Mayor Votapka called the meeting to order at 7:05 p.m. The Deputy City Clerk led the Pledge of Allegiance. Invocation was given by Father Joseph LeSage, St. Sebastian Catholic Church. 4. ROLL CALL: Councilman McCollum - aye Councilman Oberbeck - aye Councilman Rondeau - aye Mayor Votapka - aye Vice Mayor McCarthy - aye MOTION CARRIED 5-0. 2 Regular City Council Meeting November 22, 1989 Page Three Discussion took place on 11/8/89 minutes, page 6, Councilman Oberbeck's matters regarding possible golf course restaurant lease and whether Council instructed staff to investigate the cost of putting the'restaurant back into condition for lease. Council and the City Manager concurred that this was the intent but the minutes were not amended. The City Manager said a report would be prepared. MOTION by Rondeau/Oberbeck I move we approve the 11/8/89 minutes. VOICE VOTE on the motion carried 5-0. 7. PROCLAMATIONS AND/OR ANNOUNCEMENTS Mayor Votapka announced the Friends of the Sebastian River and Marine Resources Council request for show of support on November 24, 1989 at 10:00 a.m. for federal funding for the Indian River Lagoon by standing on local causeways. 8. PUBLIC HEARING(S), FINAL ACTION 89.107 ORDINANCE NO. Mayor Votapka opened the public hearing at 7:19 a.m. 3 Regular City Council Meeting November 22, 1989 Page Four The City Planner explained that this ordinance will allow manufactured homes in mobile home districts. C.N. Keary expressed concern for the increase in required square footage. Mayor Votapka closed the public hearing at 7:21 p.m. MOTION by McCollum/Oberbeck I move we adopt Ordinance No. O-89-18 as read by the City Attorney. ORDINANCE NO. 0-89-20 - Animals & Livestock AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING CHAPTER 5, OF THE CODE OF ORDINANCES OF THE CITY OF SEBASTIAN; BY INCLUDING A PROVISION PROHIBITING LIVESTOCK, FOWL AND NONDOMESTiCATED ANIMALS; PROVIDING DEFINITIONS AND PENALTY; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR INCLUSION iN THE CODE OF ORDINANCES OF THE CITY OF SEBASTIAN; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mayor Votapka opened the public hearing at 7:20 p.m. The City Planner and City Attorney explained that this ordinance will fill in the glitch regarding enforcement of livestock created when the county animal ordinance was adopted by the city. Mayor Votapka called recess at 7:26 p.m. and reconvened the meeting at 7:30 p.m. Ail members were present at recall. Discussion took place on the proposed annexation of property west of the city limit. Attorney Nash explained that if the annexation went through the 4 Regular City Council Meeting November 22, 1989 Page Five city would have to provide for agricultural zoning and rewrite this ordinance at that time. Mayor Votapka closed the public hearing at 7:35 p.m. MOTION by Oberbeck/McCollum I move we adopt Ordinance No. 0-89-20 as read by the City Attorney. Non-Agenda Items 89.157 George Metcalf_- Request for Reimbursement (City Manager Recommendation dated 11/16/89, Request for Filing Agenda Item, Letter to Mr. Metcalf from City Manager dated 11/2/89) George Metcalf, 425 Pine Street, Sebastian, said he will pursue his claim for reimbursement. The City Manager said he was waiting for a response from Mr. Metcalf as to whether there is additional backup to present to Council. In answer to Mayor Votapka, Mr. Metcalf said he will respond to the City Manager's letter and submit additional paperwork. B. Agenda Items George Reid, 202 DelMonte Road, Sebastian, supported extending the City Manager's contract. Mayor Votapka closed public input at 7:43 p.m. 10. PRESENTATIONS None. 11. COMMITTEE REPORTS/RECOMMENDATIONS None. Regular City Council Meeting November 22, 1989 Page Six 12. OLD BUSINESS 89.093 A. Street Improvement Priorities (Action Deferred from 11/8/89) (City Manager Recommendation dated 11/15/89, Memo from D. Fisher dated 11/2/89) The City Manager noted two additions to the program presented at this meeting (see attached) as follows: 1) overlay of 2500 lineal feet of Main Street from Fig to the realigned portion at a cost of $17,00 and 2) 800 feet by 6 feet of additional bicycle path east from Easy Street to Lime Street at a cost of $3000. He said a budget amendment will be required but that county option gas tax funds should cover the entire pro3ect. MOTION by McCollum/McCarthy I move we approve the street improvement priorities as presented with two additions as presented by the City Manager with additional costs of 817,000 for Main Street overlay and $3000 for bicycle path on Lime Street. ROLL CALL: Mayor Votapka - aye Vice Mayor McCarthy - aye Councilman McCollum - aye Councilman Oberbeck - aye Councilman Rondeau - aye MOTION CARRIED 5-0. 89.196 Park Improvements (City Manager Recommendation dated 11/15/89, Memo/attachment from D. Fisher dated 10/18/89) The City Engineer said Parks and Recreation had endorsed park improvements as presented (see attached) with the exception of the placement of an irrigation system at Riverview Park, which he said he concurred with. MOTION by McCarthy/McCollum I move we approve park improvements as presented with the deletion of the irrigation system at Riverview Park. City Engineer Report on Bids and Proposals The City Engineer gave reports on 1) bids received to construct toilet facilities at Riverview Park; 2) bids received to construct a records storage vault; 3) bids received to provide for sports lighting poles and fixtures at Barber Street Sports Complex; 4) proposals received to perform site survey for new police station; and 5) proposals to provide survey and design services for the realignment of Main Street (see recommendation attached). The City Engineer stated that in the future firms will not be allowed to bid on design and then bid again on construction for the same pro3ect. Mayor Votapka requested that the proposals for the site survey for the new police station be brought to Council for review since two of the proposals were within one dollar of each other. MOTION by Oberbeck/McCarthy I move we bring to Council for review the proposals for site survey for the new police station. VOICE VOTE on the motion carried 5-0. Attorney Nash was excused at 8:45 p.m. 89.209 City Hall Renovations (City Manager Recommendation dated 11/14/89, Memo from City Manager dated 11/15/89) (See Proposed Floor Plan attached outside of packet) Discussion took place on temporary placement of the Veteran's Service in City Hall and future assistance with its relocation. The City Manager stated that Job Service has not requested space. MOTION by Rondeau/McCarthy I move we approve the City Manager's recommendation to complete the construction plans for renovations on the City Hall north annex and bid the project. VOICE VOTE on the motion carried 5-0. 89.003 Airport Consultant Selection (City Manager Recommendation dated 11/15/89, Memo from Peter Jones dated 11/15/89, Letter re Study from Williams, Hatfield, ~ Stoner, Inc. dated 9/21/89) The City Manager said if Council approves the Selection Committee recommendation contract negotiations will begin with Williams, Hatfield & Stoner. 10 Regular City Council Meeting November 22, 1989 Page Eleven MOTION by Oberbeck/McCollum I move we concur with the. recommendation of the Selection Committee for the Airport Planning Study in ranking the three top consultants. COUNCIL MATTERS A. Vice Mayor McCarthy None. B. Councilman McCollum None. C. Councilman Oberbeck The City Manager said action on the Writ of Mandamus had been deferred to Monday, November 27, 1989. This should not be done until the Main Street realignment is o0mplete. This portion of Main Street is approximately 2500 LF long x 18 feet wide and is estimated to cost an additional $17,000 to o~nplete. 2) Extend the bike path syst~n from the newly proposed bike path on Easy Street eastward down the three short blocks of Lime Street (south side) to the crossover to the Sebastian El~nentary School. This portion of the bike path is approximately 800 LF long x 6 feet wide and is estimated to cost an additional $3000 to complete. At the October 25, 1989 meeting, the City Council approved the City Engineer's recommendation to construct rest room facilities at Riverview Park. At that same meeting, the City Council deferred other recommendations so that they may be reviewed by the Parks & Recreation Committee. The Parks & Recreation Committee is expected to meet on November 15, 1989 to review the list of priorities. The staff will present P & R Committee comments verbally at the November 22, 1989 meeting. APPROVAL BY PARKS & RECREATION CC~v~IITYEE AT THEIR MEETING OF 1 5 NOV 89 This is to conf~rm to you that the Parks and Recreation Committee approved the attached list of recu,,,,ended park improv~T~nts during their meeting of Wednesday evening, 15 November 89, with one exception. They did not approve the line item to provide an irrigation system for Riverview Park (estimated cost: $2500). I recomnend you request City C2ouncil approval of the Parks and Recreation Cu,,,ittee's position. The irrigation system is not a critical item at this time. Due to the abundance of shade trees there, an irrigation system would probably not make a big difference in increasing the amount of ground cover.
