MOTION by Oberbeck/Powell i move to approve the consent agenda excluding items D, E and H which will be brought up at further discussion. The City Attorney read Resolution Nos. R-90-37 and R- 90-38 by title only. MOTION and SECOND were withdrawn. Councilman Powell withdrew item B for discussion. Item B Councilman Powell questioned why trailers had been placed at Palm Lakes before approval of the final plat. The Director of Community Development said although the mobile homes had been shipped to the area, no permits had yet been issued and no enforcement action had been taken. Item D Vice Mayor Oberbeck questioned the source of payment of Solin's contract, to which the Finance Director responded that a grant of approximately $17,000 will fund the contract. MOTION by Oberbeck/Powell I move to approve item D of the consent agenda. Item E Vice Mayor Oberbeck questioned why an entrance road was being constructed prior to construction of the public works building. The City Manager responded that site plan on the building had been approved although some site analysis was still forthcoming. He said further that the VFW and American Legion had requested that construction of the road be expedited. Discussion followed regarding obtaining use of a service road from the American Legion for heavy equipment to use during construction of the building rather than using the newly constructed road. The City Manager said this item could be deferred to October 10th to allow him to contact the American Legion and report back to Council. PLANNING & ZONING COMMISSION 90.149 Recommendation Concerning Subdivision Access (Staff Recommendation dated 9/14/90, P & Z Memo dated 9/7/90) Subsequent to a brief discussion of the recommendation from Planning and Zoning and decision to exempt minor subdivisions from these requirements, motion was made as follows. MOTION by Oberbeck/Powell I move we direct the City Attorney to prepare the change by making an addition to paragraph E of Section 20A-17.2 A (1) regarding access to subdivisions as resubmitted to us by Planning and Zoning allowing for the exclusion of minor subdivision. OLD BUSINESS City Attorney Request for $5.00 Hourly Rate Increase (Deferred from 8/8/90 Workshop)(Memo from Cit~ Attorney dated 7/23/90) Following a lengthy statement by Mayor Conyers regarding the City Attorney's performance, motion was made. MOTION by Conyers/Oberbeck I move we not approve the five dollar hourly rate increase for the City Attorney. NEW BUSINESS Coastal Florida Police Benevolent Association ("PBA") Collective Bargaining Agreement - Implement Provisions of Article XXIV, "Group Insurance" (Staff Recommendation dated 9/20/90, Portion o__f Article XXIV of PBA Contract, City Manager Letter to PBA dated 9/20/90) This item had been previously deleted from the agenda. Florida State Lodge, Fraternal Order of Police ("FOP") Collective Bargaining Agreement - Implement Provisions of Article XXIV, "Group Insurance" (Staff Recommendation dated 9/20/90, Portion__°f Article XXIV of FOP Contract, City Manager Letter to FOP dated 9/20/90) The City Manager reiterated the options Council could elect in regard to group insurance. He said, according to the city's labor lawyer, if Council elects to pay the increase it would have to do so as a result of the collective bargaining process and in effect be willing to close on this article of the 8 Regular City Council Meeting September 26, 1990 Page Nine contract and leave the wage article open. MOTION by McCollum/Oberbeck I move that in the event that a successor contract is not in place by October 1, that we go by the old contract. ROLL CALL: Vice Mayor Oberbeck Councilman Powell Councilman Rondeau Mayor Conyers Councilman McCollum aye aye aye aye aye MOTION CARRIED 5-0. 90.225 Communications Workers of America ("CWA") Local 3180 Collective Bargaining Agreement - Implement Provisions of Article 17, "Group Insurance" (Staff Recommendation dated 9/20/90, Portion of Article 17 of CWA Contract, City Manager Letter to CWA dated 9/20/90) The City Manager said that the CWA contract is different in that it provides in its article regarding group insurance that the city's obligation to provide insurance coverage shall terminate on September 30, 1990 if no new contract is in effect. He said that the city's labor lawyers' opinion also applies in this case. MOTION by McCollum/Rondeau I move that if a successor contract, if we do not have one in place by October 1, that the city will implement the terms of the existing contract insofar as group insurance is concerned. MAYOR'S MATTERS 90.226 A. 15. Discussion - Ban Political Signs (Letter from N. McCollum dated 9/15/90) Following a brief discussion and suggestion by the Mayor that a political day be held in the city, motion was made as follows. MOTION by Oberbeck/Rondeau I move we direct the City Attorney to investigate the placement of signs on private property and banning them from city property or right-of-ways and investigate the possibility of banning signs on U.S. 1 and CR 512. Mayor Conyers said the public should be contacted for their input. Vice Mayor Oberbeck Vice Mayor Oberbeck expressed dismay at negative press coverage of City Council actions. B. Councilman McCollum Councilman McCollum reported on the Economic Development Council meeting, requested Council endorsement for Southern Bell to return to equipment manufacture and funding for harbor dredging in St. Lucie County with letters to federal representatives, requested that the city go on record as opposing a dredge and fill permit application for the Indian River north of the Wabasso Causeway and reported that he has been appointed a member of the Indian River County Land Acquisition Committee. it was decided to place those items that Councilman McCollum requested Council endorsement for on the October workshop agenda and copy backup to Council. 10 Regular City Council Meeting September 26, 1990 Page Eleven 90.227 C. Councilman Powell Councilman Powell said the state won't fund the St. Lucie dredging since a private citrus owner has made the request. D. Councilman Rondeau None. 16. CITY ATTORNEY MATTERS The City Attorney announced that he will be away next week and that Attorney Torpy will attend the workshop. He then responded to the Mayor's earlier comments. 17. Request to Extend Employment Contract (Cit~ Manager Recommendation dated 9/19/90, Employment Contract) MOTION by Oberbeck/Powell I move that any decision be delayed until such time as I can afford you information that might affect your decision on this matter. Following a brief discussion, request by the City Manager that any problems be discussed with him first and the addition of "prior to December" to the motion by Vice Mayor Oberbeck, roll call vote was taken. C~ny~ Mayor The September 10, 1990 special meeting minutes are corrected by the City Clerk as follows: Page 4, roll call on motion by McCollum/Rondeau "that this Council give up its salary and save the city some $13,000" is incorrect.
