PRESENT: VICE MAYOR EVERETT T. GASS, COUNCILMAN FRANK OBERBECK, MAYOR PAT FLOOD ABSENT:~ CITY ATTORNEY DANIEL KILBRIDE, COUNCILMAN RICHARD VOTAPKA, AND COUNCILWOMAN FLORENCE PHELAN THIS EMERGENCY MEETING OF THE COUNCIL HAS BEEN CALLED REGARDING THE AWARDING OF THE BID FOR THE CONSTRUCTION OF A CONTROL STRUCTURE AT COLLIER CREEK. MR. MACQUEEN, LLOYD AND ASSOCIATES, REPORTED THAT HE HAS BEEN IN TOUCH WITH DICKERSON, INC., THE BIDDER FOR COLLIER CREEK AND WITH SOME RECOMMENDATIONS AND CHANGES, THE BID PRICE NOW STANDS AT $51,600.00. MR. MACQUEEN INDICATED THAT HE WAS STILL WORKING WITH DICKERSON, INC. AND HOPED TO REDUCE THE BID PRICE A LITTLE MORE. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, TO AWARD THE BID TO DICKERSON, INC. FOR THE COLLIER CREEK DAM AND NOT TO EXCEED $51,600.00. ROLL CALL VOTE: AYES: VICE MAYOR GASS COUNCILMAN OBERBECK MAYOR FLOOD NAYS: NONE ~ -- ~----~ ~7 CARRIED. COUNCILMAN OBERBECK STATED THAT TT~ER~ WAS ~25,~0/.00 IN THE GENERAL DEVELOPMENT FUND WHICH HAS BEEN CONTRIBUTED BY GENERAL DEVELOPMENT AN~ ~ELT THAT THIS MONEY ALONG WITH THE INTEREST EARNED SHOULD BE APPLIED TOWAR~ T~ CO~T OF COL~ER CREEK DAM. AFTER A LENGTHY DISCUSSION, MAYOR FLOOD INDICATED THAT MONEY HAS BEEN SET ASIDE IN THE SURPLUS FUND TO COVER THE ENTIRE COST OF THE COLLIER CREEK CONSTRUCTION AND STATED THAT THE INTEREST EARNED ON THE $25,000.00 W~HA~O BE PRORATED AS FAR BACK AS 1979. HE FELT THIS WOULD BE A WASTE OF TIME WHEN FHE ~OME~COULD COME OUT OF THE SURPLUS FUND. VICE MAYOR GASS AGREED ALSO THAT THIS WOULD~E A WASTE OF TIME. MOTION BY COUNCILMAN OBERBECK, TO U~E ~5,000.00 THAT HAS BEEN CONTRIBUTED BY GENERAL DEVELOPMENT CORPORATION WITH THE INTEREST EARNED ON IT AND APPLY IT TO THE COST OF THE VICE MAYOR GAS~ATED A W OND THE MO E HE COULDN'T SEE THE POINT MAYOR FLOOD AS~ICE Y S NA~FAV~ . MAYOR FLOOD READ THE BIDS FOR THE SPLIT RAIL FENCING AT THE SEBASTIAN MUNICIPAL AIRPORT. SCOTTY'S, VERO BEACH, FLA. WILBUR LARKIN, FORT PIERCE, FLA. BREVARD FENCE, MERRITT ISLAND, FLA. ATLAS STEEL FENCE, FORT PIERCE, FLA. SEARS, ROEBUCK AND COMPANY, VERO BEACH $6,880.00 6,497.00 9,000.00 9,800.00 7,685.94 ($1.12 Lineal Foot) ($2.25 Lineal Foot) ($2.45 Lineal Foot) MAYOR FLOOD STATED THAT SCOTTY'S WAS TO CHECK INTO THE INSTALLATION COST TO SEE IF THEY COULD OFFER A BETTER PRICE AND THAT HE ASKED COUNCILMAN OBERBECK TO CHECK INTO INSTALLATION PRICES FROM LOCAL SUB-CONTRACTORS. SCOTTY'$ REPRESENTATIVE REPORTED THAT THE LOWEST CHARGE FOR THE INSTALLATION WOULD BE $.45 PER LINEAL FOOT. COUNCILMAN OBERBECK REPORTED THAT HE CAME UP WITH .40 ¢ PER LINEAL FOOT FOR THE INSTALLATION. MAYOR FLOOD STATED THAT HE WANTED THIS TO BE PART OF THE RECORD, THAT WE DO HAVE THE RIGHT TO ACCEPT ANY PART OF OR REJECT ANY PART OF ANY BID AND THIS WAS THE REASON WE ASKED TO HAVE THE BIDS SPLIT. MOTION BY VICE MAYOR GASS, SECONDED BY COUNCILMAN OBERBECK, THAT WE AWARD THE CONTRACT FOR THE 4,000 FEET OF FENCING AT $1.12 PER FOOT TO SCOTTY'S FOR MATERIALS. MR. WILBUR LARKIN, BIDDER FOR THE FENCING, STATED THAT HIS TOTAL BID PRICE WAS FOR A PER LINEAL FOOTAGE AND INSTALLATION. HE INDICATED THAT THE ADVERTISED BID DID NOT SPECIFICALLY ASK FOR A PRICE BReaKDOWN ON LINEAL FOOTAGE AND INSTALLATION. MR. LARKIN WAS UPSET AND AWARD COMMITTEE AND SPECIAL EMERGENCY MEETING OF THE COUNCIL - NOVEMBER 25, 1981 LEFT THE MEETING. COUNCILMAN OBERBECK FOLLOWED HIM OUTSIDE AND WHEN HE RETURNED, RECOMMEND- ED THAT WE REJECT ALL BIDS AND PURCHASE THE MATERIAL IN CASE THERE WOULD BE AN REPERCUSSIONS THE CITY CLERK CALLED THE CITY ATTORNEY WHOSE OPINION IT WAS THAT THE BID NOTICE WAS NOT QUITE CLEAR. THEREFORE, HE RECOMMENDED THAT ALL BIDS BE REJECTED. THEN WE WOULD HAVE THE RIGHT TO PURCHASE MATERIAL WHEREVER WE WANTED TO. MAYOR FLOOD STATED THAT IT WAS THE INTENT OF THE COUNCIL TO HAVE THE BIDS BROKEN DOWN ON LINEAL FOOTAGE AND INSTALLATION. , COUNCILMAN OBERBECK RECOMMENDED THAT WE REJECT ALL BIDS AND GO OUT TO PURCHASE MATERIAL SINCE THERE WAS A IRREGULARITY IN BIDDING PROCEDURES. VICE MAYOR GASS WITHDREW HIS MOTION AND COUNCILMAN OBERBECK WITHDREW HIS SECOND. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, THAT ALL BIDS FOR THE FENCING AT THE SEBASTIAN AIRPORT BE REJECTED. ROLL CALL VOTE: A YES: NAYS: VICE MAYOR GASS COUNCILMAN OBERBECK MAYOR FLOOD NONE CARRIED. MAYOR FLOOD REPORTED THAT THE G/~k~ C~M~~C~MENDED THAT A 12' X 46' TEMPORARY CLUB ,- \--! RAY LADD, GOLF PROFESSIONAL, RE~ORTED THAT THE\C~ST WOULD BE $332.00 PER MONTH, $225.00 FOR DELIVERY AND $400.00 TO SET L~UP. ~H~ TO~A~ DIFFERENCE IN PRICE COMPARED TO THE SMALL- ER TEMPORARY CLUB HOUSE WOULD .~ECD___VERE~ BY A~MALL CONCESSION THAT WILL BE SET UP IN THE TEMPORARY CLUB HOUSE. MOTION BY COUNCILMAN OBERBECK, SECO~D~BY--V~CE MAYOR GASS, THAT WE ALLOW THE GOLF COURSE COMMITTEE TO GO TO THE BIGGER TEMPO_{AR'Y QUARTERS. CARRIED. MR.. RAY LADD, GOLF PROFESSIONAL, REPORTED T~-AT THE GOLF COURSE COMMITTEE WANTS TO HAVE A LARGE COCKTAIL PARTY ON DECEMBER 12~. Cl~961, FOR THE MEMBERS OF THE GOLF COURSE AND THEIR GUESTS TO CELEBRATE THE GRAND OPENI~ ~SEBASTIAN MUNICIPAL GOLF COURSE. HE INDICATED THAT HE HAS RECEI'~ED PERMISSION FROM THE COMMITTEE TO ASK THE COUNCIL FOR A $500.00
