Barczyk William Simmons Mr. Cosco Mr. Schofield Mr. Van Buskirk VC Connelly Mr. Oakes Mr. Morozowski(a) EXCUSED ABSENCE: Mr. Davis(a) ALSO PRESENT: Officer Dennis Hovasse, Alarm Admin./Code Enforcement Officer Warren Lindquist, Code Enforcement Officer Rich Stringer, City Attorney Ann Brack, Recording Secretary Councilman Joe Barczyk Councilman Ray Coniglio APPROVAL OF MINUTES: MOTION by Connelly/Morozowski I make a motion we accept the minutes as written. A voice vote was taken. 7 - 0, motion carried. NOTICED HEARINGS: VIOLATION HEARING - CASE #2001-0023990 WILLIAM WARREN STEVENS - 1421 THORNHILL LANE · Section 66-3 (1-11-12) CODE OF ORDINANCES Mr. Van Buskirk declared a conflict and stepped down from the dais. He submitted a Form 8B. Mr. Morozowski(a) will vote in his place. Officer Dennis Hovasse was sworn in by Chmn. Barczyk at 2:15 PM, and proceeded to present Case #2001-0023990. He indicated that he has been working with Mr. Stevens since November 2001, and there has been some improvement, but asked that a deadline be set on this case. He submitted numerous photographs of the site for Board members to review. (Exhibits A - undated, & B-dated 4/17/02) CODE ENFORCEMENT BOARD MINUTES Of REGULAR MEETING OF APRIL 17TM, 2002 Mr. Oakes noted that he drove by the site earlier today, and Chwmn. Barczyk responded that is not a good idea for Board members. Atty. Stringer indicated that it is better if Board members do not visit the site. He explained the reasoning on this issue. Mr. Oakes stated that he would not do this in the future. Mr. William W. Stevens, 1421 Thornhill Lane, Sebastian, FL was present and was sworn in by Chwmn. Barczyk at 2:15 PM. He responded to questions from Board members. He then asked for ninety (90) days to get his property cleaned up. There was discussion on this request. Bob Kicia and Dianne Collins, neighbors of Mr. Stevens, were sworn in by Chwmn. Barczyk at 2:17 PM. Mr. Kicia asked questions about enforcement of the ninety (90) day time limit, along with other issues. Dianne Collins, a next-door neighbor to Mr. Stevens, asked the Board to do something to get this property cleaned up. MOTION by Connelly/Morozowski(a) i move that in the matter of Case Number 2001-0023990, Mr. William Warren Stevens of 1421 Thornhill Lane, Sebastian, Florida 32958 is guilty of the violations as reported by Officer Hovasse and we find therefore that he is in violation and we realize that there is a lot of work to be done and we are willing to bend a little bit, and I would recommend that we give him a hundred (100) days, I move that we give him a hundred days to come into compliance, failing todo that, a fine will commence on that hundred and first day of fifty dollars ($50) a day until it is resolved. B, VIOLATION HEARING - CASE #2002-0006124 SAMUEL W. HIGH - 926 DEVON AVENUE · Section 66-3(1-11) CODE OF ORDINANCES Officer Hovasse reported that Mr. High has apparently not received his notice as yet since the receipt has not yet been returned. He requested that this Case be withdrawn, and it will come back before the Board at the next meeting. Chwmn. Barczyk noted that Case #2002-0006124 will be continued to the next meeting. CODE ENFORCEMENT BOARD MINUTES OF REGULAR MEETING OF APRIL 17, 2002 Chwmn. Barczyk asked for a status report on the case for Shannon Cook, and Officer Hovasse indicated that Mr. Cook will probably come before this Board at the next meeting because he has not come into compliance yet. She also asked about Mr. McVickar, and Officer Hovasse indicated that he has not found him in repeat violation recently. He also indicated that the owner of that property is still trying to have Mr. McVickar evicted, CHAIRMAN'S MATTERS: Chwmn. Barczyk noted that Mr. Neglia, who was Chairman, resigned from the Board to run for City Council, and asked if she should continue as Chairman, or would the Board like to have a new election. Atty. Stringer noted that generally, the Vice Chairman usually moves into the Chairman position, and there is no re-election of a Vice Chairman - the member who has been on the Board for the longest time will Chair meetings when the Chairman cannot attend. MOTION by Oakes/Cosco i make the motion that Madam Chairlady stay Madam Chairlady. A voice vote was taken. 7 - 0, motion carried, MEMBERS' MATTERS: There were many comments about the scope of this Board. Chwmn. Barczyk adjourned the meeting at 2:53 PM. Aider reviewing Mr. William Warren Stevens violation notice I feel it's my responsibility to abstain from voting on case #2001~0023990 due to the fact Mr. Stevens has been a family friend for over 10 year's, I believe my vote may cause a undesirable outcome to personnel involved in this case. If you have any questions or would like to discuss this matter, please advise.
