HomeMy WebLinkAboutR-25-28 Revised IRC Unified Local Mitigation StrategyRESOLUTION NO. R-25-28 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA.) ADOPTING THE REVISED INDIAN RIVER COUNTY UNIFIED LOCAL MITIGATION STRATEGY OF 2025; ADOPTION OF RECITALS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Federal Emergency Management Agency (FEMA) requires that all Hazard Mitigation plans must be reviewed and updated as appropriate, and resubmitted to Florida Division of Emergency Management (FDEM) for approval every five (5) years; and WHEREAS, Florida Division of Emergency Management (FDEM) has found the revised Indian River County Unified Local Mitigation Strategy of 2025 to be compliant with the federal mitigation planning standards, subject to formal community adoption; and WHEREAS, on July 15, 2025 Indian River County's updated Unified Local Mitigation Strategy (LMS) was adopted by the Board of County Commissioners via Resolution No. 2025- 031; and WHEREAS, the City of Sebastian desires to adopt the revised Indian River County Unified Local Mitigation Strategy of 2025, which is deemed in the best interests of the public health, safety and welfare of the citizens of the City of Sebastian. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SEBASTIAN, AS FOLLOWS: Section 1. ADOPTION OF RECITALS. The recitals set forth in the Whereas clauses above are hereby adopted as true and correct legislative findings and intent of the Sebastian City Council. Section 2. AUTHORIZATION. The Sebastian City Council hereby approves and adopts the revised Indian River County Unified Local Mitigation Strategy of 2025 as the official document for inclusion in the statewide Hazard Mitigation Strategy. Section 3. CONFLICTS. All Resolutions or parts of Resolutions in conflict are hereby repealed. Section 4. SEVERABILITY. The provisions of this Resolution are intended to be severable. If any provision of this Resolution is determined to be void or is declared illegal, invalid, or unconstitutional by a Court of competent jurisdiction, the remainder of this Resolution shall remain in full force and effect. Section 5. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of further action of City Council by filing a corrected copy of same with the City Clerk. Section 6. EFFECTIVE DATE. This Resolution shall take effect immediately upon its adoption.
