IN THE CITY COUNCIL CHAMBERS. CODE ENFORCEMENT BOARD MINUTES OF WORKSHOP MEETING OCTOBER 18, 2000 Chairman Cosco called the workshop meeting to order at 3:02 pm, The Pledge of Allegiance was said. ROLL CALL: PRESENT: Sal Neglia Tut Connelly Chmn. Cosco EXCUSED ABSENCE: VC Barczyk UNEXCUSED ABSENCE: Mr. Schofield, Mr. Morozowski(a), Mr. Cavallo, Mr. Kea, and Mr. Davis(a) ALSO PRESENT: Rich Stringer, City Attorney Dennis Hovasse, Alarm Administrator Ann Brack, Recording Secretary ANNOUNCEMENTS: NEW BUSINESS: None There was no quorum, but the three members discussed some issues with the City Attorney. Mr. Neglia commented that he is unable to get some answers to some questions. He indicated that he will be meeting with Mr. Terrence Moore on October 30, 1999. He again suggested strongly that the Code Enforcement Department needs a Secretary so the Officers don't have to do all the paperwork. There were further comments by Chmn. Cosco and Mr. Connelly about the role of Board members, difficulties with the transition, and lack of communication with the present Code Enforcement Department. Questions were directed to Atty. Stringer. Atty. Stringer explained the appeal process as applies to Board members and noted that modifying or overturning a fine needs a justifiable reason and evidence. Officer Hovasse noted that by the time any cases get to this Board, the Code Officers have already worked with the resident and in some case, have already given many breaks to them. He noted that his Department has already scratched close to $3,000 in fines by trying to be fair and forgiving. Atty. Stringer then gave an example of a previous activity by this Board that could create a future problem by creating a "tainted" Board. He also cautioned that this Board should not be involved with the writing of codes since a case could be made for interpretation of CODE ENFORCEMENT BOARD MINUTES OF WORKSHOP MEETING OF OCTOBER 18, 2000 "intentions". He then explained some of his findings while researching the history of Code Enforcement Boards, which were formed to perform a judicial activity, which is even stronger than quasi-judicial. He noted that this Board should receive the charging document and copies of the code only, ahead of time, and any other information should come in as a presentation of evidence. There was more discussion and Mr. Connelly noted some past issues. Chmn. Cosco inquired about the City Attorney's attendance at Board meetings and this was discussed. Atty. Stringer suggested that discussions on procedural matters be put off until the other members, who are mostly new Board members, are present. There was more discussion on the role of a Secretary as pertains to the Code Enforcement Department. Mr. Neglia commented that none of the Board members got notified of today's meeting, even though they should know when the meetings are scheduled. There was discussion and the Chairman requested that the members be notified of each meeting. Officer Hovasse noted that he tries to help Tim Zelinski with all the paperwork for this Board, and he has two other jobs also, but he would try to see that the members are notified of the meetings. Sal Neglia suggested maybe a volunteer could do the paperwork, or get a woman in town who would volunteer to help. Chmn. Cosco adjourned the meeting at 3:30 pm. (10/24/00 AB)
