GASS, COUNCILMAN FRANK OBERBECK, COUNCILMAN RICHARD VOTAPKA, CITY ATTORNEY DANIEL KILBRIDE AND MAYOR PAT FLOOD, JR. ABSENT: COUNCILMAN GEORGE SCHUM MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, TO BRING TO THE FLOOR A DISCUSSION REGARDING SETTING UP A MERIT PAY INCREASE PROCESS.. MOTION CARRIED.° MR. JOSEPH LANCASTER, FINANCE DIRECTOR, REPORTED THAT HE HAS SPOKEN TO MR. NICK PELLERGRINO, CODY AND ASSOCIATES, INC., CONCERNING THE PREPARATION OF A MERIT PROCESS STUDY FOR CITY EMPLOYEES. MR. PELLEGRINO STATED THAT THE PREPARATION WOULD TAKE FIVE TO SIX DAYS TO COMPLETE AT AN APPROXIMATE COST OF $200.00 PER DAY AND THAT HE WOULD INCLUDE AN UPDATE OF OUR PRESENT PAY SCALE BREAK DOWN. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN VOTAPKA, THAT WE AUTHORIZE CODY AND ASSOCIATES TO PREPARE A MERIT PROCESS STUDY FOR CITY EMPLOYEES AND ALSO AN UP DATE OF OUR PRESENT WAGE SCALE WITH A MXIMUM COST OF $1,500.00 ROLL CALL VOTE: AYES: VICE MAYOR GASS COUNCILMAN OBERBECK COUNCILMAN VOTAPKA MAYOR FLOOD NAYS : ~ -- ~---~ ~ MOTION CARRIED. ROLL CALL VOTE: AYES: VICE MAYO~ ~ COUNCI{ MAYOR FLOOD THAT WE GO AHEAD AND AUTHORIZE UP TO MAYOR FLOOD STATED THAT MR.NELSON HYATT IS WILLING TO REIMBURSE THE CITY FOR THE COST OF THE RAIL ROAD CROSSING IF THE APPEAL IS DECIDED IN THE CITY'S FAVOR, BUT IF IT REMAINS IN THE COUNTY HE WILL NOT PAY FOR IT. IN ORDER TO EXPEDITE MATTERS, THE COUNCIL FELT THAT THE RESOLUTION BE SENT TO THE DEPARTMENT OF TRANS- PORTATION, REQUESTING AUTHORIZATION FOR A VEHICULAR CROSSING. ATTORNEY KILBRIDE READ IN ITS ENTIRETY A RESOLUTION REQUESTING THE FLORIDA DEPARTMENT OF TRANSPORTATION TO AUTHORIZE A VEHICULAR CROSSING OF THE FEC RAILROAD AT THE EXTENSION OF STRATTON AVENUE; PLEDGING TO CONSTRUCT AND MAINTAIN SAID CROSSING; AUTHORIZING THE MAYOR AND CLERK TO APPLY FOR RAILROAD CROSSING PERMIT. ROLL CALL VOTE: AYES: VICE MAYOR GASS COUNCILMAN OBERBECK COUNCILMAN VOTAPKA MAYOR FLOOD NAYS: NONE MOTION CARRIED. IT WAS THE COUNCILS DECISION NOT TO ABANDON THE RIGHT OF WAY AS REQUESTED FOR LOUISIANA AVENUE, SINCE THE ROAD IS SCHEDULED FOR EXTENSION IN THE FUTURE AND THAT THE CITY WILL NEED THE RIGHT OF WAY. (FLOOD) MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, THAT WE DO NOT ABANDON THE RIGHT OF WAY AS REQUESTED AT THIS TIME. REGULAR COUNCIL MEETING - SEPTEMBER 15, 1982 MOTION AMENDED BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, THAT THE REQUEST TO ABANDON THE RIGHT OF WAY IS DENIED AT THIS TIME. MOTION CARRIED. MAYOR FLOOD STATED THAT IT IS THE RECOMMENDATION OF THE AIRPORT COMMITTEE THAT THE POSITION OF AIRPORT MANAGER BE FUNDED $200. O0 PER MONTH. ATTORNEY KILBRIDE EXPLAINED THAT THE ISSUE IS WHETHER THE COUNCIL WANTS TO GIVE HIM AUTHORIZATION TO DRAFT AN EMPLOYMENT CONTRACT FOR THE POSITION OF AIRPORT MANAGER AND ANY OTHER COMMENTS CONCERNING MR. DREW, CITY RESIDENT AND MR. JOHN VAN ANTWERP SHOULD BE BROUGHT BEFORE THE AIRPORT COMMITTEE. SINCE THE AIRPORT COMMITTEE IS IN NEED OF A PERSON TO FILL SOME VACANCIES ON THE BOARD, COUNCILMAN VOTAPKA, SUGGESTED THAT THESE VACANCIES BE ADVERTISED IN A LOCAL NEWSPAPER FOR THIRTY DAYS WHICH WOULD BE IN COMPLIANCE WITH THE COMMITTEES ORDINANCE. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, TO TABLE THIS DISCUSSION UNTIL THE NEXT WORKSHOP MEETING TO GIVE US THE OPPORTUNITY TOHEAR FROM MR. DREW AND MAYBE HIS ATTORNEY SINCE IT IS MORE COMPLEX THAN JUST THE ISSUE OF THE COMPENSATION. THAT WE APPROVE A $200.00 FEE PER MONTH MOTION CARRIED. THAT WE START PAYING JOHN VAN ANTWERP ROLL CALL VOTE: AYES: VICE MAYOR GASS ON SEPTEMBER 28, 1982 AND IF THE COMMITTEE FEELS IT IS NECESSARY AT THAT TIME THEY WILL REPORT TO THE COUNCIL. MAYOR FLOOD ASKED COUNCILMAN OBERBECK IF HE WOULD LIKE TO ACT AS THE LIASON FOR THE CITY AND THE 1982-83 FOURTH OF JULY COMMITTEE. COUNCILMAN OBERBECK REMARKED THAT HE WOULD NEED SOME TIME TO CONSIDER IT. ATTORNEY KILBRIDE REPORTED THAT HE WAS UNABLE TO REPORT AT THIS TIME CONCERNING THE LEGALITY OF THE CITY ACTING AS THEIR OWN GENERAL CONTRACTOR IN THE RENOVATION OF THE OLD SEBASTIAN ELEMENTARY SCHOOL, BUT THAT HE WOULD REPORT AT THE WORKSHOP MEETING, OCTOBER 6, 1982. MAYOR FLOOD RECOMMENDED THAT EARL MASTELLER, CITY ENGINEER, GO AHEAD AND PREPARE THE BID DOCUMENTS WHILE WE ARE WAITING FOR THE CITY ATTORNEY'S REPORT ON OCTOBER 6, 1982. MAYOR FLOOD REPORTED THAT IT WAS BROUGHT TO HIS ATTENTION BY THE SEBASTIANAIRPORT COMMITTEE THAT A TRANSFER OF LEASE FROM GOLD STAR, INC. TO COMPLETE HOMES, INC. HAS BEEN REQUESTED. SINCE THE AIRPORT COMMITTEE DID NOT HAVE A FULL QUORUM AT THEIR LAST MEETING, THEY COULD NOT TAKE ANY ACTION ON THIS MATTER AND HAVE RECOMMENDED THAT IT BE TURNED OVER TO THE CITY COUNCIL IN ORDER FOR IT TO BE EXPEDITED. JOHN VAN ANTWERP, AIRPORT MANAGER, REPORTED THAT THE FAA HAS TO BE NOTIFIED REGARDING THIS LEASE TRANSFER FROM GOLD STAR, INC. TO COMPLETE HOMES, INC., SINCE THE ORIGINAL LEASE IS AN AVIATION TYPE OF LEASE THAT HAS BEEN APPROVED BY THE FAA. HE RECOMMENDED THAT THIS LEASE TRANSFER BE APPROVED CONTINGENT UPON FAA APPROVAL. ATTORNEY KILBRIDE STATED THAT IF THIS LEASE TRANSFER IS APPROVED THAT THE COUNCIL CONSIDER A NEW RENTAL FEE BASED ON THE MANUFACTURERS USE AND SQUARE FOOTAGE. HE ALSO RECOMMENDED THAT THE COUNCIL BE GIVEN A COMPLETE PACKAGE INCLUDING ALL INFORMATION ON THIS PRE-FAB OPERATION AND ALSO A COPY OF THE SALES CONTRACT. IN RESPONSE TO COUNCILMAN OBERBECK'S CONCERN, REGARDING FINAL AUTHORIZATION AND IF COMPLETE HOMES, INC., IS IN OPERATION AT THE AIRPORT AT THE PRESENT TIME, MAYOR FLOOD STATED THAT COMPLETE HOMES, INC., WAS NOT AUTHORIZED TO BEGIN OPERATION AND THAT HE AND JOHN VAN ANTWERP WOULD GO OUT TO THE HANGAR IN THE MORNING TO SEE IF THEY ARE OPERATING. HE STATED THAT HE WOULD HAVE THE CITYCLERK NOTIFY EACH COUNCIL MEMBER AS TO WHAT TRANSPIRES AND THAT IF NECESSARY HE WOULD HAVE TO CALL AN EMERGENCY MEETING. REGULAR COUNCIL MEETING - SEPTEMBER 15, 1982 MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, THAT WE TABLE THIS DISCUSSION FOR A WORKSHOP MEETING, SO WE WILL HAVE THE PEOPLE INVOLVED PRESENT, CONSIDER RAISING THE LEASE AND WHY THEY ARE OPERATING RIGHT NOW WHEN THEY SHOULDN'T. ROLL CALL VOTE: AYES: VICE MAYOR GASS COUNCILMAN OBERBECK COUNCILMAN VOTAPKA MAYOR FLOOD NAYS: NONE MOTION CARRIED. SINCE THE ORDINANCE FOR THE AIRPORT COMMITTEE REQUIRES THAT ALL VACANCIES BE FILLED BY 30 DAY PUBLIC NOTICE, MAYOR FLOOD REQUESTED THAT THESE VACANCIES BE POSTED ON THE WINDOW OF THE CITY CLERK'S OFFICE ALONG WITH ANY OTHER VACANCIES ON CITY COMMITTEES. HE ALSO REMARKED THAT MR. MICHAEL KENNEY'S APPLICATION WOULD BE HELD UNTIL THIS DEADLINE FOR CONSIDERATION. COUNCILMAN VOTAPKA RECOMMENDED THAT WE CONTRACT MR.HERB STRICKLER, TO SEE IF HE WOULD WORK UP AN ADD IN THE NEWSPAPER ADVERTISING THESE POSITIONS, AT NO COST TO THE CITY. MAYOR FLOOD ANNOUNCED THAT APPLICATIONS HAD BEEN RECEIVED FOR THE EXPIRED TERMS ON THE SEBASTIAN CONSTRUCTION .BOARD & THAT TWO APPLICANTS WERE INCUMBENTS WITHOUTANY APPLICANTS CHALLENGING THEIR POSITION. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, THAT WE ACCEPT THE RECOMMENDATION OF THE CONSTRUCTION BOARD AND ACCEPT MR. DONALD LANGLOIS, CONCERNED CITIZEN, MR. GREGORY.PALMER, AIR CON- MOTION WITHDRAWN BY COUNCILMANOBER~ECK, SECO. VD ~IIHDRE~ B~ COUNCILMAN VOTAPKA. MOTION CARRIED. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY VICE MAYOR GASS, TO DELETE FROM THE AGENDA, THE STRAW BALLOT FOR A SWIMMING POOL. MOTION CARRIED. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, TO PERMIT SYLVIA FLOOD TO SERVE ALCOHOLIC BEVERAGES AT A FISH FRY, TO BE HELD AT THE SEBASTIAN COMMUNITY CENTER, ON OCTOBER 2, 1982. MOTION CARRIED. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN VOTAPKA, TO PERMIT THE FOURTH OF JULY COMMITTEE TO SERVE ALCOHOLIC BEVERAGES AT LAS VEGAS NIGHT AND VARIOUS OTHER DANCES TO BE HELD AT THE SEBASTIAN COMMUNITY CENTER ON DECEMBER 4, 1982, JANUARY 29, 1983, MARCH 12, 1983, APRIL I6, 1983 AND JUNE 18, 1983. ~OTION CARRIED. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, TO BRING TO THE FLOOR A DISCUSSION RE- GARDING THE MAYOR'S VACATION PAY. MOTION CARRIED. MAYOR FLOOD QUESTIONED WHETHER HE WOULD BE ENTITLED TO 'HIS TWO WEEKS VACATION EARNED THIS YEAR AND IF SO AT WHAT RATE OF PAY WOULD HE BE ENTITLED TO SINCE HIS SALARY REDUCTION BECAME EFFECTIVE SEPTEMBER 15, 1982. AFTER SOME DISCUSSION, ATTORNEY KIBLRIDE STATED THAT UNDER THE OLD SALARY AND RULES THE MAYOR HAS EARNED THIS VACATION AND THAT THE CHARTER CHANGE DID NOT CHANGE HIS BENEFITS. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, THAT WE PAY .THE MAYOR. ~HE VACATION PAY THAT HE HAS COMING UNDER HIS FULL TIME SALARY WHICH HE PREVIOUSLY EARNED FOR ~HE LASTll% MONTHS. MOTION CARRIED. REGULAR COUNCIL MEETING - SEPTEMBER 15, 1982 ATTORNEY KILBRIDE STATED FOR THE RECORD, THAT TO THE BEST OF HIS KNOWLEDGE HE DID NOT SEE ANY PROBLEM WITH THIS DECISION AND THAT SINCE THIS DECISION WILL EFFECT THE MAYOR'S COMPENSATION THAT HE FILE A CONFLICT OF INTEREST FORM WITHIN 48 HOURS. PERMISSION COULD NOT BE GIVENTO.MAYOR FLOOD, REGARDING ANY TRAVEL IN CONNECTION WITH THE COUNTY AND THE STRATTON AVENUE EXTENSION PROJECT SINCE A FULL COUNCIL WAS NOT PRESENT.
