Benjamin City Clerk CHAIRPERSON SAM COBURN CALLED THE CEMETERY COMMITTEE MEETING ORDER AT 7:30 P.M. THEN LED THE COMMITTEE AND AUDIENCE iN THE PLEDGE OF ALLEGIANCE TO THE FLAG. TO ROLL CALL: PRESENT: ABSENT: MR. ALLEN SCHOFIELD MRS. YOLANDA PAYANT MRS. FLORENCE PHELAN MR. SAM COBURN MR. DAN POTTINGER MR. KIP KELSO, SEXTON MR. TIM JOBE MRS. .ELSIE PLYLER COUNCILMAN VALLONE (EXCUSED) 1. ACCEPT MINUTES OF FEBRUARY 12, 1986 MOTION by Pottinger/Payant I move we accept the minutes of the February 12, 1987 meeting. ROLL CALL VOTE on the motion carried (5-1, Phelan nay) 2. VOTING POSITION FOR SEXTON - No special rule, no conflict of interest according to City Attorney. MOTION by Schofield/Pottinger I move that Kip Kelso has the privilege of voting ROLL CALL VOTE on the motion carried (4-1, Phelan nay, 1 abstention) SEBASTIAN CEMETERY COMMITTEE MEETING February 26, 1987 page 2 A. CHAIRMAN'S MATTERS: SAVAGE MATTER/ATTORNEY'S OPINION - City Attorney advised, give Mrs. Savage 10 days to remove the tree/appeal to Board of Adjustments. MOTION by Phelan/Pottinger I move we have Kip Kelso talk with City Attorney, and request he write a letter with a time limit without fault falling on the Sexton. ROLL CALL VOTE on the motion carried unanimously (5-0) 4. COMMITTEE MEMBERS' MATTERS: A. ENGINEERING OPINION/BASE POURING Matter to be discussed in meeting of 2/27/86. Tabled. LIABILITY/ATTORNEY'S OPINION - Attorney Palmer stated the City has no liability, purchaser has the responsibility to care for and maintain stone/Stone damage also. Sec. 8-28. addresses this issue specifically. A. CHAIN-LINK FENCING MOTION by Phelan/Pottinger I move to approve Capital Improvements funds to add a chain-link fence to north side of cemetery running E to W./ and for Council to go to bid as soon as possible. ROLL CALL VOTE on the motion carried unanimously (5-0) B. RECOMMENDATION Chairperson suggested a letter be sent to those members not attending regular meetings that we will notify Council of this and request replacements ADJOURNED at 8:30 p.m. MINUTES APPROVED AT THE CEMETERY COMMITTEE.
