PUBLIC INPUT Rosanne Romano, 918 Bermuda Avenue, said on her block there are three street lights that are exposing her to unnecessary radiation and electricity. She asked Council to look into this. Arnold Ring and his wife, residents of 207 Cedar Street, said they were present to show their appreciation for the wonderful, superior trained staff who are working for the City. He described the following interactions with staff: During a recent storm, his home was in jeopardy of flooding. He made some phone calls and the problem was immediately cleared up. A number of days ago, he noticed Ken from the Public Works Department in a backhoe behind his house clearing the canal to prepare for the next storm. Recently, Linda from the Building Department, assisted him with the necessary permitting forms for some work on their house and then as the work was being done, the inspectors came out and shared their technical experience. He also thanked Lee from the Public Works Department, who came out to check out his street's swale after some utility work was done. He also thanked the City for the electronic speed signs on Main Street, which is deterring speeders. A week ago, he received a late -night knock on the door and was met with Officer Keiser and Officer Singh who were conducting an investigation. He commended the officers for their professionalism and police presence. He thanked the employees he mentioned and those he didn't mention for keeping the community up to the standards that Council desires. Deborah Shellenberger said she was concerned with Cleveland Clinic Hospital's proposal to close the maternity ward and have patients drive 45 minutes to another hospital. She said the problem is when something goes wrong with pregnancies it Regular City Council Meeting August 27, 2025 Page 3 happens very fast if it happens on the way to the hospital there usually isn't a good outcome. PUBLIC HEARINGS 6.21 pm 25.128 A. First Readina of Ordinance No. 0-25-13 - Establishina a Retirement Plan and Trust for the General Emr)lovees of the Citv of Sebastian, and to Set the Date for Second Readina on September 10, 2025 The City Attorney read the title to Ordinance No. 0-25-13. The Chief Financial Officer displayed a PowerPoint presentation (see attached) outlining the existing retirement plans for general employees noting the CWA/ITU Negotiated Pension Defined Benefit Plan is set to dissolve causing the City to find a new retirement plan. He talked about possible retirement options which included a new City plan that would create a master trust agreement between the City and the trustees of the Florida Municipal Pension Trust Fund. Some of the highlights of this plan include a start date of October 1, 2025, all full-time employees would be eligible; employee contributions would be voluntary and the vesting period would be five years. Regular City Council Meeting August 27, 2025 Page 4 6:59 pm 7.14 pm Those employees within five years of retirement could opt out of the new plan and remain with CWA plan. The Chief Financial Officer explained that there are currently 43 employees that have less than five years of service and should Council decide to do so, the City could provide a one-time lump sum payment to their 401(a) account to make up for the amount that the employee would have received if they were still in the CWA plan estimated at $43,230. He briefly went over the termination benefits for vested and non -vested employees. The new plan would require a five -member Board of Trustees with three-year terms to administer the plan. He asked Council to consider the following: a buyback option for unvested CWA employees; when Council would like to change the employee contribution factor; whether unvested employee contributions should be with or without interest; what kind of death benefit should be for beneficiaries; and the terms for the board members. Council Member Nunn asked if the penalty for withdrawing from the CWA would remain the same for the next 20 years. The Chief Financial Officer said it would be certain for the next 20 years, payable quarterly. The City Manager said he has met several times with the employees to see if there was interest and the most popular question was from the nonvested employees who asked if they would lose their benefit for their service years in the CWA. During the budget workshop, Council asked staff to look into a dollar value they would receive in the new plan. Council Member Dodd said hewould propose that the 401(a) contribution be deposited on the five-year anniversary date as opposed to immediately. He also requested the fund be ready as close to October 15t as possible. The City Manager said the 9% CWA contribution is currently in the budget but the remainder to get to 13.6% and the buy back the unvested employees would have to come out of reserves. He asked that Council's motion included the statement that the CFO has the authority to use reserve funds for the buy back and the difference between the 9% and the new retirement plan. The City Manager said out of the 43 unvested CWA employees, five employees have chosen to go into the 401(a). MOTION by Council Dodd and SECOND by Council Member Nunn to approve 0-25-13 with the following amendments that the makeup contribution to the 401(a) plan for employees with less than five years in the CWA plan be deposited in the 401(a) on the five-year anniversary investiture period and authorizing the City Manager and Chief Financial Officer to use reserve funds to fund the advance payment for the plan as well as make up payments for the CWA employees and set the second reading for September 10th. First Readina of Ordinance No. 0-25-14 - Establishment and Creation of the Board of Trustees for the Retirement Plan and Trust for the General Emplovees of the Citv of Sebastian and to Set the Date for the Second Reading on September 10, 2025 The City Attorney read the title of Ordinance No. 0-25-14. The Chief Financial Officer said the option to set up a five -member board with three-year terms has been written into the ordinance with two residents chosen by Council, two members chosen by the participants and one chosen by the remaining trustees. MOTION by Vice Mayor Jones and SECOND by Council Member Dodd to approve Ordinance 0-25-14 and set the second reading for September 10tn Council Member Nunn asked if it was normal for the fifth member to be chosen by the members. The City Manager responded that in discussion with the Florida Municipal Trust representative and the pension attorney, that was how they collectively chose to handle it but it was ultimately up to Council. He noted at the first meeting there will only be four members until the fifth member is chosen. Brent Chudachek, Esq., representing the City, said the City does have the ability to create and establish the board in whatever way Council would like. He said five is usually a good number for quorum and in discussions with the City Manager, they thought it would be good to model it after the police and fire F.S.185 plans. Council Member Dodd asked how the procedure would be to obtain the fifth member. The City Manager said it would be up to Council, they could appoint three or two members of the board. The City Attorney said the ordinance was written with the fifth member would be chosen by the board and City Council would then sign off on the fifth member. Council Member Nunn said he would like to see three members appointed by Council so anyone who would like to be a part of this would have the opportunity to serve. Council Member Dodd said he agreed with Council Member Nunn. Jeremy Langley, Florida League of Cities Account Executive, said this board will be charged with overseeing the plan as it is written, they won't have any authority to change the benefit structure of the plan. Regular City Council Meeting August 27, 2025 Page 6 7:27 pm Council Member Dodd said he would like to stay with Council appointing three members. Mayor McPartlan suggested the terms be staggered. The City Manager said they could stagger two trustees for two years or one trustee for three years or two trustees for three years and one trustee for two years. He would prefer the majority have at least two- or three -years terms. Vice Mayor Jones suggested two trustees for three years. Mayor McPartlan suggested two trustees for three years and one for two years. Council Member Dodd suggested two trustees for two years and one for three years. Vice Mayor Jones and Council Member Dodd WITHDREW their motion. MOTION by Vice Mayor Jones and SECOND by Council Member Dodd to amend the membership of the Board of Trustees portion of the ordinance to state that three members of the public will be appointed by City Council and two members will be general employees and active participants in the retirement plan who are elected by the majority of active participants in the retire plan. The initial terms will be two trustees for three years and one trustee for a two-year term. The City Manager said the eligible employees will be given the opportunity to submit their interest and then have a vote on who the two employees will be. The City Attorney restated the motion, "approve Ordinance No. 0-25-14 with the amendments in section b of the newly created section to read, the board of trustees shall consist of five members, three of must be residents and appointed by City Council and two general employees who are active participants in the retirement plan, elected by the majority of the employees active in the plan. The City Attorney continued to clarify that the initial board installation shall be two Council appointed trustees for a three-year term and one Council trustee appointed for a two-year term. One general employee appointed for a two-year term and one general employee appointed for a three-year term. Elections for the general employee trustees will be held every two years. There was no public input. UNFINISHED BUSINESS - None 12. NEW BUSINESS 25.129 A. Consideration of Proposed FY 25-26 Sebastian Municipal Golf Course Rate Adiustments The Golf Pro said he and the City Manager went over all of the rates and made some nominal increases. He said they did their best to balance the supply vs. demand. MOTION by Council Member Dodd and SECOND by Vice Mayor Jones to approve the rate changes as suggested by staff. There was no public input. The Golf Pro said 35-40% of the tee times are used by memberships and 60% are people coming in from off the street. Roll call: Mayor McPartlan - aye Vice Mayor Jones - aye Council Member Dodd - aye Council Nunn - aye Motion carried. 4-0 25.130 B. Consider Holdina One Council Meetina_ in November and Reschedulina_ the December Council Meetina Dates The City Manager said the results of the election are expected in to be in by November 71h unless there is a need for a recount or runoff. Mayor McPartlan noted there will definitely be three members sworn in at the November 12th meeting. It was the consensus of Council to hold meetings on November 12th, December 3rd, and December 171n 13. CITY ATTORNEY MATTERS The City Attorney said the potential litigation with SB180 is up to nine entities and the lawsuit would go forward with 10 entities. She asked Council if they would like to join the lawsuit. It was the consensus of Council to join the lawsuit. 14. CITY MANAGER MATTERS The City Manager reported that the road at Veterans Memorial Way will be closed on Tuesday, September 2nd to address an issue. The VFW, American Legion and StillDragon have been made aware of the closure. Debris Removal in Private Homeowners' Associations Regular City Council Meeting August 27, 2025 Page 8 The City Manager advised Council that he plans to use Reserve Funds to cover the Hurricane Milton debris removal for six private developments that FEMA has denied claims for. The amount is $7,265.66. He explained that FEMA will only reimburse municipalities if the debris is a life safety, health, and wellness issue. He asked Council if they would like to continue to provide debris removal in private homeowners' associations (HOAs) with the chance of future denials or rewrite the HOA agreements so that they will reimburse the City if FEMA denies the claim "during larger storms. There are 13 developments that the City has agreements with to remove debris. He distributed a map of the HOAs that the City picked up Hurricane Milton debris from. (See attached) The City Attorney advised that the agreements could state if the HOAs don't honor the agreement the City wouldn't come back for the next storm. The City Engineer said for Hurricane Milton, staff had to provide GPS coordinates and photographs of every single pile that was collected and FEMA chose not to cover the piles because the yard waste could have been included in the Waste Management pickup. The City Engineer noted that some of the communities opt out of the City's pickup because they realize the heavy equipment will damage their private streets. It was the consensus of Council to have agreements stating the HOAs will have to pay back the City if FEMA denies the claims. Indian River County's Comprehensive Plan Evaluation and Aoaraisal Report Amendments The City Manager said the County has been having public meetings to discuss their upcoming EAR amendments and in discussions with staff and community stake holders, he has a concern with under the Sanitary Sewer Sub -Element, Policy 1.1 - New Development with the municipalities of Indian River County shall be approved only when capacity is available, either on -site or off -site, to provide needed sanitary sewer service which differs from the previous plan that stated New Development within the unincorporated portion of Indian River Countywhich directly points to Sebastian. He wanted Council to be aware that in subsequent meetings with the County Administrator, the Administrator has proposed to strike the reference to municipalities in Policy 1.1. and add an additional policy to acknowledging the County's commitment to carry out and implement the provisions of the Inter -Local Agreement between the City and County concerning water and wastewater. He said with Council's approval, he would like to accept the Administrator's offer and attend the September 91h County Commission meeting to ensure the statement is included in their amendment. CITY COUNCIL MATTERS Mayor McPartlan - None Council Member Nunn - None Council Member Dodd suggested that maybe Mr. Ring, who praised the City's employees at the beginning of the meeting, could do a public service announcement to recognize the employees who weren't called out by name who recently assisted him and his wife.
