City of Sebastian POST OFFICE BOX 780127 [] SEBASTIAN, FLORIDA 32978 TELEPHONE (407) 589-5330 PUBLIC I~ OF SEBASTIAN ~Ma~N STREET INDIAN RIVER ~ FLQRIDA The Board of Adjustment of the City of Sebastian, Indian River County, Florida, will conduct a Meeting on Tuesday, June 7, 1988, at 3:00 P.M. in Council Chambers located at 1225 Main Street, Sebastian, Florida, to consider a Variance from the City of Sebastian Land Development Code, Section 20A-15.4 (c) (3) (d) (h) and Section 20A-15.8 (a) (3). St. Elizabeth's Episcopal Church of 901 Clearmont, Sebastian, Florida, have requested two (2) sign variances, each being the total of 38 square feet whereas the ordinance allows one sign per street frontage with a maximum of twenty (20) square feet. ROLL CALL Present: Joseph Stephenson Walter Shields Mary Heinicke Gale Matthews Louis Priore ( Arrived at 3:05 P.M.) Also Present: Bruce Cooper, Building Official Paul Kreuzkamp, Jr., Asst. City Attorney James Husk, Alternate 3. Chairman Matthews led the Pledge of Allegiance. 4. APPROVAL OF MINUTES - Minutes of May 3, 1988 MOTION Stephenson/Heinicke I move we accept the minutes of May 3, 1988 as presented. Voice Vote unanimous Motion carried. 5. PUBLIC HEARING - St. Elizabeths Episcopal Church - Sign Variance Chairman Matthews asked the St. Elizabeths Episcopal Church representative to come to the podium and state his case. Mr. Curt Oxford representing St. Elizabeths Episcopal Church stated that the City of Sebastians code allowed them three (3), two sided twenty (20) square foot signs, one on each side of the property with frontage. What they are requesting is two (2), one sided signs at thirty two (32) square feet, one facing Biscayn and one sign facing Clearmont to be joined at the corner. He continued by stating that if they were to use all the square footage allowed by the code, they were entitled to one hundred and twenty (120) square feet of signage but were only requesting to use sixty four (64) square feet maximum and would waive the other footage allowed. Mr. Oxford also stated that the Church had already purchased the two (2) thirty two (32) square foot signs that they were trying to salvage. Mr. Bruce Cooper explained the code to the members of the Board and stated that he did not feel that this case met the criteria to grant a variance. Ms. Heinicke mentioned the future growth of the area as it is zoned commercial. She questioned whether the sign as allowed by the code could be seen in the future. Motion Heinicke/ I move we consider the distance from Highway #512 for viewing the sign as a hardship in this case. Motion died for lack of a second Motion Shields/Stephenson I move that based on the evidence presented, there is no finding that a hardship exsist. Roll call: Joseph Stephenson Louis Priore Walter Shields Gale Matthews Mary Heinicke - Aye - Aye - Aye - Aye - Nay Motion carried 4-1 Motion Stephenson/Shields I move we deny the variance. Roll call: Joseph Stephenson Louis Priore Gale Matthews Mary Heinicke Walter Shields - Aye - Aye - Aye - Nay - Aye Motion carried 4-1 Mr. Cooper explained to Mr. Oxford that he had 30 days to appeal the decision by the Board. Mr. Cooper explianed that the City of Sebastian had aways waived the fees for churches and recommended that the Board recommend to the City Council that a waiver of the variance application fee of one hundred dollars ($100.00) be granted in this case, as fee waivers are given to Churches in all other areas such as permits, site plans, ect. Motion Heinicke/Stephenson I move we recommend to the City Council that a variance application fee of $100.00 be waived for the St. Elizabeths Episcopal Church. Voice vote on the motion carried unanimously 6. CHAIRMANS MATTERS None 7. COMMITTEE MATTERS None 8. BUILDING OFFICIAL MATTERS Mr. Cooper discussed the 1988 - 1989 fiscal budget with the Board concerning attorney fees, nameplates, seminars, bulletins, etc. The Board was not interested in name plates. The Board expressed interest in the Zoning Bulletin magazine. Mr. Cooper stated that he would furnish the Board copies of this publication. Motion Heinicke/Shields I move we adjourn Voice vote unanimous 9. The meeting was adjourned at 3:55 P.M. 3
