Mayor Conyers called the meeting to order at 7:00 p.m. 2. The Pledge of Allegiance was recited. 3. ROLL CALL Present: Mayor W.E. WORKSHOP ITEMS ae Review Indian River County Ordinances Creating Special Fire Protection District (City Manager Recommendation dated 10/30/90, Vitunac Letter dated 10/30/90, 3 IRC Proposed Ordinances, IRC Financial Info) Doug Scurlock, Indian River County Commissioner, Doug Wright, Indian River County Director of Emergency Services, Joe Baird, Indian River County Budget Director, and Charles Vitunac, Indian River County Attorney, presented the request for approval of Indian River County ordinances calling for a referendum on March 12, 1991, regarding the creation of a county-wide emergency services special district and an increase of the millage rate to three mills. A lengthy discussion ensued. Attorney Vitunac noted that the County Commission will hold public hearings on the two ordinances on November 27, 1990 and the Supervisor of Elections must be notified by early December for the March 1991 election. The City Manager said a resolution can be scheduled for the November 28, 1990 or December 12, 1990 Council meeting. Attorney Vitunac said he would contact the Supervisor of Elections and advise the City Manager of the latest date that she would require the information. MOTION by McCollum/Powell I move that the City Attorney be instructed to draw up a resolution for City Council approving 3oining the special district. 2 City Council Workshop November 7, 1990 Page Three Attorney Vitunac said the resolution should approve both Indian RiVer County ordinances. Mayor Conyers called recess at 8:05 p.m. and reconvened the meetinG at 8:20 p.m. Ail City Council members present at roll call were present. 90.248 Report on Chesser's Gap Preliminary Planned Unit Development (Staff Recommendation dated 9/18/90, P & Z Memo dated 10/15/90, P & Z Minutes dated 10/9/90, Schedule of Events) Randy Mosby, Mosby and Associates, and Warren Dill, counsel for the project, presented the request for preliminary plat approval and requested a waiver of the subdivision requirement for sidewalks on both sides of roadways under Land Development Code Section 20A-17.1K. The City ManaGer said that, although it is not required, this approval should be done by resolution to spell out specific conditions. MOTION by Oberbeck/Powell I move that we Go ahead and have the Attorney draft the resolution for the adoption of the Chesser's Gap PUD and include the items and recommendation as provided to us by the PlanninG and ZoninG Board and direct the Attorney to authorize the developer to provide the bikepath and sidewalk on the west side of the roadway. It was decided to place this item on the November 14, 1990 Council agenda and submit backup when possible. ROLL CALL: Councilman McCollum Vice Mayor Oberbeck Councilman Powell Mayor Conyers aye aye aye aye MOTION CARRIED 4-0. 3 City Council Workshop November 7, 1990 Page Four 88.183 C. 90.258 90.256 Review City's Position on Laconia Street Improvements and Sebastian Lakes PUD Request for Conceptual Plan Extension (City Manager Recommendation dated 10/31/90, City Manager Letter dated 10/31/90) Mary Scotti, Sebastian Lakes Condominium Association, said if Sebastian Lakes reps adhere to this agenda they are satisfied. She was assured that no discussion of utility rate increases would be discussed. Wayne Olson, Sebastian Lakes representative, stated that Sebastian Lakes was prepared to negotiate an agreement with the City for improvement of Laconia Street in exchange for conceptual plan extension. The City Manager with the assistance of the Director of Community Development, presented proposals for improvement of Laconia including a proposal from the developer establishing a new extension of Lansdowne Street to CR 512 and the creation of a cul-de-sac at the 3uncture of Laconia and CR 512. MOTION by Oberbeck/Powell I move we authorize the City Attorney and City Manager to go ahead and enter into negotiations with the Chase Maryland on the Sebastian Lakes pro3ect and that we pursue it based on the sketch putting in the new road. Wayne Olson said this proposal has not yet been approved by the County. ROLL CALL: Vice Mayor Oberbeck Councilman Powell Mayor Conyers Councilman McCollum aye aye aye aye MOTION CARRIED 4-0. Barber Street Sports Complex Use Fees (City Manager Recommendation dated 10/26/90, Memo from Finance Director dated 10/24/90) Following a brief discussion and recommendation from the City Manager regarding establishment of user fees by resolution and the discontinuance of the recreation coordinators services at the end of November, motion was made as follows. 4 City Council Workshop November 7, 1990 Page Five MOTION by Oberbeck/Powell I move that we go ahead and adopt the recommendation of the Finance Director with regard to the fees for the lighting at the Barber Street Sports Complex for the adult softball and that we proceed as we had discussed during our budget hearings to discontinue the funding at the end of November. Oberbeck/Powell added the motion "based on a thirty dollar fee per night". R-90-44 - Golf Course Rates - Set for Public Hearing on November 14, 1990 (Staff Recommendation dated 11/1/90, R-90-44) The interim Golf Course Manager presented the request for rate increase based on increased costs. The majority of City Council objected to a rate increase and current rates. The City Manager explained that Council must adopt rates by next week in accordance with Golf Course bond covenants. Arthur Lemire concurred that rates are too high for non-members. The City Manager recommended that current rates be incorporated into this resolution and that any changes can be done at a later date if need be. MOTION by Oberbeck/Powell I move we continue at the current rate structure until such time as we are afforded additional information to either increase or decrease rates. Recommendation from Construction Licensing Board Re: Competency Cards (Staff Recommendation dated 10/31/90~ Memo from Construction Board dated 10/31/90) The Director of Community Development presented the recommendation for unlimited extension of the grandfather clause for contractors holding an Indian River County comp card. The City Attorney said a discrimination problem could exist in allowing only Indian River County contractors holding comp cards to be grandfathered, however, the city could provide reciprocity to those jurisdictions that provide reciprocity to Sebastian. Council concurred that a letter be drafted to the Construction Board regarding the City Attorney's concerns and that this item be brought back to them for further review. 90.259 Asbestos Removal - City Council Chambers Building (Staff Recommendation dated 11/1/90, Memo from Director of Community Development dated 10/17/90, Letter from AJT dated 10/9/90) MOTION by Powell/Oberbeck I move that the City Manager bid for asbestos removal. ROLL CALL: Mayor Conyers Councilman McCollum Vice Mayor Oberbeck Councilman Powell aye aye aye aye MOTION CARRIED 4-0. 8. MAYOR'S MATTERS Mayor Conyers said he had attended a Teens Against Boredom meeting and was working with them to establish a teen center; questioned whether any progress had been made on the creation of a common code violation information packet; commended those involved in the King Neptune March of Dimes benefit and said it would continue for the next two days; reiterated that the Mayor's forum would continue on Mondays from noon to 2:00 p.m.; and requested Council support for expansion of the McClarty museum. The City Manager said he and the City Clerk would draft a resolution of endorsement for Council approval. City Council Workshop November 7, 1990 Page Seven 9. COUNCIL MATTERS A. Vice Mayor Oberbeck Vice Mayor Oberbeck requested progress reports on 1) the drainage problem in the CR512 alley; 2) planting by the city limit sign on U.S. 1; and 3) airport security lighting. The City Manager said the drainage problem is beinG reviewed, materials had been ordered for the planting and that airport security lighting would be on the November 14, 1990 agenda for approval. B. Councilman McCollum Councilman McCollum recommended use of the U.S. 1 library building for a Teen Center. C. Councilman Powell Councilman Powell extended an invitation to tour the citrus packing house at which he is employed. D. Councilman Rondeau Absent. 10. CITY ATTORNEY MATTERS The City Attorney said he had met with auditors regarding his review of charter inconsistencies and that he was reviewing Municipal Code Corporation's review of city codes. Upon questioning by Councilman Powell, the City Manager said a letter of objection had been received from the FAA regarding the proposed Italian/American Club lease. 11. CITY MANAGER MATTERS The City Manager commended those involved in the March of Dimes benefit; noted that the new library dedication would be November 19, 1990 at 3:00 p.m.; and said the County Commission had suggested a joint meeting with City Council on December 5, 1990 in Vero Beach. He suggested that the cancellation of the City Council Workshop November 7, 1990 Page Eight 12. December 5, 1990 City Council workshop be placed on the November 15, 1990 consent agenda. It was decided that the City Attorney need not attend the joint meeting. The City Manager said the Planning and Zoning Commission had suggested a joint meeting with them on November 14, 1990 to discuss the Riverfront District Study. Mayor Conyers called a special meeting for this purpose. Being no further business, Mayor Conyers adjourned the meeting at 10:02 p.m. Approved at the 1990 /~-~l Council Meeting.
