HomeMy WebLinkAbout03292000 CEBCITY OF SEBASTIAN CODE ENFORCEMENTBOARD MINUTES OF WORKSHOP MEETING MARCH29,2000 Chairman Cosco called the meeting to order at 1:06 p.m. The Pledge of allegiance was said. ROLL CALL: PRESENT: Ms. Barczyk Chmn. Cosco Mr. Schofield Mr. Morozowski(a) Mr. Cavallo Mr. Neglia Mr. Davis(a) Mr. Connelly ALSO PRESENT: Randy White, Police Chief Paul Graves, COPE Officer Tracy Hass, Planning & Growth Management Director Terrence Moore, City Manager Tim Zelinski, Code Enforcement Officer Kathy Brauer, Code Enforcement Officer Ann Brack, Recording Secretary Councilman Barczyk was present in the audience. OLD BUSINESS: A. Discussion - Citation form, citation fines, and compliance time periods- Review of proposed classifications of violations, citation form Chmn. Cosco announced that he had attended a False Alarm class put on by Officer Graves and found it very informative, and felt that the Board members would find his presentation very helpful. Officer Graves passed out copies of the Alarm Ordinance to the Board members. He gave information on the class that Chron. Cosco referred to and noted that it is a "User's" class. He then explained how this "User's" class would be used in enforcing the Alarm Ordinance on page 13. He noted that after the third violation, the fine may be waived if the violator attends this class, which will probably be held dght here at City Council Chambers, on the proper way to use an alarm to avoid false alarms. On the fourth violation there will be mandatory attendance at this class. He gave further information on the alarm violation procedures. A break was taken between 1:22 p.m. and 1:29 p.m. The Board proceeded to analyze the hand-out sheets that were furnished by Chief White at the last regular meeting on March 15, 2000. There was discussion on the subject of City Code Enforcement Officers' involvement with animal problems. Mr. Zelinski noted CODE ENFORCEMENT BOARD MINUTES OR WORKSHOP MEETING OF MARCH 29, 2000 that his involvement is limited, and the County Animal Control Department is often called. Mr. Zelinski called attention to the fact that this Board is being asked to approve or suggested any changes to the three classifications in the proposal furnished by the Code Enforcement Department at the last regular meeting. There was discussion about how to designate a classification to a violation that is not covered in this proposal as it only encompasses the violations that are prevalent at this time, and it was noted that there are many more ordinances on the books that are not included in this list. The City Attorney was not present to obtain this advice. Ms. Barczyk noted that she researched all of the cases that came before this Board for the last year or year and a half, and found that most of the issues would be considered Class I, and the repeat violations were very, very rare. CLASS I,,,;, (Code Enforcement hand-out) The following time determinations were made by consensus: 20A-5.10 - 20A-5.46 - 20A-15.3 - CD6:1 - CD82:51 - Screens for dumpsters - 15 calendar days Failure to display building numbers - 7 calendar days License for display of signs, political signs - Remains the same Posting signs, etc., to poles, etc.- Remains the same Garage/yard sale required to have a permit- Remains the same Tim Zelinski suggested that the remainder of the issues under Class I remain the same. Sal Neglia suggested that issue 20A-3.4 requiring a garage or carport on every single family dwelling unit, and 20A-14.10 requiting tree removal permits, and 20A-12.2 requiring a permit for a structure, be reassigned to Class II. 20A-5.16.1- prohibiting large trucks, heavy equipment and semis from being parked in a residential area. Consensus was to have this issue remain in Class I. g8-36B,C,D,E -Vehicles must be licensed, registered and owned or leased to the owner or tenant etc. Unregistered vehicles were discussed. Consensus was to allow seven (7) days to move the vehicles. 20A-3.4 - Every single family dwelling unit shall be required to provide a garage or carport - Class II (by consensus) 20A-14.10 - Tree removal permits required for all protected, specimen and historical trees - Consensus was to change this to Class Ii, and double the fine to $100 plus the $50 permit fee. 20A-12.2 - Permit for structure, etc. - Remain in Class I CODE ENFORCEMENT BOARD MINUTES OF WORKSHOP MEETING OF MARCH 29, 2000 CD102:10 CD26:5 - CD66:3 - Water ordinance - Remain in Class I Blockage of swale - Remain in Class I Noises, animal carcass disposal, growth of weeds etc - Remain in Class I CLASS I1: All issues on page 3 of the hand - out will remain in Class II, with the addition of 20A-3.4 and 20A-14.10. CLASS II1: All issues on page 4 of the hand - out will remain in Class III. Ms. Barczyk suggested installing signs prohibiting pollution activities in the dock areas. Officer Graves agreed with this suggestion and noted that this is an action the Police Department can undertake. There was discussion on the fine amounts for each Classification of violations. Chmn. Cosco suggested that it would be very beneficial if this Board could be educated in reference to legal procedures and rules and regulations governing its actions. Mr. Connelly suggested that attorneys be included in this process. There was discussion and it was suggested that all Class I citations have a $25.00 fee. Consensus was in favor of this issue. There were suggestions of $25.00 and $50.00 for a citation fee for Class II. Consensus was 4 to 3 in favor of $50.00 for Class II citation fee. There were several suggestions for Class III citation fee, including $50, $100, and $200. Consensus was as follows: $200.00 4 in favor $100 3 in favor (No opinion was taken for the $50.00 suggestion.) Tracy Hass explained the fence permitting fee structure when a fence is placed in an easement. Mr. Moore responded to a question in reference to a recent newspaper article about citation fees. He indicated that City Council will be addressing this issue at the April 12th Council meeting, at which time they will also be in receipt of the findings of this Code Enforcement Board from today's meeting. It was determined that the citation form will have a space for the Ordinance number relating to the violation, and the violators name will not have a designation of "owner or renter". CODE ENFORCEMENT BOARD MINUTES OF WORKSHOP MEETING OF MARCH 29, 2000 Mr. Moore noted that updated documents are being prepared for the Land Development Code and should be available in the Fall. There was discussion about availability of these books for this Board. · Mr. Neglia asked that today's findings be provided to the Board members. The next meeting will be held on April 19th 2000.
