Mayor Harris called the meeting to order at 7:00 P.M. 2. Councilman Metcalf led the Pledge of Allegiance. Invocation was given by Dr. Stan Sanford, First Baptist Church of Wabasso. 4. ROLL CALL: Present: Councilman Robert McCarthy Councilman George Metcalf Councilman Peter Vallone Mayor L. Gene Harris Attorney Thomas C. Palmer Absent: Vice Mayor Kenneth Roth (excused) PROCLAMATIONS AND/QR ANNOUNCEMENTS Councilman Vallone requested that items 87.259 (10) (G) (2) and (14) (F) "Requests for Community Center and Yacht Club" be removed from the agenda. He asked that item 87.259 (10) (G) (1) "Request for Community Center - Sebastian Volunteer Fire Dept." be acted upon with the withdrawal of the fee waiver request. 1 Councilman Vallone then requested that amendment of Resolution No. R-86-29 "Rules and Regulations for Community Center and Yacht Club" be on the November 18, 1987, agenda. Mayor Harris said City Hall would be closed on Wednesday, November 11, 1987, for Veterans Day. Mayor Harris announced that General Development Utilities water would be shut off in Units 9, 16 and 17 from midnight to 4:00 A.M. Sunday, November 8, 1987. Mayor Harris removed item 87.268 (14)(K) (2) "Recommendation from Parks and Recreation - Alternate Liaison". He said this would be handled administratively. 6. PUBLIC HEARING, FINAL ACTION A. RESOLUTION NO. R-87-76 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, REPEALING RESOLUTION NO. R-87-09 AND THEREBY AMENDING THE RATES FOR GREEN FEES AND GOLF CART FEES; PROVIDING AN EFFECTIVE DATE. Attorney Palmer read Resolution No. R-87-76 by title only. Mayor Harris opened the Public Hearing at 7:10 P.M. and called for public input. Pat Flood recommended that Council strike the $3.00 member walking fee. Mayor Harris closed the Public Hearing at 7:13 P.M. MOTION by McCarthy/Metcalf I move we adopt Resolution No. R-87-76 as read by the City Attorney by title. Discussion took place on the member walking fee. MOTION amended by McCarthy/Metcalf I move we amend the motion to strike "Member - walking 18 holes $3.00 and 9 holes $2.00 from January 1, 1988 to April 15, 1988" ROLL CALL: (amendment) Councilman Vallone - Aye Councilman Metcalf - Aye Councilman McCarthy - Aye Mayor Harris - Aye MOTION CARRIED. 2 ROLL CALL: (motion) Councilman Metcalf - Aye Councilman Vallone - Aye Councilman McCarthy - Aye Mayor Harris - Aye MOTION CARRIED. 7. COMMITTEE REPORTS None. 8. PUBLIC INPUT ON AGENDA ITEMS Mayor Harris opened Public Input at 7:20 P.M. Robert McCollum said in his opinion the City does not need any new positions. Nate McCollum said the Fire Department is withdrawing their request for a fee waiver for use of the Community Center and are changing the date to January 9, 1987. Richard Szeluga requested that since this is a workshop he be allowed to speak during discussion of item 87.260 Animal Control. Councilman Vallone stated that this was a regular meeting not a workshop. Gary McCarthy said it is not realistic for dogs to walk on the fitness trail at Hardee Park but maybe Council could designate another trail for their use. Martha Goble requested a reduction of the Yacht Club fee to $10.00 per week as previously paid by her. Pete Richards urged Council to consider some type of Animal Control because people are not abiding by current laws. John Thompson also urged Council to consider some type of animal control. Richard Szeluga recommended that the Mayor instruct Code Enforcement Officers to fulfill the duties of Animal Control Officer. Pat Flood recommended that Acting Chief of Police get with the County on solving the animal control problem. He also recommended against hiring an assistant to the Building Official. 3 Ted Zeuch said an experienced Animal Control Officer is needed by the City to prevent harm to citizens. Mayor Harris closed the Public input at 7:47 P.M. 9. CONSENT AGENDA Approve Minutes_- 10/14/87 Reqular Meeting, 10/14/87 Special Meeting Councilman Vallone requested that the 10/14/87 Regular Meeting minutes be removed for discussion. MOTION by McCarthy/Metcalf I move we approve the 10/14/87 Special Meeting minutes as presented. VOICE VOTE: Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. Councilman Vallone said that Page 7, Request for Community Center from Chamber of Commerce "Councilman Vallone stated he felt that the Fire Department should receive a $50 refund for use of the Community Center since they were non-profit", should read "Councilman Vallone stated he felt that the Chamber of Commerce should receive a $50 refund for use of the Community Center since they were non-profit". MOTION by Vallone/McCarthy I move we approve the 10/14/87 Regular Meeting minutes with the following amendment: Page 7, Request for Community Center from Chamber of Commerce "Councilman Vallone stated he felt that the Fire Department should receive a $50 refund for use of the Community Center since they were non-profit", should read "Councilman Vallone stated he felt that the Chamber of Commerce should receive a $50 refund for use of the Community Center since they were non- profit". Approval of Airport Budget m 1987/88 Fiscal Year MOTION by Vallone/Metcalf I move we approve the 1987/88 fiscal year Airport budget. Councilman McCarthy questioned figures on the budget and it was discovered that the computer printout had moved several lines out of order. Mayor Harris noted however that the recommended line was correct and the others could be corrected. ROLL CALL: Councilman McCarthy - Nay Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. B. RESOLUTION NO. R-87-6~ A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, ADDING A NEW JOB DESCRIPTION TITLED "ASSISTANT TO THE BUILDING OFFICIAL" TO PART V OF THE CITY OF SEBASTIAN STANDARD OPERATING PROCEDURES; PROVIDING AN EFFECTIVE DATE. MOTION by Metcalf/Vallone I move we deny Resolution No. R-87-68. Mayor Harris said the two reclassifications for the building department were approved during budget hearings. Councilman McCarthy said the job classifications should have been done in conjunction with the budget. The Building Official said he had only been at work for one week when budget hearings took place and the dollar amounts for these positions were approved at that time. He said if this request was denied he would present a better case at a later date. R-87-69 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, ADDING A NEW JOB DESCRIPTION TITLED "CHIEF BUILDING INSPECTOR" TO PART V OF THE CITY OF SEBASTIAN STANDARD OPERATING PROCEDURES; PROVIDING AN EFFECTIVE DATE. MOTION by Metcalf/Vallone I move we approve Resolution No. R-87-69. Mayor Harris said budget cuts were made in the Building Department Budget to justify this classification. Councilman McCarthy questioned why these classifications were not discussed during the Public Hearing on the budget. He said if the job description was presented in the budget he would have voted for it. ROLL CALL: Councilman McCarthy - Nay Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. D. RESOLUTIQN NO. R-87-70 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, ADDING A NEW JOB DESCRIPTION TITLED "HEAVY EQUIPMENT OPERATOR" TO PART V OF THE CiTY OF SEBASTIAN STANDARD OPERATING PROCEDURES; PROVIDING AN EFFECTIVE DATE. Mayor Harris said this was one of the job descriptions negotiated with the union. Attorney Palmer said there is no mandate that Council approve the content of this job description. MOTION by Metcalf/Vallone I move we deny Resolution No. R-87-70. ROLL CALL: Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. 6 87.229 E. RESOLUTION NO. R-87-71 87.258 87.259 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, ADDING A NEW JOB DESCRIPTION TITLED "BUILDING MAINTENANCE TECHNICIAN" TO PART V OF THE CITY OF SEBASTIAN STANDARD OPERATING PROCEDURES; PROVIDING AN EFFECTIVE DATE. MOTION by Metcalf/Vallone I move we deny Resolution No. R-87-71. ROLL CALL: Councilman Vallone - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye Mayor Harris - Aye MOTION CARRIED. Report on Seminar re: ~ Manager Sponsored by National League of Cities and ~ Manager Association - Councilman Metcalf Councilman Metcalf gave a brief report on his attendance at the seminar sponsored by the National Leageue of Cities and City Manager Association. Request for Fee Waivers ~ Community Center/Yacht Club (per R-86-29 #19 - see backup - these items were in progress when the 10/28/87 m~eting adjourned) Sebastian Volunteer Fire Department - Full Fee Waiver and Alcoholic Beverage at Community Center L 1/2/88 (will pay security deposit) MOTION by Vallone/McCarthy I move we approve the alcoholic beverage request for the Sebastian Volunteer Fire Department on January 9, 1987, with the withdrawal of the request for fee waiver. VOICE VOTE: Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. Italian American Club of ~ebastian_- Reduce Community Center Fee from $50.00 1/2 fee to previous $20.00 fee paid 7 87.146 87.260 This item was removed from the agenda by Councilman Vallone because he had requested that amendment to Resolution No. R-86-29 "Rules and Regulations for the Yacht Club Community Center" regarding fee waivers be placed on the November 18, 1987, agenda. 11. MAYOR'S MATTERS Although Councilman Metcalf said proper procedures were not followed, Mayor Harris was given approval to hire Jerome Thomas as temporary City Engineer for $550 a week, until a full time City Engineer is hired. 12. COUNCIL MATTERS The City Clerk said she would forward City Manager applications to Mr. Cheney of Florida League of Cities. Councilman McCarthy requested "Airport Master Plan" be placed on the November 18, 1987, agenda. 13. CITY ATTORNEY MATTERS None. 14. NEW BUSINESS Consider Engagin~ a_~n Enqineering Firm for Stud~ o~f Drainage and Street Utility - Mayor Harris After a brief discussion on a drainage and street utility took place, the following motion was made: MOTION by McCarthy/Vallone i move we request Attorney Palmer and Mayor Harris to present Council with a draft of a proposal to advertise to engage a firm for study of drainage and street utility. VOICE VOTE: Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. Presentation of Petition - Dorothea Rogers re: Animal Control Officer Pg~ition for City of-- Sebastian Dorothea Rogers presented a petition to the City Clerk and read its title as follows: 8 87.260 87.261 "We the undersigned residents of the City of Sebastian hereby request that we employ a full time Animal Control Officer whose jurisdiction shall be within our City Limits. We suggest a salary of from $18,000-$27,000 yearly, and that he/she be supplied with a 1/2-ton pick-up truck, with cage in back, and pertinent supplies to pursue his/her duties. Money can come from our unencumbered Reserve Fund." Mrs. Rogers then went on to address Council as to her reasons for the implementation of this petition. Request to Address Council - Jane Carlson~ Executive Director~ Vero Beach Humane Society re: Animal Control Jane Carlson, Executive Director, Vero Beach Humane Society, offered her assistance in establishing an Animal Control policy. She recommended the City adopt the County Ordinance and enforce it. She said only through enforcement which directly puts the responsibility on the pet owner will changes be made in the current situation. Mayor Harris instructed Attorney Palmer to obtain a copy of the County Ordinance on Animal Control, meet with Jane Carlson of the Humane Society and draft an ordinance for the City. Mayor Harris called a recess at 9:10 P.M. The meeting was recalled at 9:18 P.M. and all members present before the recess were present at recall. D. Discussion re: Harris Replace Old Mowtrim L Mayor Councilman McCarthy requested that a policy be followed whereby all requests to dispose of any vehicle or equipment come from the Vehicle Maintenance Foreman in writing to Council for approval. MOTION by McCarthy I move we go to bid for a mowtrim. MOTION died for lack of a second. Councilman Vallone said he'd like to see specifications first. Mayor Harris requested that specifications for a mowtrim and request to go to bid be placed on the November 18, 1987, agenda. 87.262 87.263 87.259 E. CITY CLERK Request from City Clerk ~ Amend Code of Ordinances_- Chapter 23 - Section 23-76 Abandonment of Easement - Notification of Public Utilities from 15 to 30 Da~s The Building Official said he has been in contact with the County on this matter. He said he feels that 15 days is sufficient notice to the utilities. This item was postponed until further information from the County. Request from City Clerk for Permission to Remove Minutes, Ordinances, Resolutions from the ~ of Sebastian t__o David Dobbs Enterprises, Inc. of St. Augustine, FL Pursuant to Florida State Statute 119.031 "Keeping Records in Safe Place: Copying or Repairing Certified Copies" o~n a~proximately 11/19/87 MOTION by Vallone/Metcalf I move approve the request from City Clerk for permission to remove minutes, ordinances, resolutions from the City of Sebastian to David Dobbs Enterprises, Inc. of St. Augustine, FL Pursuant to Florida State Statute 119.031 Keeping Records in Safe Place: copying o__r repairing Certified Copies on approximately 11/19/87. VOICE VOTE: Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. Request from Oil Painters for use of the Yacht Club Each Monday from 1:00 P.M. to 5:00 P.M., November 87 to April 88 at Previous Rate of $10.50 Per Week This item was removed from the agenda by Councilman Vallone because he had requested that amendment to Resolution No. R-86-29 "Rules and Regulations for the Yacht Club Community Center" regarding fee waivers be placed on the November 18, 1987, agenda. 10 87.264 87.265 87.266 87.196 Je Possible Draft o~f Ordinance on Employee Salary Increases L Mayor Harris This item was postponed until November 18, 1987. Retail Businesses in Mini-Warehouses ~ Councilman Vallone A brief discussion took place on retail businesses in mini-warehouses. The Building Official said if site plan is approved without additional parking retail business cannot be conducted, otherwise retail is allowed in mini- warehouses. Councilman Vallone requested that the Building Official review parking in mini-warehouses and report back to Council. Review of Police Department bv Police Chief's Association - Councilman Vallone After reading a letter into the record, (see attached), Councilman Vallone instructed the City Clerk to investigate the possibility of Florida League of Cities creating a procedures manual for the Police Department. Councilman Metcalf gave the City Clerk a copy of a report on the Cocoa Beach Police Department done by Police Chiefs' Association. Sebastian Golf Course Food and Beverage Lease Proposal - Michael A. Cledes and Cyril J. Lynch Attorney Palmer said the lease he is drafting addresses expansion and this proposal before Council is short-term. He said the Golf Course retaurant cannot be substantially expanded until the sewer problem is addressed. Cyril Lynch said he had met with Mayor Harris for direction and had used a brief proposal from Bill Vincent. He then asked for direction from Council. Councilman Vallone said the City should create the proposal and advertise for bids. Councilman McCarthy questioned if ten identical proposals come in how can Council choose one over another. He recommended the bidders send in their own proposals. 11 87.267 87.268 87.269 MOTION by Vallone/McCarthy I move we instruct Attorney Palmer to come up with guidelines to advertise to accept proposals for lease of the Golf Course restaurant. Attorney Palmer said in effect the Council was working on a long term lease. ROLL CALL: Councilman Metcalf - Aye Councilman McCarthy - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. K. Parks and Recreation Aw Recommendation - Amend Section 18-2 of Code of Ordinances- Hardee Park Dog Walk MOTION by Vallone/McCarthy I move we deny the recommendation of the Parks and Recreation Committee to amend section 18-2 of the Code of Ordinances to provide for a dog walk in Hardee Park. VOICE VOTE: Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. 2. Recommendation - Alternate Liaison Mayor Harris said he would handle this item administratively. Select Committee to Negotiate wit_h ~.E. Block Architect for Police Facility MOTION by Vallone/McCarthy I move we appoint the following to the committee to negotiate with C.E.
