PURPOSE:
1989/90 FISCAL YEAR BUDGET 2ND PUBLIC HEARING AND
ADOPTION
Mayor Votapka called the Special Meeting to order at
7:00 p.m.
2. Councilman Rondeau led the Pledge of Allegiance.

The City Manager requested an emergency item be added
to the agenda regarding discussion of appointment of
special counsel concerning the alternative writ of
mandamus.

I move we add to this agenda discussion of
appointment of special counsel regarding the
alternative writ of mandamus.
VOICE VOTE on the motion carried 5-0.
1989/90 FISCAL YEAR BUDGET
A. RESOLUTION NO. R-89-45 - AD VALOREM TAX
A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA,
PROVIDING FOR THE LEVY OF AD VALOREM TAXES FOR THE
CALENDAR YEAR 1989; PROVIDING FOR DEPOSIT OF TAX
LEVIES; AND PROVIDING FOR AN EFFECTIVE DATE.
The City Manager read Resolution No. R-89-45 by title
only.
Mayor Votapka opened the public hearing at 7:05 p.m.
There being no input from the public he closed the
public hearing at 7:06 p.m.
MOTION by McCollum/Rondeau
I move we adopt Resolution No. R-89-45, as read
by the City Manager by title only.

B. RESOLUTION NO. R-89-46 - 1989/90 BUDGET ADOPTION
A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA,
ADOPTING THE ANNUAL BUDGET OF THE CITY OF SEBASTIAN,
FLORIDA, FOR THE FISCAL YEAR BEGINNING OCTOBER 1,
1989, AND ENDING SEPTEMBER 30, 1990; APPROPRIATING
FUNDS FOR THE EFFICIENT AND EFFECTIVE OPERATION OF
THE GOVERNMENT OF THE CITY OF SEBASTIAN AND ALL OF
ITS DEPARTMENTS FOR THE FISCAL YEAR ENDING SEPTEMBER
30, 1990, SUCH APPROPRIATIONS BEING FROM ANTICIPATED
REVENUE; PROVIDING A MEANS TO AMEND THE SAID ANNUAL
BUDGET SO AS TO CARRY FORWARD THE FUNDING OF PURCHASE
ORDERS, WORK ORDERS, AND GRANTS OUTSTANDING AS OF
SEPTEMBER 30, 1989; PROVIDING A MEANS TO AMEND THE

SAiD BUDGET TO REFLECT GRANTS RECEIVED AFTER
SEPTEMBER 30, 1989; PROVIDING A MEANS TO AMEND SAID
BUDGET SO AS TO CARRY FORWARD UNENCUMBERED BALANCE IN
CAPITAL PROJECTS FUND; AUTHORIZING THE TRANSFER OF
FUNDS HEREIN APPROPRIATED SO LONG AS THE TOTAL
COMBINED APPROPRIATIONS SHALL NOT BE INCREASED
THEREBY; AND PROVIDING FOR AN EFFECTIVE DATE.
The City Manager read Resolution No. R-89-46 by title
only.
Mayor Votapka opened the public hearing at 7:08 p.m.
Edwin Gilcher, 661Wimbrow Drive, Sebastian, urged
Council to increase the budget for the Police
Department to ensure service to the public.
George Metcalf, 425 Pine Street, Sebastian, spoke in
favor of the proposed budget but stressed that it can
be improved in future years with proper planning.
Ken Roth, 402 Ash Street, Sebastian, stated that a
copy of the proposed budget should have been
available to the public at the hearing.
MOTION by Rondeau
I move we bring Resolution No. R-89-46 to the
table for discussion.
MOTION withdrawn by Rondeau
MOTION by McCollum/McCarthy
I move we adopt Resolution No. R-89-46 as read by
the City Manager by title only.
Discussion took place on the merits and deficiencies
of the proposed budget. Vice Mayor McCarthy
requested that the record show that Council did not
discuss department head salaries during the CWA union
caucus. The City Manager said he would re-evaluate
certain personnel classifications at the end of
November.

Discuss Appointment of Special Counsel Re:
Alternative Writ of Mandamus
The City Manager said he and the City Attorney
concurred that Council should appoint special counsel
regarding the alternative writ of mandamus since
Attorney Nash, prior to the airport referendum, had
given an opinion on the legality of the question.
City Council concurred with the City Manager's
recommendation to bring a recommendation to Council
at the September 27, 1989 meeting.
Mayor Votapka adjourned the meeting at 8:00 p.m.
