MOTION BY MR. DERNBACH, SECONDED BY MR. NEUBERGER TO ACCEPT
THE MINUTES OF REGULAR MEETING, 12/li/90 AS WRITTEN.
CARRIED.
BUILDING OFFICIAL MATTERS:
GRANDFATHER CLAUSE EXTENSION:
MR. COOPER TOLD THE BOARD THAT CITY COUNCIL ON THE ADVISE OF
THE CLTIf_ATTORNEY THAT TO LIMIT IT TO INDIAN RIVER COUNTY
COMP CARD HOLDERS WOULD BE DISCRIMINATORY. CITY COUNCIL
ASKED THAT IT BE BROUGHT BACK TO THE BOARD TO SEE IF THEY
WANTED TO OPEN IT UP TO ALL COMP CARD HOLDERS OR JUST DROP
IT.
MR. NEUBERGER FELT THAT WE SHOULD LEAVE IT AS IS.
MOTION BY MR. DERNBACH, SECONDED BY MR. CAPP THAT THE BOARD
DROP CONSIDERATION TO ASK CITY COUNCIL FOR A ~RANDFATHERING
EXTENSION.

MOTION BY MR. CAPP, SECONDED BY MR. DERNBACH TO ACCEPT
LETTERS OF RECIPROCITY.
DISCUSSION:
IN REGARDS TO ELLIOT SANDE, AFTER LOOKING~AT A STATEMENT OF
INCOME THAT WAS IN MR. SANDE'S FOLDER, MR. KELLEY ASKED IF
LICENSED PEOPLE OR CONTRACT LABOR WOULD DO THE WORK.
MR. SANDE SAID THAT THEY WERE PAID AS INDEPENDENT
CONTRACTORS.
MR. KELLEY SAID THAT IF THESE PEOPLE WERE BEING USED AS
INDEPENDENT SUB-CONTRACTORS THEY NEED TO BE LICENSED.
MR. NEUBERGER FELT THE APPLICATION SHOULD BE TABLED UNTIL THE
BOARD HAD INPUT FROM THE CITY ATTORNEY AND OTHER AREAS.
MR. DERNBACH WITHDREW HIS SECOND, MR. CAPP WITHDREW HIS
MOTION.

OF RECIPROCITY.

APPLICATION UNTIL WE CAN GET SOME INPUT FROM THE ATTORNEY AND
QUESTIONS ANSWERED FROM OTHER AREAS.
MR. DERNBACH FELT THAT A DATE SE SET TO REVIEW THE
APPLICATION AGAIN.
MR. COOPER SAID IT WOULD BE SUFFICIENT TIME TO BE PUT ON THE
FEBRUARY MEETING.

MOTION BY MR. NEUBERGER, SECONDED BY MR. KELLEY TO TABLE THE
APPLICATION FOR LETTER OF RECIPROCITY UNTIL THE FEBRUARY
MEETING PENDING INPUT FROM THE CITY ATTORNEY AND THE RESULTS
OF HIS HEARING AT CITY OF PORT ST. LUCIE'S CHARGES. THAT THE
RESULTS OF THAT HEARING BE BROUGHT BEFORE THE BOARD.

A LENGTHY DISCUSSION FOLLOWED.
MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP TO FIND MR.
SHARKY GUILTY OF VIOLATION OF SEC. 7-99A, NO PERMIT AND 7-
lO0(1) NO LICENSE, VIOLATION OF SEBASTIAN BUILDING CODE OF
ORDINANCES.

MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP THE BOARD FINE
MR. SHARKY $500.00 TO BE SUSPENDED FOR A PERIOD OF 6 MONTHS
PENDING THAT HE BRING BEFORE THIS BOARD EITHER A LICENSE OR A
BONAFIDE APPLICATION FROM SOME BOARD, NOT NECESSARILY THIS
BOARD THAT HE IS IN THE PROCESS OF COMPLYING AND BECOMING
LICENSED.
DURING A BRIEF DISCUSSION CHAIRMAN CAREY SAID THAT BREVARD
COUNTY WOULD BE NOTIFIED.
THE BOARD ALSO FELT THAT A PERIOD OF 30 DAYS SHOULD BE
SPECIFIED IN STARTING THE PAPER WORK.
MR. CAPP WITHDREW HIS SECOND.

MR. NEUBERGER AMENDED HIS MOTION TO INCLUDE THAT HIS PAPER
WORK BE STARTED WITHIN A 30 DAY PERIOD AND A LETTER OR COPY
OF AN APPLICATION IF YOU GO TO ANOTHER AREA.
MR. CAPP SECONDED THE MOTION.
CARRIED.
DISCUSSION: CODE AMENDMENT - MASTER PLUMBER/ELECTRICIAN
MR. COOPER POINTED OUT THAT AT THE PRESENT TIME THERE IS
NOTHING IN OUR CODE OF ORDINANCES SPECIFYING THAT A MASTER
CANNOT PULL A PERMIT. THAT THE ADMINISTRATION TEST MUST BE
TAKEN AND THAT THE LICENSE SPECIFIES PLUMBING/ELECTRICAL
CONTRACTOR. OUR CODE NEEDS TO BE AMENDED.
CHAIRMAN CAREY FELT THAT A COPY OF THE LETTER FROM ST. LUCIE
COUNTY CONCERNING THIS'MATTER BE GIVE TO OUR ATTORNEY FOR HIS
OPINION.
MR. CAPP AND MR. NEUBERGER REGISTERED SCORES IN THE SCORE
BOOK.
THERE BEING NO FURTHER DISCUSSIONS, THE MEETING ADJOURNED AT
