I) A memo dated July 22, 1986 to Mr. Bill Vincent, Business Manager, Golf Course from Mrs. Carol Cdrswell, Finance Director showing financial instability of Mr. Walsh and his company. 2) In a memo from myself to L. Gene Harris, Mayor, requesting he and the City Council consider removing Mr. Walsh from the Construction Board citing certain facts: a) A proposal to build a pump house roof, (this is structural) and Mr. Walsh or his-company have not proven compentency to do this type of work; b) A proposal by Mr. Walsh and Siding Master to install a 13' X 20" aluminum carport for a Mr. Rodenhizer, 589 Sloan Street, Sebastian. Also a complaint from Mr. Rodenhizer. immediately called Mr. Walsh and asked him to stop at my~office. I confronted him about this complaint. Mr. Walsh admitted ~o me that he had exceeded his license. He knew he was limited to siding and soffit, vinyl and aluminum installation. He agreed to return their deposit and cancel the contract. He promised he would do this in three (3) days because he had to wait for the check to clear the bank. Checking on the following Monday, I found he had not done this. I contacted Mr. Walsh again. This time he informed me he was wai~ing for his attorney to draw up a release of contract and an agreement of 15~ charge for handling of materials. I recommended he contact his attorney right away and get this situation settled. The following week I got another telephone call from Mr. Rodenhizer. His money had not been returned yet. I suggested they contact the State Attorney's office or local Chairman Ballough, Sebastian Construction Board Board Members -2- Police Department and file charges. ~ met Mr. Rodenhizer at the Golf Club one day and he. told me that he had filed charges at the local Police Department and ~tthin a few days he received his money back. Indebtedness charges from $2,500 to $5,000 were filed with the Clerk of'6Durt, IDdian:Riwar County by Renolds Aluminum Company a~a alumco Of Palm Bay, Florida. 3) On December 17, 1986 at approximately 10:30 A.M., Mr. walsh handed a proposal to Mr. Vincent, Business Manager at the Golf Course. Identified by Allrich Corporation, including State LiCense No. CBC023277, (see attached). I called Mr. James Allen, license holder of record. I explained what I had and he claims no knowledge of this or any other proposal by Allrich Corp.. J~ picked up a copy of the proposal and the next day, he delivered his letter of December 18, 1986. (See attached) On December 30, 1986, I asked Mrs. Kathy Nappi to COntact Mr. Walsh. An appointment was set for January 2, 1987 at 8:00 A.M. At 7~58 A.M., Mr. Converse took a message that Mr. Walsh could not come in and that he would contact me later. At 11:47 A.M., January 2, 1987, Mr. Walsh called. I asked him to stop by my office so that I could discuss the charges I was filin9 against him. He told me I did not have to file charges, that he was giving up the business completely. I told him I was filing anyway. Within minutes, he was in my office wanting a copy of the charges. I told him it was only partially done. We discussed the proposal for the Golf Course. He said none of this was necessary since he was out of business. I informed him I knew he had moved from his office on RT. 512 to a warehouse somewhere off Vickers Road or 99th Street. He said that was correct, but that it was all for sale since he was going out of business. I told him he should put it in writing and that. he should resign from the Construction Board at which he replied no. He then wrote a letter to me and Kathy notarized it. I told him that I was going to proceed to request his being removed from the Board. He told me to do what I had to do. While writing this memo, at 2:45 P.M., Mr. Walsh called me and said he was with Mr. Soliotis at his home. He asked if Mr. Allen had not okayed the proposal through Mr. Soliotis. I told him no. I read Mr. Allen's letter to him. Mr. Walsh said, "okay Roger, if~ou~pu~, ~uubett~rlookout." In summary, Mr. Walsh has c~ a pump house at the Golf Coruse with an unusual high price and did not obtain a building permit. He knowingly exceeded his license by passing out proposals for carports and screen rooms. He also has continually been in financial trouble. L Gene Herds City of Sel 'tian POST OFFICE BOX 127 E] SEBASTIAN, FLORIDA 32958-0127 TELEPHONE (305) 589-5330 I}u#dlf~ OIIIclII January 19, 1987 Tom Walsh 550 Concha Dr. Sebastian, Florida 32958 Dear Mr. Walsh: This is to notify you that per Sec. 7-92.2 of the Sebastian City Code, on February 3, 1987 at 7~30 P.M. the Sebastian Construction Board will consider action on the following items concerning as a license holder in this City and as a member of the Sebastian Construction Board: 1) RE: Sec. 7-10.l "Character of Work" Writing contracts with homeowners and failing to perform in a business like manner, I£, owners force compliance by numerous letters and complaints to the Building Official and Police partment. 2) RE: Sec 7-99 - Paragraph A or D or both Specifically acting outside the scope of license, IE, contracting to build structures outside the scope of Aluminum Specialties License. You are asked to be prepared to refute any or all of the mentioned items and provide the Construction Board with any paperwork, contracts or witnesses that may prove helpfull in resolving this ma t ter .
