CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA ALL PROPOSED ORDINANCES AND INFORMATION ON ITEMS LISTED BELOW MAY BE INSPECTED IN THE OFFICE OF THE CITY CLERK, CITY HALL, 1225 MAIN STREET, SEBASTIAN, FLORIDA. Mayor Votapka called the meeting to order at 7:00 p.m. Eunice Mercier, of the City Clerk's office led the Pledge of Allegiance. 3. ROLL CALL: Present: Councilman Lloyd Rondeau Councilman Frank Oberbeck Councilman Robert McCollum Mayor Richard Votapka Absent Excused Vice Mayor Robert McCarthy Also Present: City Manager, Robert McClary City Attorney, Charles Nash Director of Community Development, Bruce Cooper Clerk, Eunice Mercier City Clerk, Kathryn O'Halloran 4. AGENDA MODIFICATIONS (ADDITIONS AND/OR DELETIONS) None 5. ANNOUNCEMENTS None 1 Workshop Meeting Minutes November 1, 1989 Page Two 6. PUBLIC INPUT A. Non-Agenda Items None B. Agenda Items None 7. WORKSHOP ITEMS 88.080 A. Agenda Time and Date Change (City Clerk Recommendation dated 10/20/89, Memo from City Clerk dated 10/19/89, Res. No. R-89-59; Res. No. R-88-31) The City Clerk and City Manager stated their cases both pro and con relative to the change on the time and day of the agenda closing. The Council members agreed with the City Manager's recommendation that workshops should be eliminated and there be two regular meetings each month. Should a specific item need to be discussed a workshop meeting can be scheduled. The City Clerk suggested that the closing time be moved to Thursday at Noon. MOTION by Councilman Rondeau/McCollum to eliminate monthly workshops and move the agenda closing time to 12 noon on Thursday and have the staff prepare a resolution to that effect. VOICE VOTE on the MOTION CARRIED 4 - O. Workshop City Council Minutes November 1, 1989 Page Three 89.084 B. Rezoning & Land Use Amendment 116.55 Acres (Dir.of Community Development Recommendation dated 10/12/89, Memo from P & Z dated 9/29/89, Memo from Technical Review Com. dated 9/15/89, Survey Sketch 2524-B from James A. Fowler dated May 4, 1989.) The Director of Community Development noted that this land lies West of the railroad, North of Vickers Road, East of Lance Road and South of Concord Avenue. He noted a mad with zoning designations that would coincide with this request will be forthcoming, after review by Planning and Zoning. He answered all questions by Council and noted that Department of Community Affairs would have to give their approval also. MOTION by Councilman Oberbeck/McCollum to direct the City Attorney to draft the proper ordinances for both the Land Use and Zoning amendment as required by the applicant. VOICE VOTE on the MOTION carried 4 - 0. 89.197 C. Rezoning & Land Use Amendments (1.85 acres)- (Director of Community Dev. Recommendation dated 10/4/89, Memo from P & Z dated 10/5/89, Memo from Tech. Review Com. dated 8/31/89, Survey Sketch from James A. Fowler as of 12/22/87.) The Director of Community Affairs stated that this property is in front of the Fisher Trade Center on U.S. #1 and has a COR designation. This item being less than 3 acres does not require DCA approval. MOTION by Oberbeck/McCollum to direct the City Attorney to draft the proper ordinance for both the Land Use and Zoning amendment as requested by the applicant. VOICE VOTE on the MOTION carried 4 - O. 3 Workshop City Council Minutes November 1, 1989 Page Four 88.119 D. Discuss Proposed Resolution R-89-49 - City Board Application Policy (City Clerk Recommendation 10/23/89, Letter from City Clerk dated 10/16/89, ProDosed Amendment to Res. R-89-13.) This item was discussed at great length with no definitive decision. The City Clerk volunteered to revisit this sub3ect and research all Boards, members and requirements and report back to Council at a later date. Councilman Oberbeck requested that all board members be residents of the City of Sebastian. The Community Development Director noted that the Construction Board states a person may be a residents or have a business within the City. 89.199 E. Home Occupational Licenses (P & Z Recommendation dated 10/26/89) It was the consensus of the Council that there was not enough back-up presented with this item and a lengthy discussion followed. The Mayor recognized Jim Wordsworth, Vice Chairman of the Planning and Zoning Board who elaborated on the P&Z discussion that prompted this request. The City Attorney recommended that the Director of Community Development obtain a copy of the ordinance that governs occupational licenses in the City of Palm Bay. MAYOR'S MATTERS Mayor Votapka reported on the reply from Sebastopol, California and displayed a brochure from that City. 4 Workshop City Council Minutes November 1, 1989 Page Five The Mayor spoke and/or questioned the following items: a reply to Jonathan Potter, Esq., from Dobson, Bjerning and Dully, City Auditors; Jo Ann Townsend and her starting date as Assistant Manager; an opinion from the A.G.O. re: reimbursement of litigation for reasonable attorney fees for a Council Member; a memo from the Treasure Coast Regional Planning Council regarding the City of Sebastian's Comprehensive Plan. If in the event former Councilmen request reimbursement pertaining to litigation while in office, the Mayor directed the City Manager to get in touch with the City Attorney. 9. COUNCIL MATTERS Vice Mayor McCarthy Absent Councilman McCollum Brief report on Annexation Committee Councilman Oberbeck Noted that he would check with Finance Department on questions he has. Councilman Rondeau Questioned Airport Noise Complaint Line in the office of the City Clerk. He also questioned the status of the Cavcorp property and the status of the Police Station.
