HomeMy WebLinkAbout03151995CODE ENFORC,E,M,E NT BOARD GULAR MEETING MARCH 15. 1995 The meeting was called to order by Chairman Gilliams at 2:08 p.m. ROLL CALL: PRESENT: Chairman Gilliams Mrs. Kostenbader Mr. Nicolini Mr. Metcalf Mr. Generazio (arriving late) Mr. Neglia ALSO PRESENT: Bruce Cooper, Director of Community Development/Building official Richard Schofield, Code Enforcement Officer APPROVAL OF MINUTES: Mr. Nicolini made a motion to approve the minutes of the meeting of February 15, 1995, as written. Mr. Metcalf seconded the motion. Roll call was taken. The minutes were approved 5-0 (Mr. Generazio was not present for the vote). ATTORNEY'~ MATTERS: None OLD BUSINESS: Case # 94-9549 Mr. Generazio arrived at 2:11 p.m. This case was tabled from the last meeting because an underwater inspection could not be done by the Code Enforcement officer, as requested by the Board. Mr. Schofield states he did get to do an inspection on Saturday, February 18. Ne reviews his findings. He found a large diesel engine that had obviously been scuttled. There was no evidence of bolts in the motor mounts or any type of wood attachments. Mr. Morris' boat had an outboard motor only (having some sort of motor attachments). The wooden debris in the vicinity on the river floor had very heavy barnacle growth and oyster shells attached to both sides of the wood, indicating it had been there longer than Mr. Morris' boat. CODE ENFORCEMENT BOARD REGULAR MEETING OF MARCH 15, 1995 PAGE TWO Mr. Cooper restates staff's recommendation of not levying any fines against Mr. Morris for his days of non-compliance. As determined by the Code Enforcement staff, it appears all of Mr. Morris' debris has been totally removed. He also states the city will be looking into the State's Derelict program for help with funding for removing the remaining underwater debris. Mr. Generazio voices his concerns over the safety hazards the debris still presents. Mr. Cooper states the debris is marked with a buoy, but can request extra markage through the Florida Marine Patrol, if not Public Works. Even though the area is in the City limits, it is not governed by the city. The extra markage will lessen any city liability in case of any accidents. Mr. Neglia suggests using tow lines attached to a truck on shore to drag the debris in. Mr. Cooper states that would probably damage the grass beds and wouldn't be allowable through DEP. Mr. Gilliams suggests that maybe some of the businesses along Indian River Drive could pull together and organize a salvage effort. Mr. Cooper states he will check with the City Manager to get his opinion on whether the City should pay for any clean-up expense. Mr. Generazio made a motion to close Case #94-9549 with no fines levied. Mr. Neglia seconded the motion. Roll call was taken. Mr. Nicolini Yes Mr. Metcalf Yes Mr. Generazio Yes Mr. Neglia Yes Chmn. Gilliams Yes Mrs. Kostenbader Yes Motion was passed 6-0. NEW, BUSINESS: APPOINTMENT OF CHAIRMAN AND VICE CHAIRMAN Mr. Neglia nominated Mr. Gilliams to be retained as Chairman of the board. Mr. Gilliams accepts the nomination. CODE ENFORCEMENT BOARD REGULAR MEETING OF MARCH 15. 1995 PAGE THREE Mr. Neglia nominated Mr. Nicolini as Vice Chairman. Mr. Nicolini, after verifying that Vice Chairman Kostenbader is leaving after completing her terms on the board, accepts the nomination. There were no further nominations. Mr. Gilliams remains Chairman of the Code Enforcement Board, and Mr. Nicolini becomes the new Vice Chairman. Staff (Mr. Cooper, Mr. Schofield) asks to be excused from the meeting. REVIEW OF APPLICATIONS FOR BOARD POSITION - RECOMMENDATION TO CITY COUNCIL The sole applicant is not present to be interviewed. Mr. Generazio makes a motion to table this to the next meeting so the applicant can be present. Mr. Neglia seconded the motion. Roll call was taken. 6-0 motion passed. BOARD ATTORNEY REQUEST AND REPORTS: None BUILDING OFFICIAL'S MATTERS: None GENERAL DI,~CUSSI,pN: Mr. Nicolini gives Mrs. Kostenbader a congratulatory nod on a job well done. Mr. Gilliams extends congratulations to the new City' Council recently elected: Louise Cartwright, Norma Damp, and Ray Halloran. PUBLI~ INPUT: None ADJOURNMENT: Mr. Generazio made a motion to adjourn the meeting. Mr. Neglia seconded it.
