Those answering rollcall were Mayor Middleton,Presldent SweatS,and Councilm~n Sembler, Ellingsen, Shaffer and Dahlstrom. Mr Vocelle City Attorney also present. Minutes of special meeting of August 8th and regular meeting of August 13th. were approved as read. Bills to the amount of~200.31 approved by the finance committee were ordered paid on motion by Councilman Dahlstrom which was seconded by Councilman Ellingsen.Carried. Mr M.L.Medlin school trustee presented the City Council and other Guests present from other organizations with facts concerning the repair of Sebastian School House. Councilman Sembler said that he was in favor of Committee to be formed and attend the School Board meeting Saturday September 15,1951 at 2:00 P.M. at Court House,whereby the President of the Council appointed Councilman Ellingsen to said committee and also appointed Councilman Sembler as alternate in case Oouncilman Ellingsen could not attend. Councilman Ellingsen's report on the Police ~ar Hadio not being favorable Councilman Sembler moved it be tabled, which was seconded bY oouncilman ~ahlstrom.~arried. Building permit application for residence by Mr Halph S,'l'hompson was passed on .by motion by Councilman Dahlstrom which was seconded by Councilman Shaffer.Oarried. On Motion bt Councilman Sembler and seconded by Councilman Elllngsen, One Hundred Collars was authorized to be spent for supplies for the County Nurse and to be in the City Hall at Sebastian for first aid and whaZ~eever needed, carried. Councilman Dahlstrom Chairman of the Fire Department was authorized to spend twenty five dollars for the installation of directional lights on the Fire Truck on motion by Councilman Sembler and seconded by Councilman mllingsen.~arried. Two Stent tires and tubes for the Cub Tractor were authorized on motion by Councilman Elllngseh and seconded by Councilman Dahlstrom.Carried.' On motion by Councilman Ellingsen which was seconded by Councilman Shaffer,authorlza tion was given to purchase a drag scoop for the Cub Tractor.carried. The Clerk was authorized to purchase Bond Book to keep record o oupons ~pald by the Guaranty Trust Co of New York in order to have a complete record of all coupons paid.Carried. ~ Mayor Middleton was authorized to make fu:~her check on siren for the Police Car. The City of Sebastian budget for balance of 1951 and 1952 was accepted on motion by Councilman Dahlstrom anf seconded by Councilman Elllngsen.Oarried. Meeting called by Mayor Middleton for the purpose of the City of Sebastian,Fla. to levy and collect license tax upon all retail vendors of alchOllc beverages within the City of Se bast lan. Meeting called to order by Preslden~ Sweatt. Those present at roll call were Mayor Middleton,President Sweatt,Councilmen Sembler, Ellingsen,Shaffer and Dahlstrom. all mebmers present. Councilman Sembler introduced an"Ordinance imposing a license tax upon all retail vendors of alcohllc beverages in th~ City of Sebastian,Florida; fixing the amount thereof; providing the manner of issuing such license, and prescribing penalties for the violation thereof.And moved its adoption BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL,OF THE CITY OF SEBASTIAN,FLORIDA: Sec.1 Each retail vendor of alcholic beverages in the $ity of Sebastian,~lorida,shal~ pay an annual municipal license tax for the dOnduct of such business,as follows: 1.(a) Vendors of beverages containing alchol"of more than one percent by weight and more than three and two tenths per cent by weight, Fifteen Dollars. (b~ Vendors of beverages containing alchol of more than one per cent by weight and not more than three and two tenths per cent by weight for consumption off the premises only, Seven and One Half dollars. (a) Vendors of beverages containing alcohol of more than one per cent by weight and not more than fourteen per cent by welEht, and Wines regardless of alcholic content, (b~ Vendors of beverages containing alchol of more than one per cent by weight and not more than f~ourteen per cent by weight,and wines regardless of alcholiC content, for consumption off the premises only,Twenty Five Dollars. 3. Vendors of beverages,regardless of alcholic content,operating places of busines where such beverages are sold only in sealed p~~$~-~ containers for consumption off the premises where sold, ~wo Hundred and Twenty Five Dollars. 4. Vendors of beverages, regardless of alchol~c content,operating places of busine~ for ~consumption Sn or Off the premises, Three Hundred Dollars. Sec.2. No person,firm or corporation shall engage in the business of selling alcholic beverages at retail,within the corporate limits of the City of Sebastian,Florida,without fir~ paying the license tax therefor, as provided in section 1 hereof.Said license tax shall be d~ and payable at the time and in the manner prescribed by c~apter 90 of the Ordinances of said and all the provisions of said Chapter relating to the mannar of issuing occupational livens, shall be applicable to the licensees to be issued under the provisions of this Ordinance. Sec.3. Any person, firm or corporation violating any of the provisions of this 0rdinan, shall,upomthe conviction, thereof,be punished by fine not exceeding $500.00 or by imprisonme~ not exceeding 60 days,either one or both in the discretion of the Court trying the offender. Sec.4. All ordinances or parts of ordinances in confliet herewith are hereby repealed. Sec of the Mayor or by its becoming an ordinance wothout such approval. ~ .5. This Ordinance shall be in full force and effect immeadiately upon its pass~ ~ approval uPon motio~ made by Councilman" Sembler and seconded by Councilman Shaffer and un~n~i~ ly carried,said ordinance was raad the first time in full. Upon motion made by Councilman Sembler and seconded by Councilman Ellingsen and unanimously carried,said ordinance was read the second time by title only; there being no am, merit offered upon mm~ohtmade by Councilman Sembler seconded by Councilman Ellingsen said ordinance was read the third time in full and placed upon the final passage of said ordinanc, the result was as follows. AYES: Councilmen Sweatt,Sembler,Ellingsen,Shaffer & Dahlstrom. NAYS: NONE Thereupon said Ordinance having received an affirmative vote of hhree fifths of all members of the Council was declared duly adopted and upon being presented to the Mayor and having received his approval was numbered as Chapter 1~8 of the Ordinances of said City and thereupon duly posted at the door ofnthe City Hall of the City of Sebastian in accordance wit provisions of Section 85 of Chapter 1§~8~ of the laws of Florida, being the charter of said The Mayor called the Council's attention to the fart the Police car was going on two ye~ old and would be in line for repairs and asked their opinion as to purchaseing a new car, Whereby Councilman E~lngsen moved that the Mayor be authorized to purchase a new Ford Polic~ Special as soon as delivery eould~be~m~de~?fO: same,said motion was seconded by Councilman Sembler and Carried. A bill from the Florida Motors for repair on the police car of $148.80 was authoriz, be paid on motion by OouncllmanoEllingsen ahd seconded by Councilman Dahlstrom and carried. Authorization was given for the purchaseing of new Siren for the New Police Car on moil( by Councilman Sembler and seconded by Councilman zllingsen and carried. CoUncilman Sembler Chairmen of Street and Alley Committee was authorized to have sldewa] repaired,on motion by Councilman Elllngsen which was seconded by Councilman Shaffer .Carried, There being no more business meeting adjourned.
