B. CITY ATTORNEY MATTERS Reported on the Fischer case mediation, noting there is an offer to settle on the table in the amount of $300,000. He advised that from a legal standpoint there is no strong basis for the claim, and noted that the Florida League of Cities attorney also recommends the City does not settle. It was the consensus of City Council to follow the advice of the City Attorney. Reported that the personnel matters ordinances will be on the next agenda. CITY MANAGER MATTERS A. Report on Indian RLY~r County Census 2000 Corllllltlllity Action Committc~ (,.Qinn Letter 7/22/99) The City Manager said Indian River County was looking for support from staff members as well as the public, and advised that he will attend the first meeting in September along with members fi.om staff He said Council can also select someone from the public to attend. Other Matter~ The City Manager stated that two City Council members have expressed interest in attending upcoming presentations on grants; and discussed concerns expressed by certain members of the public, Council and staff relative to Sunshine Law matters. He said it is common practice and appropriate for multiple members to attend these types of functions; then sought direction from Council. Mayor Wininger stated that members who are going to represent the City should be appointed by the City Council, and requested a City Attorney opinion on members traveling together. The City Manager requested direction from Council on the August Indian River County and September Tallahassee presentations. Ot3qr Matters Discussed a letter from the governor regarding "Front Porch Florida" and asked the City Clerk to provide a copy of the letter to each Council member and then the City Manager can report on whether the City could participate Expressed concern for critical remarks made by staff and Planning and Zoning about Council, advising if nothing good could be said nothing should be said Gave a letter to the City Attorney regarding a sandmine being constructed in the county abutting the City of Sebastian, and inquired whether City resident abutters would receive notification Noted that the City is getting a lot of publicity on the water restriction, and that the County has no restrictions. (First Reading 7/14/99, Advertised 7/28/99, Public Hearing & Adoption 8/11/99) Mayor Wininger opened the public heating at 7:43 p.m. and the City Attorney read Ordinance No. 0-99-05 by title. ]TAPEI- SIDE II (7:48 p.m.) Ruth Sullivan, Indian River Drive, Sebastian, opposed the removal of the cap. Larry Paul, Sunset Lane, Sebastian, suggested phasing in a tax of 3 or 5%, and questioned the justification for the removal of the cap. The City Manager responded to concerns by explaining the reasons for the removal of the cap, the current requirement for the 10% tax, and proposed millage reduction. The Finance Director presented an analysis (see attached), noted that cable and sewer do not have a utility tax; and the City Manager concluded that the cap is illegal and reiterated that the removal of the cap will benefit the entire community by reducing property taxes.
