MOTION BY COUNCILMAN JOACHIM, SECONDED BY COUNCILMAN GASS, TO ACCEPT THE MINUTES OF PUBLIC HEARING AND SPECIAL COUNCIL MEETING - AGREEMENT WITH GENERAL DEVELOPMENT CORPORATION 8/15/79; SPECIAL MEETING - BIDS FOR MUNICIPAL DOCK AT SOCIAL CENTER 8/15/79; REGULAR COUNCIL MEETING 9/10/79; PUBLIC HEARING 9/12/79; SPECIAL MEETINGS 9/13/79, 9/17/79; SPECIAL BUDGET MEETING 9/26/79; PUBLIC HEARING AND SPECIAL MEETING 10/3/79. CARRIED. MOTION BY COUNCILMAN JOACHIM, SECONDED BY VICE MAYOR GRAY, TO PAY SEPTEMBER BILLS AMOUNTING TO $11,739.54. CARRIED. MR. F. EUGENE CRAGG COMPLAINED ABOUT THE WATER STANDING ON HIS PROPERTY AS A RESULT OF THE LAST HEAVY RAINS. HE CONTINUED THAT THIS SITUATION HAS BEEN GOING ON FOR A YEAR, BUT IT IS NOW THE WORST IT HAS EVER BEEN. MAYOR FLOOD ASSURED MR. CRAGG THE SITUATION WOULD BE CHECKED INTO AND, HOPEFULLY, THE PRO- BLEM WILL BE CORRECTED BY REDOING THE SWALES. MR. PISANO PRESENTED A PETITION VOTING AGAINST A CITY MANAGER TYPE CITY GOVERNMENT, SIGNED BY 280 PERSONS. MR. DAVID ROGERS PRESENTED A PAPER WITH 20 SIGNATURES FROM FAMILIES LOCATED IN THE AREA AROUND DEL MONTE AND S.R. 512. THERE ARE 13 DUPLEXES IN THE AREA AND EACH TIME iT RAINS - AND IT DOES NOT HAVE TO BE A HEAVY RAIN - THE SEWAGE BACKS UP INTO THE BATHTUBS, TOILETS WON'T FLUSH, ETC., AND IT CREATES QUITE A HEALTH HAZARD. THE HEALTH DEPARTMENT PUMPED OUT THE SEPTIC TANKS IN THE AREA LESS THAN TWO MONTHS AGO, BUT NOW, WITH THE LAST HEAVY RAINS, IT IS BACKED UP AGAIN. ONE MAN SAID HE AND HIS LANDLORD TOGETHER HAD PAID $600. TO HAVE NEW DRAIN FIELDS LAID, BUT DURING THIS LAST RAIN, HIS TOILETS WOULD NOT FLUSH. MAYOR FLOOD SAID THE CITY WOULD DO WHA~COUJ-D~P~IATE THIS CONDITION BY RE-SWALING THE AREA. VICE MAYOR GRAY STATED THIS PRSBI,~IDIO NdI-T-EX.~T\U~I/L A SMALL LAKE WAS DUG BEHIND THE DUPLEXES. CLARENDON COMPLAINED ABOUT THE UN~4~O~D__ZTZO~ON P~ip..~ERTY LOCATED AT LAYPORT AND TAYLOR AVENUE. DURING HURRICANE DAVID, TREES WSRE KNOCKED DOWN FROM THE TOP AND ARE HANGING. IT IS NOT ONLY DIRTY, BUT DANGEROUS AS WELL. HE FELT THE CITY SHOUL~NOTIFY THE OWNER OF THS PROPERTY, MR. R. W. NOURSE, THAT HE IS IN VIOLATION OF A CITY ORDiNANCS~N~O~I;_~E REQUIRED TO CLEAN UP THE AREA BY REMOVING THE BROKEN TREES AND HAVING THE GRASS MOWED. ItF4YDR F~_OOD ADVISED MR. CLARENDON THAT THE CITY DID HAVE AN ORDINANCE ON THE BOOKS THAT IT IS UNLAWFUL T"3 PE_%~I~ WEEDS, GRASS, OR UNDERGROWTH TO GROW TO A HEIGHT OF TEN INCHES OR MORE, BUT THAT LAST SPRrNU GENERAL DEVELOPMENT CORPORATION HAD A SUIT IN PORT ST. LUCIE AND THE DISTRICT SUPREME COURT DE(~'~FE~ IP pNCONSTITUTIONAL. THAT DECISION HAS BEEN APPEALED AND WE ARE AWAITING THE OUTCOME BEF~RYI'NU TO ENFORCE OUR ORDINANCE. MR. CLEM, ACTING CITY ATTORNEY, SAID HE BELIEVED THE ORDINANCE WAS UPHELD BY THE COURT BUT HE WOULD CHECK FURTHER. LAND WHICH CIT WD RO C VILO N PU OSES. COUNCILMAN GASS REP~,~I~ONE R~QUEST~A~~E~SEPff~ER~RI~ISIkR~ET_.Li~T. FLORIDA POWER AND LIGHT COMPANY WAS ASKED TO RELOCATE FIVE LIGHTS TO INTERSECTIONS WHERE THEY WILL BETTER SERVE THE PUBLIC. UNFORTUNATELY, HOWEVER, THIS WORK WILL NOT BE DONE SOON AS FLORIDA POWER AND LIGHT IS AT LEAST SIX MONTHS BEHIND IN iTS WORK SCHEDULE. HE FURTHER STATED IT MAY BE NECESSARY TO SET UP AN APPOINTMENT WITH THE PRESIDENT IN MIAMI TO SEE WHAT CAN BE DONE. COUNCILMAN JOACHIM REPORTED THE NIGHT CALL CONVERTER IN THE POLICE DEPARTMENT WENT OUT AS A RESULT OF HURRICANE DAVID AND THE AUXILIARY POLICE HAVE TAKEN OVER DURING THE INTERIM. THE NEW CONVERTER IS EXPECTED SOMETIME THIS WEEK. THE DEPUTY CLERK READ THE MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING OF SEPTEMBER 13, 1979. IN THE ABSENCE OF A REPRESENTATIVE OF THE AIRPORT ADVISORY BOARD, MAYOR FLOOD REPORTED SEVERAL LEASES ARE BEING DISCUSSED. A REPRESENTATIVE OF THE BOARD WILL REPORT ON ITS CURRENT ACTIVITIES AT THE NEXT REGULAR COUNCIL MEETING. THE BUILDING OFFICIAL REPORTED 16 SINGLE FAMILY RESIDENCES VALUED AT $500,000. WERE BUILT DURING SEPTEMBER. THE TOTAL FOR THE MONTH, INCLUDING COMMERCIAL STORES ON NORTH CENTRAL AVENUE, AMOUNTED TO $687,142. TOTAL FEES FOR PERMITS DURING THE MONTH AMOUNTED TO $4,269.30. DURING THE FISCAL YEAR 1978-79, 231 SINGLE FAMILY RESIDENCES WERE ERECTED IN SEBASTIAN. TOTAL VALUE OF CONSTRUCTION FOR THE YEAR AMOUNTED TO NINE AND ONE HALF MILLION DOLLARS. $52,000. WAS COLLECTED IN FEES FOR THE YEAR. THE POLICE DEPARTMENT REPORTED 352 COMPLAINTS ANSWERED DURING SEPTEMBER, NOT INCLUDING TRAFFIC STOPS. DURING THE NIGHT OF HURRICANE DAVID, APPROXIMATELY 185 CALLS WERE ANSWERED BY THE POLICE DEPARTMENT. CHIEF CUMMINS WAS PLEASED TO ANNOUNCE THAT ONE OF THE AUXILIARY POLICE MEMBERS IS NOW ATTENDING THE POLICE ACADEMY. THE STREET DEPARTMENT SUPERINTENDENT REPORTED SEPTEMBER WAS ONE OF THE BUSIER MONTHS, 1314 WORKING HOURS, 902 OF WHICH WERE SPENT CLEANING UP THE CITY AFTER THE HURRICANE. HE FELT HIS MEN HAD DONE AN OUTSTANDING JOB. THE INDIAN RIVER CORRECTION INSTITUTION CONTRIBUTED358 MAN HOURS ON THIS PROJECT AND A LETTER OF APPRECIATION HAS BEEN FORWARDED TO THE INSTITUTION. REGULAR COUNCILMEETING, OCTOBER 8, 1979 (PAGE 2) DURING THE CLEAN UP OF THE CITY, THE ARMY TRUCK BROKE DOWN. THE ESTIMATED COST TO PUT IT IN SERVICE IS $1200.-$1500. MR. WEHR EXPLAINED THE BRAKES WENT OUT AND THE HOIST WENT BAD. WHEN THE LOAD WAS UP AND THE BRAKES LET GO, THE TRUCK COULDN'T BE STOPPED AND THE BED TWISTED. WITH THE HOIST UP, THE CYLINDER WAS TWISTED. VICE MAYOR GRAY INDICATED HE HAD SEEN THE TRUCK BEING DRIVEN AT EXCESSIVE SPEEDS AND REQUESTED AN INVESTIGATION BE MADE TO DETERMINE WHO WAS DRIVING THE VEHICLE WHEN THE DAMAGE OCCURRED. COUNCILMAN GASS SUGGESTED HAVING THE TRUCK REPAIRED, MAKE THE INVESTIGATION AND TRY TO PREVENT IT HAPPENING AGAIN. MOTION BY COUNCILMAN GASS, SECONDED BY COUNCILWOMAN McKINLEY, TO HAVE THE TRUCK REPAIRED AND AT THE SAME TIME iNVESTIGATE THE CAUSE OF THE DAMAGE AND WHO WAS RESPONSIBLE FOR IT. CARRIED. MAYOR FLOOD STATED THIS WILL BE ON THE BALLOT AT THE MARCH ELECTION FOR CHANGE OF CHARTER. MAYOR FLOOD REQUESTED PERMISSION OF THE COUNCIL TO ADVERTISE FOR A BOOKKEEPER. THE PRESENT INCUMBENT WILL BE MOVED TO A CLERK-TYPIST POSITION. HE ALSO ASKED THAT THE BOOKKEEPER'S POSITION BE TAKEN OUT OF THE CITY CLERK'S OFFICE AND PLACED DIRECTLY UNDER THE MAYOR AND THAT THE BOOKKEEPER BE DESIGNATED AS THE CITY TREASURER. THE CHARTER AUTHORIZES THE CiTY COUNCIL OR THE CITY CLERK TO ACT AS CITY TREASURER, OR THE COUNCIL CAN APPOINT A CITY TREASURER AT ITS OWN DISCRETION. MAYOR FLOOD FEELS THE BOOKKEEPER SHOULD ALSO BE THE CITY TREASURER. VICE MAYOR GRAY SUGGESTED HIRING A NEW BOOKKEEPER AND IF THE PERSON PERFORMS WELL, HE OR SHE CAN THEN BE APPOINTED CITY TREASURER BY ACTION OF THE COUNCIL. AT THE LAST WORKSHOP MEETING MAYOR FLOOD SAID HE HAD TURNED IN A PRE-APPLICATION FOR A 75% GRANT TO FARMERS HOME FOR THE WATER AND SEWER SYSTEM. IT IS ESTIMATED THE PROJECT WILL RUN ABOUT FORTY MILLION DOLLARS. MR. ROBERT LLOYD DID AN EXCELLENT JOB IN GETTING THE PAPER WORK TOGETHER FOR THIS REQUEST. CLEM MADE A FEW SUGGESTIONS, PARTICULARLY ITEM 7B, PAGE 5, WHICH STATES "ALL TREES THAT ARE REMOVED OR DESTROYED SHOULD BE REPLACED BY A SPECIES AND SIZE OF TREE AS REQUIRED BY THE CITY COUNCIL OR ITS DESIGNEE AND FILEDIN THE OFFICE OF THE CITY CLERK." MAYOR FLOOD HAS DISCUSSED THIS SUBJECT WITH MR. WAYNE ALLEN OF GENERAL DEVELOPMENT CORPORATION WHO, IN TURN, PASSED IT ON TO MR. SMITH, GDC UTILITIES, WHO IS TAKING IT UNDER ADVISEMENT. MAYOR FLOOD ALSO DISCUSSED WITH GDC THE FIRE PLUG SITUATION AND THEY HAVE INDICATED SOMETHING WILL BE DONE IN THE NEXT 30 DAYS. WHEN ASKED HIS OPINION OF THE SITUATION, MR, CLEM SAID IF THERE IS A HEALTH OR FIRE HAZARD - OR BOTH - AS A RESULT OF THE WATER FAILURE, IT WAS HIS OPINION THAT UNDER THE CITY'S POLICE POWER THE CITY HAS THE RIGHT TO STEP IN. MAYOR FLOOD ASKED THE BUILDING OFFICIAL TO CHECK INTO GDC'S PUMPING SYSTEM AND REPORT BACK TO HIM. THE PILINGS FOR THE SOCIAL CENTER DOCK HAVE BEEN RECEIVED AND MAYOR FLOOD ASKED THE COUNCIL'S PERMISSION TO ADVERTISE FOR BIDS FOR iNSTALLATION OF THE PILINGS. MOTION BY COUNCILMAN JOACHIM, SECONDED BY VICE MAYOR GRAY, TO ADVERTISE FOR BID FOR THE INSTALLATION OF THE PILINGS AT THE SOCIAL CENTER DOCK. CARRIED. MR. JOHN VAN ANTWERP, SEBASTIAN MUNICIPAL AIRPORT MANAGER, DISCUSSED PROPOSAL FOR PUTTING IN A FULL GOLF COURSE AT THE SEBASTIAN AIRPORT. HE REFERRED TO AN AREA OF THE AIRPORT AS A POSSIBLE SITE, COMMENTING THAT IT WAS THE LEAST DEVELOPED AND LEAST VALUABLE TO DEVELOP. THERE ARE STRINGS ATTACHED TO THE USE OF AIRPORTPROPERTY BECAUSE IT WAS A LAND GRANT TO THE CITY FOR THE PURPOSE OF AN AIRPORT AND IT MUST BE MAINTAINED AS AN AIRPORT. HE FELT REASONABLY CERTAIN THE CITY COULD OBTAIN FAA APPROVAL FOR THE LAND USE. HE REQUESTED THE CITY AUTHORIZE $400. FOR AN INITIAL SURVEY T~DETERMINE IF THE SOIL, DRAINAGE, ETC. WERE SATISFAETORY~OR'.ACGQLFi~OUR.SE. MOTION BY COUNCILMAN JOACHIM, SECONDED BY VICE MAYOR GRAY, TO APPROVE THE EXPENDITURE OF $400. FOR A SURVEY TO DETERMINE IF THE LAND AT THE AIRPORT IS SUITABLE FOR A GOLF COURSE. CARRIED. MAYOR FLOOD ASKED FOR APPROVAL TO GO OUT TO BID FOR A BUILDING BEHIND CITY HALL. CARRIED.
