NEW BUSINESS PUBLIC HEARING: Eugene Popow. General Manager of Sebastian Center, Ltd.. in Regards to a Property. Located at 1627 U.S. 1. Is Requesting a Variance from Section 20A-8.2(13) of the Land Development Code to Reduce the Parking Requirements for a Medical Doctor to 3.465 Spaces (One Space for Every_ 200 Square Feet of Gross Building Area), Whereas the Code Requires 15 Spaces (Ten Spaces Per Doctor and Five Spaces Per Mayor Firtion opened the quasi-judicial hearing at 6:33 p.m. The Zoning Technicial presented the variance request on behalf of staff, noting that Dr. Bambrick had been practicing in that building since last year when he was denied an occupational license for not meeting the parking requirements. She said staff had been working with him and the building's owners to remedy the problem and stated that a variance seemed to be the only solution. Eugene Popow, 952 Schumann Drive, Sebastian, explained that this was a part-time office, said that a parking survey conducted shows more than sufficient parking, and that the original tenant in that same office was a medical doctor. Mrs. Damp noted that Dr. Bambrick was affiliated with the rehabilitation center, a current occupant. Mr. Halloran inquired whether the driveway to the rear of the building could be used for parking and suggested that no other variances of this type be addressed until the code is revisited. Vice Mayor Corem suggested that the building's owners seek additional parking adjacent to their property to alleviate any future problems with medical offices. Mr. Popow said his tenant would be willing to stay with the same number of hours. 2 Board of Adjustment Meeting September 27, 1995 Page Three TAPE I - SIDE II (7:00 p.m.) Mr. Popow stated he had a management office in the building which is 697 square feet and usually staffed by one person, stated that his hardship relates to the fact that the way the parking lot is configured relative to the building prevents him from constructing additional parking and that the original building did house medical offices. He said if denied his tenant would vacate the building to be able to obtain an occupational license. MOTION by Cartwright/Comm I'd like to move that we grant a variance to reduce it down from the requirement to five parking spaces. The formula I used is one per 200 square foot, which is four and one for the employee or the doctor and I'm going to base this on the fact that 1) we have a mixed use building 2) our present ordinance is in the process of being reviewed and revised, our present ordinance is very restrictive and the hardship I believe would be that the loss of income, rental income, and the restrictive use of his building. He can only rent at this point to people who can only use four spaces, so based on all of the above I'd like to recommend five. Vice Mayor Corem noted the applicant said he would adhere to the current hours of operation. Mrs. Cartwright included in her motion that "the same number of hours and days" be adhered to. Mayor Firtion closed the public hearing at 7:10 p.m. Mr. Halloran suggested that Council grant a 180 day variance to allow the applicant to continue pending any code revisions. "To grant a temporary variance not to exceed 180 days" was added to the motion. Vice Mayor Corem concurred. Whereas the Code Requires the Septio System to Be Placed in the Front or Rear Yard. Building Line or Within the Rear Yard. Mayor Firtion opened the quasi-judicial hearing at 6:34 p.m. The Director of Community Develop~nent presented the request and recommended approval. He said he felt the code needs to be relaxed somewhat relative to placement of septic systems for these types of developments. Randy Mosby, Mosby and Associates, spoke on behalf of the applicant, stating that HRS appr°val had been obtained. Vice Mayor Corum expressed concern for what she perceived as a lack of open space. MOTION by Cartwright/Halloran I move to approve the request and grant the variance. The Director of Community Develop~nent suggested the motion be based on fmdings of fact and reiterated that the subject property is abnormally large for the intent of the ordinance and does not have a deu'imental affect nor an immediate impact on neighboring properties by the granting of the variance.' The Sebastian Center is located at 1627 U.S. 1. it' is an existing two story building renting office and retail spaces. Please note that we are not increasing the size of the building, aItering the parking lot or 'making any other changes to the building or the parking Iot. The site plan remains the same as was originally approved prior to construction of the building. Some time ago, we rented one bay to Dr. Bambrick to operate a part time Orthopaedic Office. His main office continues -to be in Palm Bay. Dr. Bambrick was not successful in obtaining an occupational license because tl~e building apparently does not satisfy the current parking code for Medical Offices. We are requesting a variance so that Dr. Bambrick can remain in the Building. In support of our request we would point out that neither the building nor the parking lot has changed since it was originally approved and constructed. The original occupant of the space being used by Dr. Bambrick' (as well as the remainder of the ~est side of the building) wasa medical office. Dr Bambrick is occupying the building on a part time basis. His office is open= Monday 9:00 ~.M. to 12:00 P.M.; Mednesday 2:00 P.M. to 4:30 P.M. and Friday 9:00 A.M. to 12:00 P.M. General Partner: Condor Management, Inc., Ft. Lauderdale, Florida The strongest factor in support of our request is the fact that we do not have a parking problem. The Center has 98 Parking Spaces. At the request of the Bu£1ding Official, our Building Manager conducted a physical count of empty parking spaces every morning and every afternoon for a two week period. The results of his count is attached together uith his affidavit swearing to the accuracy of the counts. As you can see there was a daily morning average of 32 vacant parking spaces and a daily afternoon average of 38 vacant parking spaces. This count was done in February and March which is the busiest timc of the year for the Center. Also, Dr. Bambrick was alreact¥ in the building at the time the counts were taken.
