MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN OBERBECK, TO APPROVE THE MINUTES OF BID OPENING AND REGULAR COUNCIL MEETING 10/13; REGULAR COUNCIL MEETING 10/20; PUBLIC HEARING OF 11/3; BID OPENING AND REGULAR COUNCIL MEETING OF 11/10, 1982 AS WRITTEN. MOTION CARRIED. ARTHUR MAYER, BUILDING OFFICIAL, REPORTED A TOTAL OF 14 SINGLE FAMILY DWELLING PERMITS ISSUED FOR THE MONTH OF NOVEMBER, 1982, WITH A TOTAL OF $3,131.50 COLLECTED IN PERMIT FEES. EARL MASTELLER, CITY ENGINEER, REPORTED THAT GENERAL DEVELOPMENT WATER UTILITY TREATMENT PLANT HAS INDICATED THAT THEY WILL BE ON LINE WITHIN TWO WEEKS, SINCE THE 16" WATER MAIN IS JUST ABOUT CONSTRUCTED ALONG BARBER STREET, BETWEEN FILBERT STREET AND SCHUMANN DRIVE. HE ALSO REPORTED THAT GENERAL DEVELOPMENT UTILITY HAS GIVEN THE CITY A USED 15,000 GALLON A DAY, STEEL PACKAGE, WASTE WATER TREATMENT TANK IN GOOD CONDITION, WHICH IS BEING STORED AT AN END FIELD AT THE SEBASTIAN MUNICIPAL AIRPORT. VICE MAYOR GASS REPORTED THAT AFTER MEETING WITH FLORIDA POWER AND LIGHT REPRESENTATIVES, IT WAS AGt~EED TO I2~P_I~EMi ILLUMINATION. MAYOR FLOOD RECOMMENDED THAT WE CONTINUE WITH THIS MEETING TONIGHT AND SEE HOW MUCH BUSINESS NEEDS TO BE CARRIED OVER TO THE NEXT MEETING AND THAT IT WILL BE DISCUSSED FURTHER AT THE END OF THE MEETING. COUNCILMAN VOTAPKA REMARKED THAT HE WOULD TALK TO MR. BRIGHTNER, WHO APPLIED FOR THE CIVIL DEFENSE COMMITTEE. COUNCILMAN SCHUM REPORTED THAT THE SWIMMING POOL COMMITTEE IS PREPARING TO PUT THE DECISION OF THE SWIMMING POOL ON THE MARCH BALLOT AND THAT THE COLLECTION FOR THE BARBER STREET FIRE STATION WILL BE CONTINUED AFTER THE HOLIDAYS. HE STATED THAT THE "NO PARKING" ON THE SOUTH SIDE CAN BE ENFORCED AS SOON AS THE PROPER SIGNS ARE POSTED. DUE TO A HEAVY WORK LOAD, ATTORNEY KILBRIDE REPORTED THAT HE HAS BEEN UNABLE TO DO ANY FURTHER RESEARCH REGARDING THE MAYOR'S EXPENSE ACCOUNT AND THAT HE WOULD TRY TO HAVE SOMETHING IN WRITTING BY THE FIRST MEETING IN JANUARY, 1983. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, TO TABLE THE MAYOR'S EXPENSE ACCOUNT TO THE FIRST MEETING IN JANUARY, 1983. MOTION CARRIED. EARL MASTELLER, CITY ENGINEER, REQUESTED PERMISSION FROM THE COUNCIL TO PURCHASE A 15 INCH CULVERT PIPE AT AN APPROXIMATE COST OF $250.00, IN ORDER TO BRING THE .EAST AIRPORT ROAD UP TO THE PROPER STANDARD, THAT WILL BE EXPECTED TO BE MAINTAINED IN ACCORDANCE WITH THE COMPLETE HOMES, INC., LEASES AGREEMENT. HE REMARKED THAT THIS COULD BE COMPLETED NEXT WEEK. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, TO BRING TO THE FLOOR A DISCUSSION REGARDING THE SPRAYING OF HERBICIDE ON THE TAXIWAYS AT THE AIRPORT. MOTION CARRIED. MAYOR FLOOD EXPLAINED THAT THE TAXIWAY AT THE SEBASTIAN MUNICIPAL AIRPORT IS SCHEDULED TO BE SPRAYED WITH HERBICIDE AT AN APPROXIMATE COST OF $2, 000. O0 AND ASKED FOR COUNCIL APPROVAL TO USE THE GOLF COURSE EQUIPMENT TO DO THE SPRAYING. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, TO PROCEED WITH THE SPRAYING OF HERBICIDE ON THE TAXIWAYS AT THE SEBASTIAN MUNICIPAL AIRPORT. MOTION CARRIED. REGULAR COUNCIL MEETING DECEMBER 8, 1982 MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, TO BRING TO THE FLOOR A REQUEST FROM MR. O'SICKEY, GREAT AMERICAN CARNIVAL COMPANY. MOTION CARRIED. MR. O'SICKEY, GREAT AMERICAN CARNIVAL COMPANY, REQUESTED PERMISSION FROM THE COUNCIL TO USE THE SEBASTIAN RIVERVIEW PARK, TO HOLD A FAMILY TYPE CARNIVAL BEGINNING DECEMBER 9, 1982 THROUGH DECEMBER 20, 1982, TO BE OPEN FROM 6:00 P.M. to 10:00 P.M. WEEKDAYS, FRIDAY AND SATURDAY FROM 6:00 P.M. to ll :00 P.M.. HE ALSO MENTIONED THAT IF THERE WAS ADEQUATE DEMAND, THAT HE WOULD PROMOTE A SATURDAY AFTERNOON KIDDY MATINEE. UNDER NORMAL CIRCUMSTANCES, WHEN THERE IS~MORE?TIME~. MR. i~'O'S~CKEF,i!S~P~INE~LZ.i.~-.E. THAT THIS TYPE OF CARNIVAL IS USUALLY HANDLED BY THE COMMUNITIES FIRE DEPARTMENT, SINCE THEY WILL RUN THE TICKET BOOTHS AND RECEIVE 20% OF THE PROCEEDS. AFTER SOME FURTHER DISCUSSION, MR. O'SICKEY STATED THAT HE HAS PROVIDED PROOF OF INSURANCE BY TELEGRAM TO THE MAYOR AND THAT THE EQUIPMENT HAD BEEN INSPECTED IN TALLAHASSEE THIS YEAR AND THAT IT IS NORMAL PROCEDURE THAT THERE BE ONE YEARLY INSPECTION. HE DID INDICATE THAT THE CARNIVAL FORMAN DOES PERFORM HIS OWN SAFETY INSPECTION PROGRAM ON A DAILY BASIS. COUNCILMAN OBERBECK RECOMMENDED THAT PRIOR TO THE OPERATION OF THE EQUIPMENT, THAT IT BE VISIBLY CHECKED BY THE BUILDING OFFICIAL AND THE MAYOR. ATTORNEY KILBRIDE SHOWED SOME CONCERN, REGARDING THE ADEQUATE PARKING FACILITIES. COUNCILMAN OBERBECK RECOMMENDED THAT PERMISSION TO PARK ON THE PROPERTY ACROSS FROM THE PARK BE REQUESTED FROM THE OWNER, IN ORDER TO PROVIDE ADDITONAL PARKING FACILITIES IF NEEDED. MR. ATTORNEY KILBRIDE EXPLAINED THAT THIS RESOLUTION DEALS WITH DISCRIMINATION RIGHTS. ATTORNEY KILBRIDE REMARKED THAT THE ANNEXATION PAPERS WERE INCOMPLETE FOR THE SKILLMAN ANNEXATION REQUEST. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, TO TABLE THE SKILLMAN ANNEXATION, UNTIL THE NEXT REGULAR COUNCIL MEETING, DECEMBER 15, 1982. MOTION CARRIED. REGULAR COUNCIL MEETING DECEMBER 8, 1982 IN REGARDS TO THE PLANNED UNIT DEVELOPMENT, MAYOR FLOOD STATED THAT THE COUNCIL DID RECEIVE A COPY OF IT IN AUGUST, 1982 AND SUGGESTED THAT IT BE REVIEWED AGAIN AND THAT IT BE DISCUSSED FURTHER AT THE WORKSHOP MEETING, JANUARY 5, 1983. A VERY LENGTHY DISCUSSION FOLLOWED REGARDING THE UTILITY AGREEMENT DRAFTED BY GENERAL DEVELOPMENT UTILITY, WHICH WILL PROVIDE WATER AND SEWER SERVICE TO "REFLECTIONS" ON THE RIVER, CONDOMINIUM COMPLEX, PRESENTLY LOCATED IN THE COUNTY, ATTORNEY KILBRIDE EXPLAINED THAT THE CITY NEEDS TO CONSENT AND BE PART OF THIS AGREEMENT, SO THERE WILL BE A GUARANTEE THAT THIS AGREEMENT BETWEEN GENERAL DEVELOPMENT UTILITY AND "REFLECTION" DOES NOT AFFECT THE FRANCHISE THAT GENERAL DEVELOPMENT UTILITY HAS WITH THE CITY OF SEBASTIAN. AFTER CAREFUL REVIEW OF THE AGREEMENT, EARL MASTELLER, CITY ENGINEER, RECOMMENDED THAT ON PARAGRAPH #3, PAGE 1 AND 2, WHERE IT STATES "SUCH CIRCUMSTANCES SHALL NOT INCLUDE OVER COMMITTMENT BY THE UTILITY TO ITS CUSTOMERS" THAT THE WORK "NOT" BE REMOVED. HE ALSO RECOMMENDED THAT THE WORDS "AND COMMERCIAL", BE INSERTED IN THE LAST SENTENCE OF PARAGRAPH 5, PAGE 2, BETWEEN "RESIDENTS" AND "CONNECTION" AFTER MUCH DISCUSSION REGARDING THE PROPER INTERPRETATION OF THE AGREEMENT AND THE RECOMMENDED CHANGES, MAYOR FLOOD RECOMMENDED THAT WE GET BACK WITH GENERAL DEVELOPMENT UTILITY AND REQUEST THAT THEY MAKE A SEPARATE ATTACHMENT TO THE AGREEMENT, SHOWING MUTUAL CONSENT AND CLARIFICATION OF THESE RECOMMENDED CHANGES. MOTION BY COUNCILMAN OBERBECK, SECONDED BY VICE MAYOR GASS, THAT WE APPROVE THE AGREEMENT, SUBJECT TO CLARIFICATION. MOTION WITHDRAWN BY COUNCILMAN OBERBECK, SECOND WITHDREW BY VICE MAYOR GASS. GREG KISELA , REPRESENTATIVE, GENERAL DEVELOPMENT UTILITIES, STATED THAT A LETTER AND PROPOSED ORDINANCE WILL BE TRANSMITTED. MR. GREG KISELA, REPRESENTATIVE, GENERAL DEVELOPMENT UTILITIES, BRIEFLY REVIEWED THE CHANGES MADE TO THE FLORIDA FLOURIDATION RESOLUTION. THESE CHANGES WERE AS FOLLOWS: ~ THAT THE CITY OF SEBASTIAN APPLY FOR THE FLOURIDATION PROJECT GRANT, UPON EXPIRATION OF THE GRANT MONEY, FOR CHEMICALS AND MAINTENANCE, THAT GENERAL DEVELOPMENT UTILITY, INC. BE ALLOWED TO ADJUST WATER RATES TO OFFSET ANY INCREASE CHEMICAL AND MAINTENANCE COSTS ASSOCIATED WITH THE FLOURIDATION SYSTEM AND THAT THESE RATES WILL BE IMPLEMENTED UPON APPROVAL BY THE CITY OF SEBASTIAN. HE ALSO STATED THAT THE CITY CLERK IS DIRECTED TO FORWARD THIS RESOLUTION TO THE DEPARTMENT OF HEALTH AND REHABILITATIVE SERVICES OF FLORIDA WITHIN TWO WEEKS OF ITS ADOPTION AND IN ESSENCE, THE RESOLUTION WILL SERVE AS THE APPLICATION. AFTER SOME DISCUSSION REGARDING THE SAFETY OF FLOURIDATED WATER, DR. DERMONDY, STATED THAT HE SUPPORT FLOURIDATION 100% AND HIGHLY RECOMMENDS IT TO HIS PATIENTS. COUNCILMAN VOTAPKA REMARKED THAT HE HAS CHECKED INTO THE FLOURIDATION MATTER THOUROUGHLY AND THAT THE AMERICAN CANCER AND LUNG ASSOCIATION AND THE FOOD AND DRUG ADMINISTRATION ENDORSES THIS PROGRAM ALONG WITH MANY OTHER ORGANIZATIONS. ATTORNEY KILBRIDE READ IN ITS ENTIRETY A RESOLUTION AUTHORIZING THE CITY OF SEBASTIAN IN COOPERATION WITH GENERAL DEVELOPMENT UTILITIES CORPORATION TO APPLY FOR THE FLORIDA FLOURIDATION PROJECT GRANT AND TO IMPLEMENT AND MAINTAIN FLOURIDATION OF THE GENERAL DEVELOPMENT UTILITY WATER SYSTEM WITHIN THE CORPORATE CITY LIMITS OF SEBASTIAN, UPON RECEIVING GRANT FUNDING. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, TO ADOPT A RESOLUTION AUTHORIZING THE CITY OF SEBASTIAN IN COOPERATION WITH GENERAL DEVELOPMENT UTILITIES CORPORATION TO APPLY FOR THE FLORIDA FLOURIDATION PROJECT GRANT AND TO IMPLEMENT AND MAINTAIN FLOURIDATION OF THE GENERAL DEVELOPMENT UTILITY WATER SYSTEM WITHIN THE CORPORATE LIMITS OF SEBASTIAN, UPON RECEIVING GRANT FUNDING WITH THE CHANGES FROM OPTIONAL TO OPTIMAL IN THE SECOND WHEREAS AND THE FOURTH WHEREAS. REGULAR COUNCIL MEETING DECEMBER 8, 1982 IN RESPONSE TO VICE MAYOR GASS'S QUESTION, MAYOR FLOOD EXPLAINED THAT WE CAN STOP THE FLOURIDATION GRANT ANY TIME UP TO THE POINT WHERE GENERAL DEVELOPMENT UTILITIES ACTUALLY PURCHASES THE PROPER EQUIPMENT AND ENGAGES IN FINAL ENGINEERING. MOTION AMENDED BY VICE MAYOR GASS, THAT THIS RESOLUTION BE PUT ON THE BALLOT FOR MARCH ELECTION, AND LET THE PEOPLE DECIDE WHETHER THEY WANT FLOURIDATION OR NOT. MAYOR FLOOD STATED THAT THE BIDS FOR THE AIR CONDITIONING, ELECTRICAL AND SUSPENDED CEILING FOR THE OLD SEBASTIAN ELEMENTARY SCHOOL HAVE BEEN REVIEWED AND THEIR RECOMMENDATION WAS TO AWARD THE BIDS AS FOLLOWS: H.R.
