GASS, COUNCILMAN RICHARD VOTAPKA, COUNCILMAN GEORGE SCHUM, CITY ATTORNEY DANIEL KILBRIDE AND MAYOR PAT FLOOD, JR. ABSENT: COUNCILMAN FRANK OBERBECK, (EXCUSED ABSENCE) COUNCILMAN SCHUM READ A LETTER ADDRESSED TO THE COUNCIL, FROM THE CUB SCOUT PACK #589 EXPRESSING THEIR THANKS FOR THE FREE USE OF THE COMMUNITY CENTER AND THAT THEY WOULD ALSO BE AVAILABLE TO DONATE TIME AND EFFORT TO THE FOURTH OF JULY FESTIVITIES AND THAT THEY WOULD LIKE TO PARTICIPATE IN THE FOURTH OF JULY PARADE. MAYOR FLOOD STATED THAT PRIOR TO ANY ELECTED CITY OFFICIAL TRAVELING, A UNANIMOUS VOTE OF THE COUNCIL IS NEEDED AT A REGULAR CALLED MEETING AND SINCE COUNCILMAN OBERBECK IS NOT PRESENT, HE ASKED THE COUNCILS PERMISSION TO GO AHEAD AND ATTEND AN IMPORTANT ADMINISTRATIVE MEETING IN ORLANDO AT HIS OWN EXPENSE AND BE REIMBURSED LATER. MOTION BY VICE MAYOR GASS, SECONDED BY COUNCILMAN SCHUM, TO ALLOW MAYOR FLOOD TO ATTEND THE URBAN ADMINISTRATIVE MEETING IN ORLANDO, DECEMBER 16, 1982. MAYOR FLOOD STATED THAT HTIS MOTION IS OUT OF ORDER SINCE IT IS NOT IN COMPLIANCE WITH THE CITY CHARTER. MOTION WITHDRAWN BY VICE MAYOR GASS, SECON WITHDREW BY COUNCILMAN SCHUM. MAYOR FLOOD RECOMMENDED THAT ~ME-~O~S~D OF DIRECTORS BE REAPPOINTED. MOTION BY COUNCILMAN VOTAPKA, Sr, CONDED BY VICE MA~O~ GASS, THAT WE GO AHEAD AND REAPPOINT DAN MELIA TO THE GOLF COURSE BO~OF £IRECTORS F~RIA TWO YEAR TERM. MOTION CARRIED. MOTION BY COUNCILMAN VOTAPKA, SECOND~ V~AYOR GASS, TO REAPPOINT HARRY MORRIS, TO THE GOLF COURSE BOARD OF DIRECTORS FO~ ~ -tWO ~R TERM. MOTION CARRIED. MOTION BY COUNCILMAN VOTAPKA, SECOND~ V~ MAYOR GASS, TO REAPPOINT ARTHUR TROWBRIDGE TO THE GOLF COURSE BOARD OF DIRCTORS FOR A TWO YEAR TERM, ~APP~DON LININGSTON TO MOTION CARRIED. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, TO REAPPOINT GORDON CARLISLE TO THE GOLF COURSE BOARD OF DIRECTORS AS AN ALTERNATE MEMBER. MOTION CARRIED. THE CITY CLERK REPORTED THAT THE PLANNING AND ZONING COMMISSION WILL NOT BE MEETING UNTIL THURSDAY NIGHT, DECEMBER 16, 1982 AND REQUESTED TO INTERVIEW THE APPLICANTS FIRST, UNLESS THE COUNCIL WOULD PREFER TO APPOINT THEM. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY VICE MAYOR GASS, TO TABLE THE APPOINTMENTS TO THE PLANNING AND ZONING BOARD UNTIL THE NEXT REGULAR COUNCIL MEETING, JANUARY 12, 1983. MOTION CARRIED. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, TO BRING TO THE FLOOR THE APPOINTMENT OF GEORGE BRIGHTNER, TO THE CIVIL DEFENSE COMMITTEE. MOTION CARRIED. MOTION BY COUNCILMAN VOTAPKA, SECONDED BY COUNCILMAN SCHUM, TO APPOINT GEORGE BRIGHTNER TO THE CIVIL DEFENSE COMMITTEE. MOTION CARRIED. THE CITY CLERK READ A LETTER FROM MR. MILLER, REVEREND, CALVARY BAPTIST CHURCH, INDICATING THAT THEY WOULD LIKE TO PROCEED WITH THE CONSTRUCTION OF THEIR CHURCH, BUT UNTIL GENERAL DEVELOPMENT CORPORATION SENDS WRITTEN CONFIRMATION AS TO THE COMPLETION DATE OF STREETS AND WATER AND SEWER SERVICE IN THAT AREA, THEY CANNOT PULL ANY BUILDING PERMITS. REGULAR COUNCIL MEETING DECEMBER 15, 1982 MAYOR FLOOD STATED THAT AFTER SPEAKING TO GENERAL DEVELOPMENT CORPORATION TODAY, THEY INDICATED THAT THEY WOULD SEND CONFIRMATION, PROVIDING THEY DO NOT HAVE ANY PROBLEMS WITH THE DEPARTMENT OF ENVIRONMENTAL REGULATION SINCE THEY HAVE ENFORCED SOME NEW REGULATIONS. HE ALSO MENTIONED THAT SINCE CALVARY BAPTIST CHURCH WOULD LIKE TO PROCEED WITH CONSTRUCTION BY THE FIRST OF THE YEAR, THAT THE COUNCIL WOULD TAKE ACTION AT THAT TIME IF THE LETTER OF CONFIRMATION IS NOT RECEIVED FROM GENERAL DEVELOPMENT CORPORATION, THERE BEING NO FURTHER BUSINESS, MEETING ADJOURNED: 7:50 P.M. THE CITY CLERK READ THE NOTICE OF BID FOR THE PLUMBING IMPROVEMENTS IN THE SEBASTIAN SCHOOL HOUSE BUILDING WHICH IS BEING CONVERTED FOR USE OF THE CITY HALL, WHICH APPEARED IN THE VERO BEACH PRESS JOURNAL, DECEMBER 5 AND 12, 1982. THERE BEING NO OTHER BIDS TO BE TURNED IN, ATTORNEY KILBRIDE OPENED ONE BID RECEIVED AND READ AS FOLLOWS: MAXWELL PLUMBING, INC. PRESENT: VICE MAYOR EVERETT T. CASS, COUNCILMAN RICHARD VOTAPKA, COUNCILMAN GEORGE SCHUM, CITY ATTORNEY DANIEL KILBRIDE AND MAYOR PAT FLOOD, JR. ABSENT: COUNCILMAN FRANK OBERBECK (EXCUSED ABSENCE) MAYOR FLOOD STATED THAT THE PURPOSE OF THIS SPECIAL MEETING IS CONCERNING AN APPEAL REQUEST RECEIVED FROM MR. ROGER FLOWERS, 257 MAIN STREET, SEBASTIAN, FLORIDA, SINCE HE DISPUTES THE ALLEGATIONS OF VIOLATION OF SECTION 16-2 OF THE CODE OF ORDINANCES, CITY OF SEBASTIAN, AS SET FORTH IN A CERTIFIED LETTER DATED NOVEMBER 9, 1982. MAYOR FLOOD EXPLAINED THAT A COMPLAINT HAD BEEN RECEIVED REGARDING AN OVER GROWTH OF GRASS AND WEEDS TO A HEIGHT OF MORE THAN 10" ON LOTS 13, 15 AND 16, BLOCK 57, UNIT #2, SEBASTIAN HIGHLANDS AND THAT LOT 15 IS OWNED BY MR. ROGER FLOWERS. AFTER SOME QUESTIONS ASKED BY ATTORNEY KILBRIDE, MR. FLOWERS STATED THAT HE WAS OF THE OPINION THAT HE WAS NOT IN VIOLATIONS OF SECTION 16-2, SINCE THERE IS NO RECORD OF LOT 15 EVER BEING CLEARED OR MOWED AND THAT IT SHOULD NOT BE HIS RESPONSIBILITY TO MAINTAIN IT. FOR THE PURPOSE OF CLARIFICATION OF THIS ORDINANCE, ATTORNEY KILBRIDE EXPLAINED THAT ANY UNDEVELOPED LOT WITHIN THE CITY THAT HAS BEEN CLEARED OF ANY UNDERGROWTH, SUCH AS PALMETTO BUSHES OR PALM SCRUB AND NOT LIVED ON, MUST BE MAINTAINED BY THE PROPERTY OWNERS. HE STATED THAT IT IS IMMATERIAL WHETHER THE WEEDS OR GRASS HAS BEEN MOWED IN THE PAST. THE FACT IS THAT LOT 15, BLOCK 57, UNIT #2,~,~F~BAST_I. AN ~r. AN_DS~S BEEN CLEARED OF UNDERGROWTH IN THE \--I SINCE THE OWNER OF LOT 16 HAS COMPLIED WIT~ THE O~D~NANCE, COUNCILMAN VOTAPKA RECOMMENDED BE CHECKED FOR VIOLATIONS ALSCk.
