PRESENT: VICE MAYOR DOROTHY MCKINLEY COUNCILMAN RICHARD SZELUGA COUNCILMAN KENNETH ROTH COUNCILWOMAN LINDA KEENAN MAYOR JIM GALLAGHER CITY ATTORNEY THOMAS PALMER VICE MAYOR DOROTHY MCKINLEY LEAD THE COUNCIL AND AUDIENCE IN THE PLEDGE OF ALLEGIANCE TO THE FLAG. MAYOR GALLAGHER READ A PROCLAMATION RECOGNIZING THE EFFORTS OF THE SEBASTIAN 4TH OF JULY COMMITTEE AND PRESENTED IT TO HOWARD CARSWELL, WHO ACCEPTED WITH THANKS. ATTORNEY PALMER READ BY TITLE ONLY AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING ORDINANCE 0-81-8, DATED MAY 11, 1981, GENERAL DEVELOPMENT UTILITIES FRANCHISE: BY AMENDING SECTION 1 TO INCLUDE AN ADDITIONAL AREA: AND PROVIDING THAT SECTION 16, CONVEYANCE OF SYSTEM, CAN BE EXERCISED BY THE CITY AS TO THIS ADDED AREA WITHOUT EXERCISING SECTION 16 AS TO ANY OTHER AREA: PROVIDING AN EFFECTIVE DATE. MINUTES: PAGE 2 PUBLIC HEARINGS/REGULAR COUNCIL DECEMBER 19, 1984 IN RESPONSE TO A QUESTION FROM MR. ERNIE WALSH, MAYOR GALLAGHER ADVISED THAT G.D.U. HAS THE CAPABILITY TO MAINTAIN THE PRESSURE LEVEL AND SERVE THE SCHOOL WITHOUT ANY PROBLEM. IN RESPONSE TO A QUESTION FROM MR. JEWELL THOMPSON, MAYOR GALLAGHER ADVISED THAT THIS ORDINANCE RELATES TO SCHOOL PROPERTY ONLY AND A CLAUSE IS INCLUDED TO TERMINATE IF THE CITY SO DESIRES. THERE BEING NO OTHER COMMENTS, MAYOR GALLAGHER CLOSED THE PUBLIC HEARING AT 7:14 P.M. THE COUNCIL WAS ASKED TO APPROVE CORRECTED PAGES 3 AND 8 TO BE INSERTED INTO THE RECENTLY ADOPTED RESOLUT, I~NO~84-43 PERTAINING TO THE DEVELOPMENT NEW VERBIAGE INTO THE DEVELOPMENT ORDER. MAYOR GALLA OM D U ENAN FOR T D R~, SHE AND MAYOR GALLAGHER RECOMMENDED THAT THE CITY PURCHASE SPACE AT A COST OF $5,000.00. ON THE COMMUNICATIONS TOWER BEING ERECTED BY THE COUNTY AT HOBART PARK. THE TOWER WILL BE MAINTAINED BY THE COUNTY. THE CITY WILL HAVE TO PURCHASE AND MAINTAIN THEIR OWN EQUIPMENT ON THE TOWER. MOTION BY VICE MAYOR MCKINLEY, SECONDED BY COUNCILMAN SZELUGA, THAT $5,000.00 BE PAID TO THE COUNTY FOR THE TOWER. ROLL CALL VOTE: A YES: NAYS: VICE MAYOR MCKINLEY COUNCILMAN SZELUGA COUNCILMAN ROTH COUNCILWOMAN KEENAN NONE MOTION CARRIED. MAYOR GALLAGHER ANNOUNCED THAT THE LABOR ATTORNEY HAD ADVISED THAT ALL RETIRED CITY EMPLOYEES COULD PARTICIPATE IN THE CITY'S HEALTH INSURANCE PROVIDED THEY PAID THEIR OWN PREMIUMS. THOSE INDIVIDUALS CONCERNED HAVE BEEN SENT NOTICES. MAYOR GALLAGHER ADVISED THAT THE PIECE OF PROPERTY NORTH OF THE PUBLIC WORKS COMPOUND ON LOUISIANA AVENUE WAS FOR SALE AT A COST OF $52,000.00. HE STATED HE DID NOT SEE ANY ADVANTAGE TO THE CITY BUYING IT AND THE COUNCIL CONCURRED. MAYOR GALLAGHER ADVISED THAT IT WOULD COST $1,412.00 FOR 25 CITY FLAGS. HE SUGGESTED THAT THERE MIGHT BE INDIVIDUALS WHO WOULD LIKE TO FLY A CITY FLAG AND IF FIFTEEN (15) WOULD EACH BUY ONE, THE CITY WOULD PAY FOR THE REST. HE ADDED THAT THE FLAGS WOULD FIRST BE FLOWN OVER CITY HALL. PRICE FOR ONE FLAG IS $56.50. ATTORNEY PALMER READ FOR THE FIRST TIME BY TITLE ONLY AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING SECTION 4-2 OF THE CODE OF ORDINANCES, AND THEREBY PERMITTING THE SALE OF ALCOHOLIC BEVERAGES BETWEEN THE HOURS OF 7:00 A.M. and 1:00 P.M. ON SUNDAYS, AND PERMITTING THE SALE OF ALCOHOLIC BEVERAGES FROM MIDNIGHT TO 1:00 A.M. ON SUNDAY NIGHTS; ALSO EXTENDING THE HOURS FOR THE SALE OF ALCOHOLIC BEVERAGES TO 3:00 A.M. ON THE EARLY MORNING HOURS OF JANUARY 1; PROVIDING AN EFFECTIVE DATE. AND 1:00 P.M. ON SUNDAY, AND PERMITTING THE SALE OF ALCOHOLIC BEVERAGES FROM MIDNIGHT TO 1:00 P.M. MAYOR GALLAGH~R STATED HE WAS AWARE THAT SOME RELIGIOUS LEADERS IN THE CITY ARE CONCERNED AND THEY WILL HAVE A CHANCE TO BE HEARD AT THE PUBLIC HEARING TO BE HELD ON JANUARY 16, 1985. ATTORNEY READ A RESOLUTION PERMITTING THE SALE OF ALCOHOLIC BEVERAGES UNTIL 3:00 A.M. ON NEW YEAR'S DAY. MOTION BY COUNCILMAN ROTH , SECONDED BY COUNCILMAN SZELUGA, TO ADOPT A RESOLUTION PERMITTING THE SALE OF ALCOHOLIC BEVERAGES UNTIL 3:00 A.M. ROLL CALL VOTE: AYES: NAYS: MEETING ADJOURNED AT 7:40 P.M.
