MARTIN ALLEY DRAINAGE COUNCILMAN ROTH QUESTIONED IF THiS WAS THE S~E MARTIN ALLEY DRAINAGE PROBLEM THAT HAD BEEN D~SCD$SED ~ER THE PAST FIVE YEARS. MAYOR GALLAGHER REPLIED THAT iT WAS AND RECOMMENDED THAT MR FRANCO INCLUDE THIS IN THE MASTER PLAN OF DRAINAGE FOR THE CITY. UNAUTHORIZED ALTERATION OF SWALE DRAINAGE SYSTEM MAYOR GALLAGHER STATED THAT THE COUNCIL HAD RECEIVED A MEMO FROM MR FRANCO, CITY ENGINEER, REGARDING THIS AGENDA ITEM AND STATED THAT THE COUNCIL HAD NOT ADOPTED RULES AND REGULATIONS REGARDING THE SAME AND PERHAPS THE COUNCIL SHOULD ESTABLISH LEGISLATION FOR CONTROL. MIKE BROWN, OF BART, HASH & ASSOCIATES EXPLAINED THAT THEY HAD BEEN RETAINED BY THE COUNTY TO PROVIDE A COMPREHENSIYE MODEL OF THE CURRENT AND PROJECTED FUTURE TRAFFIC NEEDS OF THE INDIAN RIVER COUNTY AREA. MR BROWN STATED FOR THE RECORD THAT A NUMBER OF PROBLEM AREAS EXIST IN THE CITY OF SEBASTIAN ESPECIALLY AS THE C.R. 512 CORRIDOR DEVELOPS. MR. JIM NICHOLAS, GOVERNMENT EXTENSION, UNIVERSITY OF FLORIDA, EXPLAINED THE CURRENT CHANGES MADE BY THE LEGISLATORS DURING THE 1985 SESSIONS, REGARDING THE_ANDATING OF T~E AMENDMENTS TO THE COMPREHEN$IYE LAND USE PLANS' AND A COMPREHENSIVE ELEMENT ON TRAF~I'C NEEDS FOR FUTURE GROWTH. THE I'MPACT ORDINANCE THAT IS BEING CONSIDERED BY ~NDI'AN R1VER COUNTY HAS A PROPOSED FEE SCHEDULE FOR THE CITY OF SEBASTIAN THE IMPACT FEE FOR A SINGLE FAMILY RESIDENCE IS AS LOW AS $161.00 AND THE HIGHEST IS $1,444.00, THIS IS BASED ON SINGLE FAMILY, MULTI-FAMILY, RETAIL AND COMMERCIAL DEVELOPMENT. THE CITY OF SEBASTIAN IS LOCATED IN DISTRICT THREE (3) OF THE COUNTY WIDE IMPACT WHICH INCLUDES ALL OF THE UNINCORPORATED AREAS OF ROSELAND AND OUT TO VERO LAKE ESTATES. MR NICHOLAS ADDED THAT BY THE END OF THIS YEAR MORE THAN ½ OF THE COUNTIES 1N FLORIDA WILL HAVE ADOPTED AN IMPACT FEE ORDINANCE AND BY THE END OF 1987 THERE WILL BE ONLY A FEW COUNTIES THAT HAVE OPTED OUT. MR. CRAIG RICHARDSON OF SEMEN, LARSON AND PURDY, ATTORNEY AND PLANNER, STATED THAT HE MAD WORKED CLOSE WITH THE COUNTY AND THE TRANSPORTATION PLANNING COUNCIL IN THE PREPARATION OF THE ORDINANCE, THE ORDINANCE IS ESTABLISHED REQUIRING THE DEVELOPER TO PAY THE IMPACT FEE AND PROVIDES FOR CREDITS TO THE DEVELOPER SHOULD HE DESIRE TO CONSTRUCT THE ROADS AND DEDICATE THEM TO THE DISTRICT IN WHICH THEY ARE LOCATED. THE FEES WILL BE COLLECTED IN THE DISTRICT. MR COBB AND MR LEGUE PLAYED THREE SONGS FOR THE COUNCIL' AND AUDIENCE. MAYOR GALLAGHER STATED THAT IN THE AUDIENCE WERE A NUMBER OF INDIAN RIVER COUNTY OFFICIALS AND THEY WERE HERE TO PRESENT AND EXPLAIN TO THE RESIDENTS AND COUNCIL THEIR PROPOSED ORDINANCE REGARDING THE COUNTY WIDE IMPACT FEES. MAYOR GALLAGHER REQUESTED THAT THE COUNCIL CONSIDER WAIVING THE RULES OF COUNCIL AND ALLOW THE COUNTY REPRESENTATIVES TO SPEAK AND HAVE QUESTIONS FROM TME COUNCIL AND AUDIENCE. MOTION BY COUNCILMAN SZELUGA, SECONDED BY VICE MAYOR HARRIS THAT WE WAIVE THE RULES Of T~E COUNCIL AND ALLOW THE COUNTY' REPRESENTATIVES TO ADDRESS THE COUNCIL AND AUDIENCE ON THE PROPOSED ORDINANCE AND ALLOW FOR QUESTIONS. ALL AYES MOTION CARRIED. MR JIM DAVIS, INDIAN RIVER COUNTY DIRECTOR OF PUBLIC WORKS ADVISED THE AUDIENCE AND COUNCIL THAT THE MAIN PURPOSE OF THE PROPOSED IMPACT FEE ORDINANCE WAS TO FUND TB.E T~AN~PO~TAT~ON NEEDS OF T~E ENTIRE COUNTY. MR DAVIS ADVISED THAT PALM BEACH COUNTy WAS TBE FIRST TO ADOPT SUCH AN ORDINANCE APPROXIMATELY 6 YEARS AGO AND THAT TBE'~ LEGI'SLATION HAD BEEN UP~ELD BY T~E COURTS A NUMBER OF TIMES. MR DAVIS E×PLA~NED ABOUT THE NEW STATE LEGISLATIVE MANDATE ON COUNTIES AND MUNICIPALITIES REQUIRING UPDATES ON THE ADOPTED COMPREHENSIVE LAND USE PLANS AND THE PLANNING REQUIREMENTS FOR LONG RANGE CAPITOL IMPROVEMENTS. MR DAVIS ADVISED THAT THE ATTORNEY WHO ASSISTED IN THE PREPARATION WAS PRESENT MR CRAIG RICHARDSON OF SEMON, LARSON, AND PURDY. MR MIKE BROWN OF NASH & ASSOCIATES AND DR.
