Mayor Powell read and presented the proclamation to
Dom Whitmore, recipient for the U.S. Fish and
Wildlife Service, however, advised that this was not
a City Council endorsement of proposed expansion of
the refuge area.

The City Manager read the consent agenda in its
entirety.
Mayor Powell removed item D.
MOTION by Holyk/Oberbeck
I move that we approve items A, B, and C of the
consent agenda as written.
VOICE VOTE on the motion carried 5-0.
Item D
Mayor Powell inquired whether it was standard
practice to require a $100 security deposit for use
of Riverview Park.
The City Manager responded that it was standard when
a group seeks City Council approval for a use to
charge a $100 deposit, however if Council wished to
amend that condition it could do so.
Mayor Powell suggested that the security deposit
condition be placed on an agenda for future
consideration. The City Manager said it was staff's
intent to draft regulations for use of the park by
large groups as has been done for the Yacht
Club/Community Center.
MOTION by Oberbeck/Holyk
I would move that we approve item D of the
consent agenda Church of the Nazarene request to use
Riverview Park 10/11/92.
VOICE VOTE on the motion carried 5-0.

11. MAYOR AND CITY COUNCIL MATTERS
A. Mrs. Carolyn Corum
Mrs. Corum acknowledged a citizen's letter
recommending opening of an alternative access to
Chessers Gap; and spoke to citizen concern relative
to the recent clearing of the banks of Collier Creek
at Hardee Park.
B. Dr. Peter R. Holyk
Dr. Holyk reiterated Mayor Powell's statement that
the Pelican Island Wildlife Refuge proclamation was
not an endorsement by the City Council for expansion;
stated that it is important to the growth of
Sebastian to obtain professional assistance when
needed.
C. Mr. George G. Reid
Mr. Reid noted that wild ducks are still present in
the city; and thanked the Press Journal for advising
the public that the budget hearing tape would play on
Tuesday, September 22.
D. Mayor Lonnie R. Powell
Mayor Powell acknowledged a citizen letter requesting
a dock on the lake at Blossom Drive and recommended
staff look into it; urged support by staff and
residents to write to Dr. Barbara Bryant regarding
increasing census figures; and requested staff to
look into a letter regarding children hanging out on
fitness equipment at Hardee Park.

1. Bond Money four Street Repair (No Backup)
Mayor Powell recommended that discussion take place
on the possibility of a financing method to develop a
better street repair program.
Following discussion, the City Manager said he would
like to do some staff analysis regarding methods of
financing other municipalities are using.

Mayor Powell called recess at 8:18 p.m. and
reconvened the meeting at 8:37 p.m. Ail members of
City Council were present.

12. CITY ATTORNEY MATTERS
The City Attorney said that proposed Charter
amendments are with the City Manager, City Clerk and
Supervisor of Elections; said that Land Development
Code amendments are with the Director of Community
Development; suggested a 3oint workshop with City
Council, Board of Adjustment and Planning and Zoning
relative to a 4th District Court of Appeals decision
on quasi-judicial matters, which, he said, is on file
with the Director of Community Development.

The City Manager reported on informal negotiations
with the Coraci property for annexation into the
City; and, responded to concerns expressed relative
to the clearing of the banks at Hardee Park.
COMMITTEE REPORTS/RECOMMENDA?IONS
Mrs. Corum reported that there will be a Land
Acquisition Committee field trip on the last
Wednesday of the month at 1:30 p.m. regarding
"Sebastian Scrub".
OLD BUSINESS
Review of Golf Course Clubhouse Facility
Expansion (Staff Recommendation dated 9/17/92,
Jones Letter dated 9/15/92, Plans Under Separate
Cover)
Peter Jones, architect for the project, presented the
conceptual plan and fielded questions from City
Council.
A brief discussion followed and it was the consensus
of City Council to approve the conceptual plan and
go to Planning and Zoning for site plan approval.

AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, AMENDING CHAPTER 7 OF THE CODE OF
ORDINANCES OF THE CITY OF SEBASTIAN PERTAINING TO
TECHNICAL CODES; AMENDING SECTION 7-16 OF THE CODE OF
ORDINANCES OF THE CITY OF SEBASTIAN TO PROVIDE FOR
THE ADOPTION OF UPDATED ADDITIONS OF VARIOUS BUILDING
CODES; AMENDING SECTION 7-35 OF THE CODE OF
ORDINANCES OF THE CITY OF SEBASTIAN TO ADOPT AN
UPDATED EDITION OF THE NATIONAL ELECTRICAL CODE;
AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES OF THE
CITY OF SEBASTIAN TO ADOPT UPDATED NEW FIRE
PREVENTION CODES; PROVIDING FOR A REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF
THE CITY OF SEBASTIAN; PROVIDING A SEVERABILITY

The City Attorney read Ordinance No. O-92-17 by title
only.
George Metcalf, 425 Pine Street, Sebastian,
addressed the ordinance.
Following a brief discussion, motion was made.
MOTION by Oberbeck/Holyk
I would move that we approve the first reading of
Ordinance No. O-92-17 and set public hearing for
10/14/92.

AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, PERTAINING TO OCCUPATIONAL LICENSE
FEES; AMENDING SECTION 14-28 OF THE CODE OF
ORDINANCES OF THE CITY OF SEBASTIAN TO MODIFY
EXISTING OCCUPATIONAL LICENSE FEES FOR BARBER SHOPS
AND BEAUTY SHOPS; PROVIDING FOR REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF
THE CITY OF SEBASTIAN; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
The City Attorney read Ordinance No. 0-92-22 by title
only.
In response to the City Clerk, the City Attorney said
Section 5 of the Ordinance can be amended to be
effective as of October 1, 1992 for current license
renewals. The City Clerk said it would not create an
undue burden on her office to amend those licenses
affected.
The City Attorney read the amendment in Section 5
following the word "adoption" as, "and shall apply to
all new or renewal occupational licenses for the
period commencing 10/1/92"
MOTION by Oberbeck/Holyk
I would move that we approve Ordinance No. 0-92-
22 the first reading with the correction as indicated
by the Attorney in Section 5 and set public hearing
date for October 14, 1992.

The Assistant Finance Director fielded questions from
Council.
In response to Mr. Oberbeck, the Assistant Finance
Director named four other proposals received.
The City Attorney recommended that City Council
approve only the concept tonight and direct staff to
negotiate and bring back an agreement for approval.

I would move to waive the normal bidding procedure
and authorize further negotiation with the TRICO group.

Estimates)
The City Engineer presented the request and noted
that Dickerson had the Indian River CoUnty contract
for street paving.
MOTION by Oberbeck/Reid
I would move to waive the bidding procedure for
asphalt construction and direct staff to execute a
purchase order with Dickerson for $3,425 for the
overlay of the railroad crossing at Schumann Drive.

Request from Skydive Sebastian, Inc. - Permit
Skydiving at Airport (Staff Recommendation dated
9/17/92, Price Letter dated 9/16/92)
Clay Price, Skydive Sebastian, inc., with input from
Roger Moore, stated that they would like to buy J & S
Aviation, Inc. and were requesting approval for
skydiving at the Sebastian Municipal Airport.
A lengthy discussion ensued and City Council
generally concurred with the request, however, the
City Attorney advised that certain conditions of the
J & S Aviation lease would have to be addressed prior
to final approval.
Further discussion took place and the City Manager
requested that staff be given the opportunity to
respond to concerns.
At 10:30 p.m. motion was made.
MOTION by Oberbeck/Holyk
I would move that we extend the meeting five
minutes.
VOICE VOTE on the motion carried 5-0.
MOTION by Oberbeck/Holyk
I would move that we approve the request of
Skydive Sebastian, Inc. subject to working out the
conditions in the lease with staff and our City
Attorney.
The City Manager said, to avoid any conflict of
interest, he would assign a staff member other than
Mr. Van Antwerp to coordinate the research.
