OR BUILDING THAT WOULD REQUIRE A SEWER-WATER SYSTEM. CARRIED.
THERE WAS A DISCUSSION WITH REGARD TO A BID FOR RESTROOMS AT THE FOOTBALL FIELD. THE NORTH COUNTY
RECREATION COMMITTEE IS GOING TO PAY FOR THIS WITH MATCHING FUNDS COMING OUT OF VICE MAYOR GRAY'S
BUDGET FROM LAST YEAR. MR. VOCELLE ADVISED THAT SINCE CITY FUNDS ARE INVOLVED, THE CITY SHOULD
ADVERTISE THE BID AND IT SHOULD BE THE ULTIMATE DECISION OF THE COUNCIL WHETHER OR NOT TO ACCEPT
A BID.

MAYOR FLOOD STATED THAT THERE HAD BEEN SOME QUESTION ABOUT THE LEGALITY OF THE LAS VEGAS NIGHT
HELD RECENTLY AT THE COMMUNITY CENTER AND ADVISED THAT A NEW LAW HAD BEEN PASSED PERMITTING SUCH
ACTIVITIES. MR. VOCELLE READ THE NEW LAW, EFFECTIVE MAY 4, 1978, WHICH ALLOWS BINGO OR GUESS GAMES
TO BE HELD BY CHARITABLE NON-PROFIT ORGANIZATIONS ON PROPERTY OWNED BY A MUNICIPALITY OR A COUNTY
WHEN THE GOVERNING AUTHORITY HAS SPECIFICALLY AUTHORIZED THE USE OF THE PROPERTY FOR THE CONDUCT
OF SUCH GAMES.
