Mayor Barnes called the Regular Meeting to order at 7:05 p.m.
The Pledge of Allegiance was recited.
Rev. Bob Shields of Alliance Community Church gave the invocation.

Mayor Barnes added the Employee of the Quarter presentation under Presentations.

Representative Mayfield was not in attendance.
B. Employee of the Quarter
Mayor Barnes presented the Employee of the Quarter certificate to Genevieve Murray.
CITY ATTORNEY MA-I-rERS
Reported that he attempted to attend the August 7, 2001 Indian River County
Commission meeting regarding the Kirrie project but arrived after the fact and Mayor
Barnes represented the City.
Advised that the land use plan amendment ordinance scheduled for adoption tonight
can be acted upon since it does not become effective until the school siting policy is
adopted.
Noted that the TRIM notices going out will include the preliminary assessment for all
properties, and that vacant properties will be adjusted at a later time.
Said staff members would address any public groups to give information on the
stormwater utility if requested
Requested authorization for attendance at the Florida League of Cities Conference.

A. Announce Public Workshop for Stormwater Utility
Reported on a staff public information workshop on the stormwater utility at council
chambers on Tuesday, August 21st, 2001 at 6:00 p.m.

CITY CLERK MATTERS
The City Clerk requested permission for her attendance with the Deputy City Clerk at a Florida
Association of City Clerks session at the Florida League of Cities conference on the afternoon
of August 24, 2001.

of City on the August 24th tO attend the City Clerk Association."

The City Clerk reported that she and the deputy would join the newly formed Indian River
County Clerks Association which will meet on a monthly basis with guest speakers,
CITY COUNCIL MATTERS
A. Mr. Hill
Attended the MPC meeting this morning and in the approved improvements plan,
$240,000 enhancements for CR512 were identified. Mr. Hill noted the City will have to
compete for this funding in the Spring.

Reported on the Indian River County Commission meeting and the two agenda items
which pertained to Sebastian-Dodgertown and the Kirrie project.
Suggested a workshop prior to a City Council meeting to discuss recreation issues as
copied to Council by the City Clerk's office on August 22, 2001 at 6 pm.
Announced the Keep Indian River Beautiful Arts and Craft Show September 8th and
9th, 2001 at Riverview Park from 10:00 am to 5:00 pm.
Announced the September 15. 2001 coastal cleanup also sponsored by Keep Indian
River Beautiful,
Noted some new home construction sites need container to hold debris.

Announced the first public hearing on the budget has been rescheduled for September
6, 2001 at 7:00 p.m. at the council chambers, due to conflicting dates with Indian River
County.
With consensus of Council, the riverfront plan workshop was scheduled for August 29,
2001 at 7:00 p.m.

Discussed Schumann Dr. median problems - dead and overgrown plants.
Discussed a resident using a RV for storage on her property, 2 boats parked, business
truck, two other trucks with two additional cars, and said he would like code enforcement
to look into this residence.
Described last Saturday's problem at Barber Street Sports Complex with people parking
on grass and in driveways during the football games at which an ambulance did not
have access to respond to an injury. He also described a great deal of trash left at the
Complex that day.
Noted that the City has given authorization for a permit for someone to live in their RV
which is parked on their construction site while their home is being built.

AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING CODE OF ORDINANCES TO
CREATE SECTION 50-54 CERTAIN MULCH MACHINES PROHIBITED; PROVIDING FOR CONFLICTS,
SEVERABILITY, AND EFFECTIVE DATE.
Mayor Barnes opened the public hearing at 7:35 p.m.; and the City Attorney read
Ordinance No. O-01-17 by title.
The City Manager stated this ordinance is in response to Council's direction to ban
mulching machines in the City.
Being no input, Mayor Barnes closed the public hearing at 7:36 p.m.

Mayor Barnes opened the public hearing at 7:38 p.m. and the City Attorney read

The Growth Management Director described the proposed voluntary annexation of the
County enclave. He responded to questions from Council regarding access to the
property.

AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, APPROVING AN AMENDMENT TO THE
COMPREHENSIVE PLAN WHICH AMENDS THE FUTURE LAND USE MAP TO DESIGNATE INITIAL
LAND USE CLASSIFICATION OF MEDIUM DENSITY RESIDENTIAL (MDR) FOR ANNEXED LAND WITH
A PRIOR COUNTY LAND USE DESIGNATION AS LOW DENSITY RESIDENTIAL, 6 UNITS PER ACRE (L-

Mayor Barnes opened the public hearing at 7:43 p.m. and the City Attorney read
Ordinance No. O-01-09 by title.
The Growth Management Director responded to questions from Council regarding
commercial usage within the PUD as recommended by Treasure Coast Regional
Planning Council, noting that during the conceptual phase it is too early to tell whether
this will be implemented.
Charlie Stachel, asked if the developer could take advantage of the allowed eight units
per acre allowed by medium density and the Growth Management Director responded
that the designation is medium family residential. The Growth Management Director
further explained that with maximum buildout it will be tough to go past six units per
acre. The City Attorney stated that any change to the conceptual plan will have to be
done by ordinance.

WITH A PRIOR COUNTY ZONING DESIGNATION AS AGRICULTURE (A-l) FOR LAND CONSISTING OF
EIGHTY (80) ACRES, MORE OR LESS, BEING A PART OF SECTION 18, TOWNSHIP 31, RANGE 39;
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
Mayor Barnes opened the quasi-judicial public hearing at 7:48 p.m. and the City
Attorney read Ordinance No. O-01-10 by title, and described a proposed amendment as
follows: "Section 2, in accordance with the attached Conceptual Development Plan,
including the 4 conditions recommended by the planning and zoning commission." The
City Attorney advised this amendment should be included in the motion.
Brian Davis, applicant, and Tracy Hass, Growth Management Director, were sworn in
and the applicant briefly addressed Council. Mr. Davis asked where the main
thoroughfare would be located. The City Attorney responded that this would be
addressed at each phase and what each traffic analysis would determine.
The Growth Management Director gave staff presentation. This development would be
single family homes lining the existing perimeter, expanding the Highlands.
Maureen Murphy asked if there would be an access from South Moon Under and when
told there would not, she said she was in favor.
The applicant had no further input.

INTRODUCTION OF NEW BUSINESS FROM THE PUBLIC
Item that has occurred or was discovered within the previous six months which is not othe~vise on the agenda -

Carolyn Corum expressed concern for the Schumann Drive median; inquired when netting will
be installed at the Barber Street Sports Complex baseball fields to protect people on the
bleachers.
Sal Neglia expressed concern for work being done on city restrooms. The City Manager said
he will clarify these issues in his next report to City Council, Mr, Barczyk asked if the police
patrolled these restrooms.
Charlie Stachel, Coral Reef Street, Sebastian, suggested that CR512 be renamed Sebastian
Rivers-Indian Rivers Parkway and asked that it be included in the Pelican Brief for vote of the
public; and read a prepared statement regarding his recommendation on stormwater
assessments for unimproved lots.
