The Mayor called the Regular City Council meeting to order at 7:00 p.m. 2. The Pledge of Allegiance was recited. 3. Father John Morrissey of St. Sebastian Catholic Church gave the invocation. 4. PROCLAMATIONS, ANNOUNCEMENTS AND/OR PRESENTATIONS 02.056 A. Senior Housin~ Proposal Presentation from Finley Properties The City Manager gave a brief introduction on the proposed facility in the area of the new Publix. Christopher Ferguson, Finley Properties described the proposed 96 unit senior housing facility on a 10.9 acre site on Barber Street with rents in the range of a Iow of $305 to a maximum of $485. He sought local support to assist him in the application process, stated he feels there is a need for this type of facility in Sebastian, and described the application process to the Florida Housing Finance Agency. He said he is seeking any assistance that can be credited toward the $75,000 needed such as deferral of fees or other creative avenues, such as waiver of impact fees. The City Manager said he was seeking direction from Council and if directed would come back with a report as to how the City can assist Finley Properties. Mr. Ferguson said they are obligated to provide this as an affordable housing facility for fifty years, and inquired whether members of Council might be willing to contact Indian River County officials advising of their action. The Mayor said at the very least a letter could be mailed to the County. Mr. Ferguson said April 18th, 2002 was the application deadline. It was the consensus of Council to direct the City Manager to work with Finley and send a letter to Indian River County. 02.047 B. The Sebastian Clambake River Festival The City Attorney presented a proposal to hold an annual fall Sebastian Clambake Lagoon Festival (see distributed literature attached). City Council discussion followed relative to parking, possible use of the shopping center north of the city limits for parking, the board of directors membership. It was the consensus of City Council to allow use of the park and work out an agreement with the newly formed non-profit group. Mayor Barnes read and presented the proclamation to Public Works Director, Terry Hill. CITY ATTORNEY MATTERS None. CITY MANAGER MATTERS A. Introduce Dave Fisher, New City En,qineer The City Manager formally introduced David Fisher to City Council, noting he was a former City interim Public Works Director approximately twelve years ago. Mr. Fisher announced that he was ready to be part of the team and invited citizens to contact him. B. Clarification Relative to Police Crime Scene Investigator The City Manager clarified that there has never been funding for a crime scene investigator in the City, however there is an evidence technician. The Chief of Police explained the function of the Identification/Property Evidence Technician (a copy of the job description was distributed and is attached to these minutes). CITY CLERK MATTERS Congratulated Mayor Barnes, Mr. Hill and Mr. Coniglio on their re-election. CITY COUNCIL MATTERS A. Mr. Hill · Congratulated all candidates for a well run campaign. · Noted an award to Captain Hirams for a clean marina. B. Mr. Coni.qlio · Reported that the EPA gave the award to Captain Hirams, a very stringent award. · Agreed the election was well run. · Noted the SRHS band will play in the park on Thursday night. 02,057 Regular City Council Meeting March 13, 2002 Page Four C. Mayor Barnes Said he was asked by a builder to change setbacks to 15 feet on one side of corner lots and asked the Building Director to report back. The City Manager said Mr. Bonacci would be in attendance at the March 27, 2002 meeting and could address it at that time. The City Attorney advised the setback is a visual issue. D. Mr. Barczyk 1. Discuss State Legislature Activity on State Sales Tax and Direct Staff Accordingly Mr. Barczyk withdrew this matter. Other Matters · Reported at the March 5th, 2002 Indian River County Commission that they adopted a building code ordinance for new homes relating to 140 mph wind. · Also at the March 12th indian River County Commission meeting there was discussion of a tree ordinance which will come back to the commission in the future. · Noted that at the next Commission meeting wireless communication towers will be discussed. E. Mr. Ma~ Thanked all candidates who ran in the election. 11. CONSENT AGENDA All items on the consent agenda are considered routine and will be enacted by one motion, There will be no separate discussion of consent agenda items unless a member of City Council so requests; in which event, the item will be removed and acted upon separately. Regular City Council Meeting March 13, 2002 Page Six Mayor Barnes opened the public hearing at 8:02 p.m, the City Attorney read Resolution No. R-02-09 by title, and the City Clerk swore in all those who intended to offer testimony. Joe Schulke, P.E., Schulke, Bittle & Stoddard, LLC, presented the application for approval of preliminary development plan for Phase II of Park Place PUD-MH Subdivision. The Growth Management Director briefly described the project and recommended approval as requested. City Council discussion followed regarding the emergency access and impact to Barber Street. Carolyn Corum, Dolores Street, questioned off-site drainage, and Mr. Schulke responded to her question by showing her on the drawings how the treated drainage flows ultimately ending up in the Indian River. Mr. Schulke said the phasing will take approximately five years. Being no further input, Mayor Barnes closed the hearing. MOTION by Barczyk/Hill "1 move to adopt Resolution No. R-02-09." INTRODUCTION OF NEW BUSINESS FROM THE PUBLIC Item that has occurred or was discovered within the previous ~ix months which is not otherwise on the agenda - sign-up required, limit of ten minutes for each speaker Herbert Sturm, 549 Saunders Street, Sebastian, discussed the Code Enforcement Board order process, and said, in his opinion current orders do not comply with the code. He further stated that the City Council can appeal decisions of the Code Enforcement Board and read from Attorney General Opinions relative to Code Enforcement. Mayor Barnes said a staff meeting will be held regarding code enforcement orders. Herbert Munsart, 1464 Seahouse Street, Sebastian, pointed out to Council that allowing a special use permit on CR512 for a car wash was a direct violation of the 512 overlay district provisions, and urged that special use permits be carefully considered in the future. Mayor Barnes called recess at 8:33 p.m. and reconvened the meeting at 8:45 p.m. All members were present. MOTION by Majcher/Barczyk "1 move to approve the selection and ranking of the engineering firms as shown on the attached finalist evaluation and ranking matrix as recommended by the consultant selection committee and authorize staff to start contract negotiations with the number one ranked firm WCG, Inc., Vero Beach, FL and should those negotiations fail, negotiate with the number two ranked firm and so forth." Schedule) The City Manager sought approval to contract with Ranger for road resurfacing. He advised that this will close out the Ranger contract and further resurfacing until rebidding. ROLL CALL: Mr. Majcher - aye Mr. Hill - aye Mr. Coniglio - aye Mayor Barnes - aye Mr. Barczyk - aye MOTION CARRIED 5-0 02.019 Approve Change Order #1 with Kimley-Horn & Associates in the Amount of ~.1. 0,550.00 for a Feasibility Study Pertaining to the Pier/Boat Dock Facility Project (GSA Transmittal 3/1/02, Change Order) The City Manager briefly described the feasibility study for the pier/dock facility. Jeff Mullis, Kimley-Horn & Associates addressed Council and introduced Mike Keifer, marine specialist. Mr. Keller said as he looked at the existing facility and advised that perhaps the city should take a step back and consider what it wants to build by conducting the feasibility study. Mr. Keifer responded to Council's questions. Wally Kramer, Micco, expressed concern for the people of Sebastian, and suggested a fishing pier, a boardwalk, leased out small restaurant, docking for restaurant customers, sandy beach, rental boats, and sailboats. Damian Gilliams, Sebastian, asked who is going to benefit from taxpayers money. He noted that the city would not pay taxes for a marina but that private marina owners would pay taxes. He urged that the area be kept recreational as it was intended. Carolyn Corum, Dolores Street, Sebastian, objected to the city building a marina, noting the community will be watching. TAPE II - SIDE I (9:17 p.m.) Herbert Munsart, 1464 Seahouse Street, Sebastian, did not agree with a marina concept, and urged Council to consider it carefully. Mayor Barnes said this is only a step in the process to determine whether or not a marina is a good idea and that public input will be heard before any decisions are made. The City Manager stated the city is committed to implementing greenery spaces and shoreline stabilization as referred to by the public speakers through a pending grant application. To earn it, marina staff must attend a daylong workshop to learn the Clean Mar/na requirements. Then they perform a self-audit of their marina and draw up plans to implement the requirements of the program. The employee in this position will respond to crime scenes to assist in the processing, photographing, collection and preservation of evidence for crime analysis and court presentation. Employees are responsible for the transporting of evidence and property to a secured facility, maintaining records for chain of custody, and maintaining the integrity of evidence according to established Florida State Statutes. Position may require appearance in court for formal reporting, questioning and/or testifying with regard to evidence and property collected. Performs related work as directed. Duties and Responsibilities Essential Functions Responds to calls for service and processes crime scenes. Must be knowledgeable in the use of photographic equipment in the processing of crime scenes. Takes into custody evidence and property for further laboratory analysis i.e., intake, security, storage, chain of custody. Packages evidence/property according to Florida State Statutes and department procedures. The technician is required to classify, according to accepted methods, rolled sets of fingerprints taken of arrested persons, applicants and anyone else whose prints come into the department's custody. Completed classifications are posted both to fingerprint cards and an index card which is forwarded for filing. Coordinates and prepares for the disposal of evidence through general destruction, returning to owner and/or auctions; responsible for the preparation of the necessary paperwork concerning evidence disposal. Processes hazardous materials/waste in compliance with established regulations and procedures. Responsible for overseeing the property room with regard to inventory, filing, storage, preservation of evidence taken into custody by police department personnel. Responsible for the preparation of various reports, records, forms, and receipts, i.e., property receipts, release forms, transfer forms, etc. Maintains the necessary case files of all reports, receipts and documents processed and enters data into the departments computer system. Responsible for the safe receipt, examination, organization, and inventories of various weapons; responsible for the disposal of all weapons as directed by the Chief of Police or designee. Assists police personnel and law enforcement agencies with general information and inquiries concerning submission of evidence and/or property. Marginal Functions Assists and performs various administrative support tasks in supporting the department as needed. Performs related duties as directed. Minimum Trainina and Experience High school diploma or equivalent; along with basic fingerprint training presented by a recognized CJSTC training facility or law enforcement agency; FBI Latent Fingerprint Examination School preferred; supplemented by minimum two (2) years previous experience in a law enforcement agency in crime scene or a judicial process agency that provides broad general knowledge of criminal justice systems and procedures; supplemented by experience in supply or inventory warehouse work; or an equivalent combination of education, training, and experience. Special Requirements Must possess a valid State of Florida Ddver License at the time of appointment and throughout employment. The ceremonial bonfire, which shall bum throughout the festival, will be lit on the beach near the historic campsite of the Spanish treasure ship cast-aways, and transported over water by our Clambake pirate crew for the opening festivities; Fishing Tournament: Redfish, snook, speckled trout and those clam-loving sheepshead will be the targets in a unique tagged fish tournament that not only offers prizes for the biggest of species and the best grand slam, but also a chance to win a grand, prize of $25,000 to anyone lucky enough to catch our very special fish; special children's categories win prizes, too! Musical Bands: Entertainment along the shores of the tranquil indian River Lagoon at the new SouthPointe addition to Riverview Park, from rock 'n roll to local marching bands to gospel; Boat Show: Local dealers present the latest models of vessels and gear for public viewing along Indian River Drive; Carnival: A long-time Sebastian tradition once lost is now restored as the kids and the kids-at- heart thrill at the Rides and Midway along the River in the shadow of the Millennium Clock; Biergarten: Adults can put a little ooohm-pah-pah to the music with draft beer on the tap in our tented Biergarten across the street from the musical venue; Pelican island Boat Tours: Ride along the Lagoon for a close view of the nation's first wildlife preserve, set aside by President Teddy Roosevelt in 1903; The Clambake Challenge Regatta: Majestic sails glide along the Lagoon as local sailors test their skills in a first-of-its-kind event in the County; Educational Displays: Stroll under the oaks and learn more about the history of the Sebastian Fishery, efforts to improve water quality in the Lagoon, manatee protection, and more; The Clammer-Slammer Volleyball Tourney: Beach volleyball competition comes to the Park! Handicapped~ViP Parking- Southwest portion of SouthPointe DIE Sebastian Clambake PURPOSE ,The Clambake seeks to build community spirit by focusing attention on the Indian River Lagoon and its importance to life in the Sebastian River area, both in the past and at present. The events featured in the Festival bring together the diverse interests that make the Lagoon an essential facet of the Sebastian lifestyle. Our vibrant fishing community is recognized in its recreational form through a uniquely modem-day tournament, while the importance of the local commercial fishery in the development and history of the area is honored. The Clambake Regatta and the Boat Show reflect the draw that boating in all its forms has for our citizens, whether they are retirees making Sebastian the home of their golden years or third-generation Florida Crackers. The Concerts and Carnival highlight the growing importance of the expanded Riverview Park as a center for community fun and entertainment. Finally, the Bonfire & the Clambake, like those remembered from the Long Island and New England childhoods of so many of our residents, seem to bring an endless offering of the delectable bounty of the sea! But it's not just about good times and good food The Clambake is organized by The Sebastian Clambake Foundation, a non~profit corporation that coordinates with area public service organizations and our business community to have a positive impact on our quality of life. Each year the Executive Committee of the Foundation will pick a local charitable or public-purpose project to receive the proceeds of the Clambake. For the first year we have committed to helping the Boys & Girls Club of Sebastian with their New Facility Capital Fund.
