THE PROCLAMATION TO DR. LUNDSFORD FROM THE COLLEGE.
THE CITY CLERK READ A PROCLAMATION, IN ITS ENTIRETY, COMMENDING GENERAL
DEVELOPMENT CORPORATION FOR THEIR CONTINUTING EFFORTS TO PROVIDE HOUSING IN
THE CITY OF SEBASTIAN AND THE STATE OF FLORIDA.
MAYOR GALLAGHER ANNOUNCED THAT THE CITY WOULD BE CELEBRATING THEIR 60th
BIRTHDAY AND THE UNVAILING OF THE BIRTHDAY PRESENTS THAT THE CITY'S 4TH OF

MAYOR GALLAGHER ANNOUNCED THAT THE POLICE DEPARTMENT WOULD BE HOLDING A CHILD
ABUSE PROGRAM IN THE COMMUNITY CENTER ON DECEMBER 19, 1984, AT 7:00 P.M.
MAYOR GALLAGHER ANNOUNCED THAT A REPRESENTATIVE FROM DAVID NOLTE'S OFFICE
WOULD BE IN THE CITY COUNCIL CHAMBERS, THURSDAY, DECEMBER 6, 1984, BETWEEN
THE HOURS OF 9:00 A.M. AND 12:00 P.M. AND 1:00 P.M. TO 3:00 P.M.
MAYOR GALLAGHER ANNOUNCED THAT WITH COUNCIL PERMISSION HE WOULD LIKE
TO ADJOURN THE MEETING AS 7:30 P.M. TO LIGHT THE CHIRSTMAS DECORATIONS
IN FRONT OF CITY HALL. MAYOR GALLAGHER ANNOUNCED THAT MR. DON NEIHAUS
WOULD BE LIGHTING THE TREE AS HE SO GENEROUSLY DONATED THE TREE TO THE
CITY.
MR. ERNIE WALSH, RESIDENT OF GEORGE STREET, AND DIRECTOR OF THE SEBASTIAN
HIGHLANDS PROPERTY OWNERS ASSOCIATION DISCUSSED THE PROBLEMS WITH THE
STRIPPING ON MAIN STREET.
MAYOR GALLAGHER STATED THAT THE CITY WAS AWARE OF THE PROBLEM AND THAT
IT WOULD BE TAKEN CARE OF BY THE MIDDLE OF JANUARY. THERE WAS A DISCUSSION
REGARDING THE NO PARKING ON MAIN STREET FROM U.S. #1 WEST TO THE RAILROAD
CROSSING AND ANTICIPATED COMPLETION DATES WILL BE THE SAME AS THE STRIPPING.
MR. PRESTON, RESIDENT, POINCIANA STREET, COMPLAINED THAT THE WATER STANDS
IN THE DITCH.
MR. BLAIR, BUILDING OFFICIAL AND MR. PELTIER, PUBLIC WORKS DIRECTOR,
STATED THAT THEY WERE AWARE OF THE PROBLEM AND HAD BEEN IN TOUCH WITH
GENERAL DEVELOPMENT CORPORATION AND THEY WERE ATTEMPTION TO STRAIGHTEN
OUT THE PROBLEM.

MR. WALSH, ADDRESSED, THE COUNCIL AGAIN REGARDING THE RAILROAD CROSSING
GATES AT SCHUMANN DRIVE.
CHIEF NAPPI STATED THAT HE HAD BEEN AWARE OF THE PROBLEM AND THAT THE
F.E. C.C. HAD REPAIRED THE GATE.
MAYOR GALLAGHER REQUESTED THAT THE COUNCIL RECESS THE MEETING, FOR THE
TREE LIGHTING CEREMONY, 7:30 P.M., AND REOPENED THE MEETING AT 7:40
P.M., ALL MEMBERS OF THE COUNCIL WERE PRESENT.
#11. RECOMMENDATION TO AWARD BID FOR THE CONSTRUCTION OF RIVERVIEW
PARK.MOTION BY VICE MAYOR MCKINLEY, SECONDED BY COUNCILWOMAN KEENAN,
TO AWARD THE BID TO UNLIMITED DEVELOPMENT, INC., IN THE AMOUNT OF $133,000.43.

THERE WAS A LENGTHY DISCUSSION REGARDING THE TYPE OF WATER AND SEWER

#21. CONSENT TO SUBLEASE GOLD STAR BUILDING TO KINIRY , SR. /AIRPORT.
AFTER SOME DISCUSSION REGARDING THE SUBLEASE, IT WAS REPORTED THAT THE
PLANT WOULD EMPLOY' 50 NIGHT PEOPLE AND THEY WOULD BE MAKING CANVAS PRODUCTS
FOR THE FEDERAL GOVERNMENT. ATTORNEY PALMER STATED THAT THERE WOULD
BE A FEW CHANGES ON THE CONSENT TO SUBLEASE AND THAT THE MAYOR WOULD
SIGN THE NEW SUBLEASE.
MOTION BY COUNCILMAN ROTH, SECONDED BY COUNCILMAN SZELUGA, TO ACCEPT
THE CONSENT TO SUBLEASE WITH CORRECTIONS.
MOTION CARRIED.
MAYOR GALLAGHER RECESSED THE MEETING AT 9:05 P.M.
MAYOR GALLAGHER REOPENED THE MEETING AT 9:10 P.M. WITH ALL MEMBERS OF
THE COUNCIL PRESENT.
MR. RENE VAN DE VOORDE REQUESTED PERMISSION OF THE COUNCIL TO ADDRESS
THEM REGARDING THE NORTH INDIAN RIVER COUNTY RECREATION DEPARTMENT.
THERE BEING NO OBJECTIONS MR. VAN DEVOORDE EXPLAINED THAT THE CITY FACILITIES
AT NO CHARGE FOR RESIDENTS TO HAVE RECREATION AND CLASSES AND THAT THE
CITY COULD RENT THE CENTERS AND CANCEL THE NORTH INDIAN RIVER COUNTY
CLASSES. MR. VAN DEVOORDE STATED THAT THE RECREATION COULD DONATE $50.00
PER MONTH TO THE CITY SO THAT THE CLASSES WOULD NOT BE CANCELLED UNTIL
A NEW CONTRACT COULD BE DRAWN, AS THERE IS SO MUCH INTEREST IN THE AREOBICS
ON TUESDAY AND THURSDAY NIGHTS. MAYOR GALLAGHER STATED THAT THE COUNCIL
COULD GRANT PERMISSION FOR AN UNDEFINITE PERIOD OF TIME.
MOTION BY COUNCILMAN ROTH, SECONDED BY VICE MAYOR MCKINLEY, THAT THE
NORTH INDIAN RIVER COUNTY RECREATION DEPARTMENT BE PERMITTED TO USE
THE COMMUNITY CENTER ON TUESDAY'S AND THURSDAY'S, WITH A WAIVER OF FEES,
AS SPECIFIED BY THE MAYOR.

OF THE CITY FLAG AND THAT THE COUNCIL COULD PURCHASE THE WHITE FLAG
WITH OUTDOOR NYLON 3x5 AND THAT THE COUNCIL COULD PURCHASE THE FLAG
GREEN OR YELLOW BORDER AND THAT THEY WOULD BE PRINTED IN ONE DOZEN AT
APPROXIMATELY $100. O0 PER FLAG, AND THAT ANOTHER COMPANY WOULD CHARGE
$97.65 PER FLAG IN ONE DOZEN ORDERS. MAYOR GALLAGHER STATED THAT THEY
WOULD CONTINUE TO INVESTIGATE FURTHER.

FOR MR. ROLAND MILLER FOR THE MEETING OF DECEMBER 12, 1984.
#23. RESOLUTION ABANDONING EASEMENT BETWEEN LOTS 8 AND 9, BLOCK 288.
MAYOR GA£LAGHER STATED THAT THIS WOULD BE AN AGENDA ITEM FOR DECEMBER 12,
1984, MEETING.

ATTORNEY PALMER STATED THAT THE COUNCIL COULD ACT AS AN ASSESSMENT BOARD
AND ADOPT AN ORDINANCE PROVIDING FOR SUCH ASSESSMENT, INDICATING EACH
PARCEL OF PROPERTY AND TAXING EACH SEPERATELY. ATTORNEY PALMER STATED
THAT HE WOULD REVIEW THE LAW FURTHER AND GET BACK TO THE COUNCIL WITH
A REPORT ON DECEMBER 12, 1984.
#26. REQUEST FROM THE MEMBERS OF THE SPRING CHICKEN BAND.
MOTION BY COUNCILMAN ROTH, SECONDED BY COUNCILMAN SZELUGA, TO ENDORSE
THE CHANGE OF NAME TO THE SEBASTIAN CHICKEN BAND AS THE OFFICIAL CITY
OF SEBASTIAN BAND.

MAYOR GALLAGHER STATED THAT THE COUNCIL WOULD HAVE A FIRST READING OF
THE ORDINANCE DURING THE REGULAR COUNCIL MEETING OF DECEMBER 12, 1984.
#28. APPROVE MINUTES OF BID OPENING AND WORKSHOP MEETING OF NOVEMBER
7, 1984, AND PUBLIC HEARINGS AND REGULAR COUNCIL MEETING OF NOVEMBER
14, 1984.

THE MINUTES OF THE BID OPENING AND COUNCIL WORKSHOP MEETING OF NOVEMBER

#29. REQUEST FROM J. HORNE/SEBASTIAN RIVER AREA LITTLE LEAGUE ASSOCIATION.
MAYOR GALLAGHER RECOMMENDED THAT THE SEBASTIAN RIVER AREA LITTLE LEAGUE
ASSOCIATION LIASON BE COUNCILWOMAN KEENAN AS SHE IS ALSO THE CHAIRPERSON
OF THE CITY PARKS AND RECREATION DEPARTMENT.

MAYOR GALLAGHER STATED THAT HE HAD INVITED THE UNITED WAY TO DO A PRE-
SENTATION PRIOR TO THE COUNCIL MEETING ON DECEMBER 12, 1984.
ATTORNEY PALMER STATED THAT HE HAD BEEN CONTACTED BY THE BANKERS OF
THE PLANNED UNIT DEVELOPMENT IF THE PROJECT WERE NOT FINANCED THAT THE
AVIATION EASEMENT WOULD BE REVERTED BACK INTO LAND AS A TOTAL THE AVIATION
EASEMENT WOULD BE REVERTED BACK INTO LAND AS A TOTAL ACREAGE. THE COUNCIL
HAD NO OBJECTION TO THE LETTER BEING PREPARED.
COUNCILMAN SZELUGA STATED THAT HE WOULD LIKE TO SEE A COMMITTEE ESTABLISHED
TO REVIEW AND MAKE RECOMMENDATIONS FOR CHARTER AND CODE CONFLICTS AND
UPDATE. A DISCUSSION FOLLOWED REGARDING THE DELECTION OF SECTION 2.17
OF THE CODE OF ORDINANCES PROVIDING FOR COMPENSATION OF THE VICE MAYOR
SINCE THE CHARTER 2.05 PROVIDES FOR COMPENSATION AND THAT IT COULD BE
CONSIDERED DUAL COMPENSATION.
ATTORNEY PALMER WAS INSTRUCTED TO DRAFT A~ ORDINANCE AMENDING SECTION
2.05 OF THE CODE. IT WAS THEN DECIDED TO CHECK INTO THE POSSIBILITY
OF A NEW UPDATED CODE AND CHARTER.
