GASS, COUNCILMAN FRANK OBERBECK, COUNCILMAN RICHARD VOTAPKA, COUNCILMAN GEORGE SCHUM, CITY ATTORNEY DANIEL KILBRIDE AND MAYOR PAT FLOOD, JR. THE CITY CLERK READ THE NOTICE OF PUBLIC HEARING AS IT APPEARED IN THE VERO BEACH PRESS JOURNAL, SEPTEMBER 19, AND 26, 1982, TO CONSIDER THE ADOPTION OF AN ORDINANCE AMENDING SECTION 2-94 OF THE CODE OF ORDINANCES BY INCREASING THE CODE ENFORCEMENT BOARD MEMBERSHIPS TO SEVEN; LIMITING REAPPOINTMENT TO ONE SUCCESSIVE TERM; AMENDING SECTION 2-109 OF THE CODE OF ORDINANCES BY REQUIRING VOTE OF FOUR MEMBERS TO CONSTITUTE OFFICIAL ACTION; AMENDING SECTION 2-104 OF THE CODE OF ORDINANCES BY REDUCING MAXIMUM DAILY FINE $25.00 PROVIDING AN EFFECTIVE DATE. OF THE CHARTER ~D TH~ HE WOULD CONTACT THE SECRETARY OF STATE ~D ROSEMARY RICHEY, SUPERVISOR OF HE ~LSO EXPLAINED TEAT SE H~ PREPARED ~ RESOLUTION ENABLZNa THE PETITION TO BE PLACED ON THE BALLOT ATTORNEY KILBRIDE READ IN ITS ENTIRETY A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA SUBMITTING TO THE ELECTORS OF SAID CITY A PROPOSED AMENDMENT TO SECTION 2.05 OF THE CHARTER OF THE CITY OF SEBASTIAN W~ICH INCREASES THE COMPENSATION FOR THE MAYOR; AND CONTROLS BUSINESS EXPENSES OF THE MAYOR AND COUNCIL. MOTION WITHDRAWN BY COUNCILMAN OBERBECK, SECONDED WITHDREW BY COUNCILMAN VOTAPKA. MOTION BY VICE MAYOR GASS, THAT WE ADOPT THE RESOLUTION, SUBJECZ'.~O CLARIFICATION OF THE SECRETARY OF STATE AND OUR ATTORNEY AS TO.~W IT SHOULD BE SHOWN ON THE BALLOT. MOTION DIED, LACK OF A SECOND. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, THAT WE APPROVE A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SUBMITTING TO THE ELECTORS OF SAID CITY A PROPOSED AMENDMENT TO SECTION 2.05 OF THE CHARTER OF THE CITY OF SEBASTIAN WHICH INCREASES THE COMPENSATION FOR THEMAYOR: AND CONTROLS BUSINESS EXPENSES OF THE MAYOR AND COUNCIL WITH THE UNDERSTANDING THAT THE QUESTION BE DIVIDED INTO FOUR INDIVIDUAL PARTS AND TO BE VOTED ON SEPARATELY IF IT,S LEGALLY POSSIBLE AND THAT OUR ATTORNEY CONFIRM THIS WITH THE SECRETARY OF STATE. IF IT IS NOT LEGALLY POSSIBLE, THEN THE QUESTION GOES ON IN TACT AND TO BE VOTED ON AS ONE ITEM ON THE BALLOT. ROLL CALL VOTE: AYES: COUNCILMAN OBERBECK COUNCILMAN VOTAPKA COUNCILMAN SCHUM MAYOR FLOOD NAYS: VICE MAYOR GASS MOTION CARRIED. SPECIAL COUNCIL MEETING - OCTOBER 6, 1982 ATTORNEY KILBRIDE STATED FOR A MATTER OF RECORD, THAT THE RESOLUTION WILL PLACE THE PETITION QUESTION ON THE BALLOT, CONCERNING THE CHARTER CHANGE AND THE ONLY QUESTION AT THE PRESENT TIME IS WHETHER ONE QUESTION WILL APPEAR ON THE BALLOT OR FOUR SEPARATE QUESTIONS. MAYOR.FLOOD STATED THAT ALL THE NECESSARY PAPER WORK IS COMPLETED TO CLOSE ON THE GREENE'S GAS PROPERTY AND THAT THE AGREEMENT IS THAT THE CITY WILL PAY $15,000.00 DOWN, THE SECOND YEAR $20,000.00 AND THE REMAINDER WILL BE PAID IN 1985. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN VOTAPKA, THAT WE GO AHEAD AND APPROVE THE PURCHASE CONTRACT OF THE GREENE'S GAS PROPERTY~o ROLL CALL VOTE: AYES: VICE MAYOR GASS COUNCILMAN OBERBECK COUNCILMAN VOTAPKA COUNCILMAN SCHUM MAYOR FLOOD NAYS: NONE MOTION CARRIED. COUNCILMAN SCHUM REQUESTED PERMISSION FROM THE COUNCIL TO TRAVEL TO VERO BEACH FOR THE ENTIRE TERM THAT HE WILL BE SERVING ON THE INDIAN RIVER COUNTY RECREATION COMMITTEE. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY VICE MAYOR GASS, THAT WE AUTHORIZE COUNCILMAN SCHUM TO GO TO THE INDIAN RIVER COUNTY RECREATION COMMITTEE MEETINGS, VERO BEACH, BASED ON THE REFERENDUM CHANGE TO COINCIDE WITH THE EXPENSES.
