ANNOUNCEMENTS/PROCLAMATIONS: THE DEPUTY CITY CLERK READ A PROCLAMATION, PROCLAIMING THE WEEK OF NOVEMBER 7TH AS "FESTIVAL OF THE ARTS WEEK" MAYOR FLOOD INTRODUCED AND WELCOMED MR. COUNCILMAN GALLAGHER MADE THE COMMITTEE WAS HELD ON SEPTEMBER A HOLLO~EEN SLOW PITCH SOFTBALL_TOURNAMENT__WILL BE H~D_...AT THE BARBER STREET ANY AD~I~OA'AL I VOLUN~EE~ II~E~.P ~D mE APPRECiAblES. ~ NORTH~TY ~I~_E~;~R~) AND THE SEI~I~N R~CREATION COMMITTEE HAVE AGREED ~ ES-T-A-B'Li~S-B'-CLOb-E CITMMUD--ICATIO-N II~--AN---EF~O~RT'--TO--BETTER SERVE THE PUBLIC. MR. HOWEARD CARSWELL WILL SERVE AS THE SEBASTIAN PARKS AND RECREATION COMMITTEE LIASION TO THE NORTH COUNTY RECREATION COMMITTEE. EMPLOYEES OF THE PARKS AND RECREATION DEPARTMENT WILL BE PAINTING THE SEBASTIAN COMMUNITY CENTER IN THE NEAR FUTURE. RESERVATIONS FOR ADVERTISING SPACE ALONG THE BARBER STREET BALL FIELD ARE NOW BEING RECORDED AND INTERESTED PARTIES ARE ASKED TO CONTACT CITY HALL FOR FURTHER DETAILS. COUNCILMAN GALLAGHER REQUESTED THAT THE CITY CLERK READ INTO THE RECORD A LETTER HE SUBMITTED TO THE CITY COUNCIL, STATING THE IMPORTANCE OF THE PARKS AND RECREATION COMMITTEE AND THE NEED OF PLACING IMPORTANT ITEMS ON THE AGENDA AT A WORKSHOP MEETING. MAYOR FLOOD MENTIONED THAT IT TAKES A FULL VOTE OF THE COUNCIL TO EXTEND A MEETING PASSED 10:30 P.M. AND POINTED OUT THAT THESE ITEMS WILL BE BROUGHT UP AT THE END OF THE MEETING PROVIDING THERE IS SUFFICIENT TIME OR A MOTION TO EXTEND THE MEETING TO BRING THESE ITEMS TO THE FLOOR FOR DISCUSSION AND POSSIBLE ACTION. DAN BLAIR, BUILDING OFFICIAL, REPORTED THAT HE ATTENDED A SOLAR INSPECTION CLASS AT THE FLORIDA SOLAR ENERGY CENTER, CAPE CANAVERAL, FLORIDA. ~HE EXPLAINED THAT THE BASIC SOLAR CONCEPTS AND ALL ASPECTS OF A SOLAR WATER HEATER WERE DISCUSSED. HE ALSO MENTIONED THAT SPECIAL PERMITTING AND LEGAL ASPECTS HAVE BEEN DRAWN UP BY THE STATE OF FLORIDA TO BE USED AS GUIDELINES. COUNCILMAN SZELUGA REPORTED THAT THE GATE AT THE SEBASTIAN CEMETERY WHICH WAS DESTROYED HAS BEEN REPLACED AND LOOKS LIKE NEW. OLD BUSINESS: ATTORNEY KILBRIDE STATED THAT HE AMENDED THE HOME OCCUPATION DEFINITION, AS IT APPEARS IN THE GLOSSARY OF TERMS IN THE ZONING ORDINANCE. HE EXPLAINED THAT THIS SEPARATE AMENDMENT TO THE ZONING ORDINANCE WOULD HELP TO CLARIFY THE DEFINITION OF A HOME OCCUPATION. HE RECOMMENDED THAT THIS PROPOSED AMENDED ORDINANCE BE PROCESSED SEPARATELY SINCE IT IS IN A SEPARATE SECTION OF THE ZONING ORDINANCE. HE ALSO MENTIONED THAT THIS ORDINANCE COULD NOT BE PUT INTO EFFECT UNTIL THE FIRST HOME OCCUPATION ORDINANCE AMENDMENT IS ADOPTED. A $50.00 APPLICATION FEE IS CHARGED FOR A CERTIFICATE OF NEEDS AND CONVENIENCE LICENSE AFTER A PUBLIC HEARING IS HELD AND ALL FACTORS ARE TAKEN INTO CONSIDERATION. AFTER A BRIEF DISCUSSION, MR. JACK WEBB,INDIAN RIVER MOTORS, MENTIONED THAT IT IS HIS INTENTION TO OPERATE BETWEEN THE HOURS OF 6:00 A.M. AND 10:00 P.M. FOR LOCAL PEOPLE AND WILL MAKE SPECIAL ARRANGEMENTS FOR THOSE NEEDING THE SERVICE EITHER EARLIER OR LATER. MAYOR FLOOD STATED THAT THE PUBLIC HEARING WOULD BE HELD ON NOVEMBER 9, 1983, PRIOR TO THE REGULARLY SCHEDULED COUNCIL MEETING. MR. MULLER, DEVELOPER, RIVER RUN CONDOMINIUM PROJECT, REQUESTED PRELIMINARY APPROVAL AND THE SUPPORT OF THE SEBASTIAN CITY COUNCIL TO PROCEED WITH GENERAL DEVELOPMENT UTILITY, CONCERNING A WATER EXTENSION AGREEMENT FOR THE RIVER RUN CONDOMINIUM PROJECT. MOTION BY COUNCILMAN GALLAGHER , SECONDED BY COUNCILWOMAN MCKINLEY, THAT THE CITY COUNCIL VOICE THEIR SUPPORT THROUGH A VOTE FOR THE PANTHERS FOOTBALL AND ATTEMPTS OF THE PARKS AND RECREATION DEPARTMENT OF THE CITY TO FORM A COOPERATION BETWEEN THE CITY AND THE PANTHERS FOOTBALL IN AN EFFORT TO BETTER SERVE THE COMMUNITY. MOTION CARRIED. THE NORTH COUNTY PARKS AND RECREATION COMMITTEE HAS REQUESTED PERMISSION TO USE THE SECOND FLOOR IN CITY HALL TO STORE ATHLETIC EQUIPMENT, MOTION BY COUNCILMAN GALLAGHER, SECONDED BY COUNCILWOMAN MCKINLEY, TO ALLOW NORTH COUNTY TO USE THE SECOND FLOOR OF CITY HALL, TO STORE ATHLETIC EQUIPMENT. MOTION CARRIED. A TRAMPOLINE IN THE SEBAST'IAN~_~OMMUNIT_Y C~NVE~ AND THAT IT BE USED FOR SOME OF HER CLASSES. A BRIEF DISCUSSION FOLLOWE~ ~E~ARDING THE ~S~ OF THE TRAMPOLINE AND IT WAS THE GENERAL CONCENSUS OF THE CI~jf.W'CO~CI~--~-HAT ~r-~E LIABILITY RISK WOULD BE EXTREMELY HIGH AND THAT THE BUILDING IS NOT MADE FOR THE USE OF THAT PARTICULAR PIECE OF GYM EQUIPMENT. AS FAR AS STORIN~HE~MPOLINE, MAYOR FLOOD FELT THERE WOULD NOT BE A PROBLEM SINCE IT IS CO~.PSI~ MOTION BY COUNCILMAN GALLAGHER, ~ECONDE~BY COUNCILWOMAN MCKINLEY, THAT PERMISSION BE GRANTED TO NORTH COUNTY RECREATION ~0 STORE THE TRAMPOLINE AT THE COMMUNITY CENTER PROVIDING THAT IT CAUSES~N~ ~N~NVENIENCE TO THE EXISTING PROGRAMS BEING HELD THERE AND ALSO THAT PERMISS~N BE GRANTED TO ALLOW THE TRAMPOLINE TO BE USED OUTSIDE ONLY. MOTION BY COUNCILMAN GALLAGHER , SECONDED BY COUNCILWOMAN MCKINLEY, TO SEND THE TWO ESTIMATES RECEIVED FOR THE YACHT CLUB RAILINGS TO THE AWARDS COMMITTEE FOR THEIR REVIEW AND RECOMMENDATION. MOTION CARRIED. COUNCILMAN GALLAGHER REQUESTED THAT RENT RATES. BETWEEN $75.00 AND $125.00 PER YEAR BE SET FOR ADVERTISING SIGNS AT THE BARBER STREET BALL FIELD. MOTION BY COUNCILMAN GALLAGHER, SECONDED BY COUNCILWOMAN MCKINLEY, TO SET THE FIGURES REQUESTING RENT RANGE AND DESIGN FEE RANGE FOR THE BALL FIELD ADVERTISING TO THE CITY ATTORNEY TO WORK UP A RESOLUTION. MOTION CARRIED. MOTION BY COUNCILMAN GALLAGHER, SECONDED BY COUNCILWOMAN MCKINLEY, TO BRING TO THE FLOOR FOR DISCUSSION AND POSSIBLE ACTION, THE RESOLUTION CONCERNING THE LAND USE CHANGE ON S.R. 512 AND 1-95. MOTION CARRIED. MOTION BY COUNCILMAN SZELUGA, SECONDED BY COUNCILMAN GALLAGHER, THAT THE MAYOR SIGN A RESOLUTION PREPARED BY THE ATTORNEY TO ENDORSE THE CHANGE IN THE LAND USE PLAN FOR THE PROPERTY ON 1-95/S.R. 512 FOR THE PROPOSED ELECTRONIC FIRM. FOR CLARIFICATION, ATTORNEY KILBRIDE STATED THAT HE WILL INCLUDE THE NAME OF HELENE HOLDING COMPANY IN THE RESOLUTION AS THE ELECTRONIC FIRM. MOTION CARRIED. MINUTES: REGULAR COUNCIL MEETING OCTOBER 10, 1983 MAYOR FLOOD WELCOMED MR. NAPPI AND STATED THAT HE DID NOT VOTE AGAINST MR. NAPPI PERSONALLY OR HIS ABILITY AND WILL SUPPORT HIM. VICE MAYOR FITZMAURICE STATED FOR THE RECORD THAT HIS VOTE IS NOT AGAINST MR. NAPPI PERSONALLY AND NOT DETRIMENTAL, IT'S JUST A MATTER OF PRINCIPAL. MOTION BY COUNCILMAN GALLAGHER, SECONDED BY COUNCILWOMAN MCKINLEY, THAT THE CITY COUNCIL INDICATE BY THEIR VOTE THAT THEY HAVE THE UTMOST CONFIDENCE IN MR. GERALD NAPPI, AS THEIR POLICE CHIEF, CITY OF SEBASTIAN. ROLL CALL VOTE: A YES: VICE MAYOR FITZMAURICE COUNCILMAN SZELUGA COUNCILWOMAN MCKINLEY COUNCILMAN GALLAGHER MAYOR FLOOD NAYS: NONE MOTION CARRIED. A DISCUSSION FOLLOWED REGARDING THE SALARY TO BE PAID TO MR. NAPPI AND WHETHER OR NOT HE SHOULD BE PUT ON A PROBATIONARY PERIOD AND FOR WHAT TIME LIMIT. MAYOR FLOOD INDICATED THAT POLICE DEPARTMENT STANDARD OPERATING PROCEDURES REQUIRES A SIX (6) MONTH PROBATIONARY PERIOD FOR POLICE PERSONNEL. MOTION BY COUNCILMAN GALLAGHER, SECONDED BY COUNCILWOMAN MCKINLEY, THAT MR. COUNCILMAN GALLAGHER WAS OF THE OPINION THAT THE CITY NOT ADVERTISE FOR THE POSITION OF POLICE CHIEF SINCE, WE HAVE A PERSON WHO IS QUALIFIED TO DO THE JOB. HE ALSO REQUESTED THAT THE LETTERS OF RECOMMENDATION RECEIVED SUPPORTING MR. NAPPI BE READ INTO THE RECORD. THE DEPUTY CITY CLERK READA LETTER OF RECOMMENDATION FROM THE EMPLOYEES OF THE SEBASTIAN POLICE DEPARTMENT, RECOMMENDING THAT MR. GERALD NAPPI, BE APPOINTED AS POLICE CHIEF. AFTER REVIEWING MR.
