MEETING WAS CALLED TO ORDER BY CHAIRMAN DEROBERTIS AT 2:05
P.M.

APPROVAL OF MINUTES:
MOTION WAS MADE BY MR. GILLIAMS AND SECONDED BY MR. TOZZOLO
TO APPROVE THE MINUTES OF MEETING HELD ON FEBRUARY 20, 1991.
CARRIED.
ATTORNEY LULiCH STATED THERE SHOULD BE AN ADDITION TO THE
GUIDELINE FORM PROVIDED THE BOARD FOR MINIMUM FINES AS
FOLLOWS: FOR EACH ADDITIONAL OFFENSE THE MINIMUM FINE WOULD
INCREASE $25.00 PER DAY FOR SECOND, THIRD, & FOURTH OFFENSE.
THIS GUIDELINE FORM SHOULD BE MADE AVAILABLE TO THE BOARD
MEMBERS AT EACH MEETING.
ATTORNEY'S MATTERS: NONE

NEW BUSINESS:
MR. DEROBERTIS STEPPED DOWN AS CHAIRMAN FOR A FEW MINUTES FOR
AN ELECTION FOR A NEW CHAIRMAN. MR. GILLIAMS ASKED MR.
DEROBERTIS IF HE WOULD LiKE TO RUN FOR THE POSITION AGAIN AS
CHAIRMAN. MR. DEROBERTIS STATED THAT HE WOULD.
A MOTION WAS MADE BY MR. GILLIAMS AND SECONDED BY VICE
CHAIRMAN FISCHER TO REINSTATE MR. DEROBERTIS FOR ANOTHER 3
YEARS AS CHAIRMAN FOR THE CODE ENFORCEMENT BOARD OF THE CITY
OF SEBASTIAN.
CARRIED.

BUILDING OFFICIAL'S MATTERS: NONE
GENERAL DISCUSSION: NONE
PUBLIC INPUT:
MR. GEORGE REED (COUNCILMAN) WOULD LIKE THE BOARD TO CONSIDER
THE PROBLEM THAT SEEMS TO BE PREVALENT IN SEBASTIAN OF
EXCESSIVE NUMBER OF YARD SALES BY INDIVIDUALS TO THE POINT
THAT THE YARD SALE ALMOST BECOMES A BUSINESS WHICH IS
CONTRARY TO THE CODES TO BEGIN WITH. THE CITY NEEDS TO
CONSIDER A LIMIT OF THE YARD SALES THAT AN INDIVIDUAL CAN
HAVE PER YEAR AND DO IT BY PERMIT.
CHAIRMAN DEROBERTIS STATED THAT HE BROUGHT THE SAME PROBLEM
BEFORE THE STAFF TO GO BEFORE CITY COUNCIL ABOUT 5 YEARS AGO.
MR. REED ASKED IF THIS MATTER EVER GOT ON THE AGENDA. MR.
DEROBERTIS STATED IT DID NOT. HE SUGGESTED THAT MR. REED
CHECK WITH THE CITY CLERK'S OFFICE.
ATTORNEY LULICH STATED THAT THE CODE ENFORCEMENT BOARD DOES
NOT CREATE CODES OR MAKE RECOMMENDATIONS OF CODES. THE
PLANNING AND ZONING COMMISSION AND THE CITY COUNCIL DOES.
THE BOARD SiTS AS A JUDGING BODY. IT IS NOT PROPER FOR A
BOARD MEMBER GOING AROUND TO FIND VIOLATIONS IN THE CITY.
THE CITY ATTORNEY TOGETHER WITH THE CODE ENFORCEMENT OFFICER
AND THE BUILDING OFFICIAL ARE THE ONES THAT FIND THE
VIOLATIONS AND PROCESS THE COMPLAINTS. THE BOARD DOES NOT
GET INVOLVED UNTIL THERE IS NON-COMPLIANCE. THE BOARD GETS A
MONTHLY REPORT OF CASES. THE LAST FEW MONTHS THERE WERE NO
CASES BROUGHT BEFORE THE BOARD. YOU SHOULD TAKE SUCH MATTERS
OF CODES TO STAFF, OR PLANNING & ZONING COMMISSION IF THERE
IS A CHANGE NECESSARY IN THE ORDINANCE. IF STAFF IS NOT
FOLLOWING THROUGH ON THE COMPLAINTS OR PROSECUTING THE
VIOLATIONS, THEN CITY COUNCIL SHOULD GET ON STAFF.

KOSTENBADER TO ADJOURN THE MEETING AT 2:30 P.M.
