R-25-12 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, EXPRESSING SUPPORT FOR THE INDIAN RIVER ENVIRONMENTAL LANDS ACQUISITION PROGRAM (FLAP) IN THE CONSIDERATION OF RECOMMENDING TO THE INDIAN RIVER COUNTY BOARD OF COUNTY COMMISSIONERS THE PURCHASE OF PROPERTY LOCATED AT 11360 S INDIAN RIVER DRIVE FOR CONSERVATION PURPOSES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Indian River Environmental Lands Acquisition Program (ELAP) seeks to preserve, protect, and manage environmentally sensitive lands within Indian River County; and WHEREAS, the City of Sebastian recognizes the importance of preserving and protecting valuable natural habitats and ecosystems for the benefit of current and future generations; and WHEREAS, the property located at 11360 S Indian River Drive, which consists of 2.84 acres, has been nominated for consideration of purchase by the ELAP for conservation due to its location along the Indian River Lagoon; and WHEREAS, the preservation of this site will contribute to the enhancement of water quality, protect water resources, the Indian River Lagoon, Natural Areas, and potentially provide opportunities in the future for environmental education and passive recreation for the use and enjoyment of the residents of Indian River County; and WHEREAS, public access to natural areas such as the lagoon enhances community well- being, supports environmental education, and fosters a culture of stewardship; and WHEREAS, conservation of this land aligns with local, regional, and state environmental goals, including those related to climate adaptation, open space preservation, and habitat restoration. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, AS FOLLOWS: SECTION 1. ADOPTION OF RECITALS. The Sebastian City Council hereby adopts the clauses contained in the Whereas recitals above as the true and correct legislative findings of the Sebastian City Council. SECTION 2. EXPRESSION OF SUPPORT. The Sebastian City Council hereby expresses its support for the Indian River Environmental Lands Acquisition Program (ELAP) and recommends to the Indian River County Board of County Commissioners the consideration and potential acquisition of the property located at 11360 South Indian River Drive for conservation purposes. 1 SECTION 3. CONFLICTS. All resolutions or parts of resolutions in conflict herewith are hereby repealed. SECTION 4. SEVERABILITY. In the event a court of competent jurisdiction shall hold or determine that any part of this Resolution is invalid or unconstitutional, the remainder of the Resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the City Council would have enacted the remainder of this Resolution without said invalid or unconstitutional provision, thereby causing said remainder to remain in full force and effect. SECTION 5. SCRIVENER'S ERRORS. Sections of this resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of further action of the City Council by filing a corrected copy of same with the City Clerk. SECTION 6. EFFECTIVE DATE. This Resolution shall take effect immediately upon its adoption.
