IT WAS NOTED THAT THE HEARING INVOLVED IRRIGATION, NOT WELL
DRILLING.

MOTION BY MR. HANEY, SECONDED BY MR. NEUBERGER TO FIND GUILTY
OF CODE OF ORDINANCE SEC.7-99(A), NOT LICENSED, LOCATION WAS
THE SUPER AMERICA AT 700 U.S. %1, SEBASTIAN, FLORIDA.
MOTION CARRIED.
MOTION BY MR. MOSBY, SECONDED BY MR. DERNBACH HE OBTAIN HIS
LICENSE IN THE CITY OF SEBASTIAN WITHIN A REASONABLE TIME
PERIOD OF 60 DAYS AND THE LICENSe' IS NOT OBTAINED THAT A"FINE
OF $250.00 BE IMPOSED.
DISCUSSION= MR. NEUBERGER FELT THE MOTION WAS OUT OF ORDER
BECAUSE IF MR. MUSGROVE, THROUGH NO FAULT OF HIS OWN DOES NOT
PASS THE TEST, YOU CANNOT FINE HIM FOR THAT.
MR. DERNBACH FELT THE FINE SHOULD BE $150.00 SINCE IT IS A
FIRST OFFENSE.
MR. DERNBACH WITHDREW HIS SECOND, MR. MOSBY WITHDREW HIS
MOTION.
MOTION BY MR. MOSBY THAT MR. MUSGRO.VE TAKE THE TEST FOR
IRRIGATION CONTRACTOR'S LICENSE WITHIN THE NEXT 90 DAYS.
MOTION DIED FROM LACK OF SECOND.
MOT. ION BY MR. NEUBERGER, SECONDED BY MR. DERNBACH THAT DUE TO
THE FACT THAT THROUGH HIS OWN ADMISSION WE HAVE FOUND MR.
MUSGROVE GUILTY, THAT THE BOARD, DUE TO THE FACTS BROUGHT OUT
SHOULD ASSESS A FINE OF $250.00 TO BE SUSPENDED FOR A PERIOD
OF 90 DAYS AND CAN BE DROPPED IF HE BECOMES LICENSED PRIOR TO
THAT TIME.

FINE HIM $150.00 TO BE SUSPENDED FOR 90 DAYS AND FORGIVEN. IF
HE SHOWS OS THAT HE HAS TAKEN THE BLOCK AND ASSOCIATES TEST
FOR IRRIGATION SPECIALISTS LICENSE.

DISCUSSION~ MR. NEDBERGER NOTED THAT MR. HANKE IS LICENSED
(CERTIFIED) BUT WAS NOT REGISTERED WITH THE CITY.
MR. DERNBACH MADE A MOTION, SECONDED BY MR. HANEY TO AMEND
THE MOTION CURRENTLY ON THE FLOOR TO READ, IN FINDING MR.
HANKE IN VIOLATION OF SEC. 7-99[B) OF SEBASTIAN CODE OF
ORDINANCES.
MOTIONS CARRIED.
MOTION BY MR. DERNBACH, SECONDED BY MR. NEDBERGER THAT IN
VIEW OF THE FINDING OF FACTS OF THE BOARD I MOVE THAT WE FINE
MR. HANKE $150.00 FOR NOT HAVING A BUILDING PERMIT AND
$150.00 FOR NOT REGISTERING HIS LICENSE IN THE CITY OF
SEBASTIAN BEFORE COMMENCING WORK.

SEBASTIAN ISSUES ANY MORE BUILDING PERMITS TO HIM.

ViCE CHAIRMAN LAMAN ASKED IF THE FINES THAT WERE BEING
IMPOSED WERE BEING COLLECTED.
MR. COOPER ASKED THE BOARD SECRETARY THAT FOR THE NEXT BOARD
MEETING TO TAKE A TALLY OF ALL THE FINES THAT HAVE BEEN PAID
OR NOT PAID AND THEN THE BOARD CAN CERTIFY THE FINES.

THE BOARD SECRETARY TOLD THE BOARD THAT MR. OLIVA HAD CALLED
TO 'SAY HE WOULD NOT BE ABLE TO ATTEND THE MEETING DUE TO A
FUNERAL AND ASKED'THAT HIS HEARING BE TABLED UNTIL THE
FEBRUARY MEETING.
MOTION BY MR. NEUBERGER, SECONDED BY MR. DERNBACH THAT DUE TO
MR. OLIVA'S PERSONAL OBLIGATION THAT THE BOARD CARRY THIS
CHARGE FORWARD TO THE FEBRUARY MEETING IN ITS ENTIRETY AND
RESERVE, IF NECESSARY ALL PEOPLE INVOLVED.

THE BOARD SECRETARY WAS REQUESTED THAT AFTER THE TALLY OF
FINES WAS DONE THAT IT BE GIVEN TO THE PRESS JOURNAL AND TH~
SEBASTIAN SUN.
DISCUSSION: FULL SERVICE PROCTORED PROGRAM/BLOCK'EXAM
THE BOARD SECRETARY TOLD THE BOARD THAT AS OF 2/1/92, WE
WOULD BE GOING TO THE FULL SERVICE PROCTORED EXAM, THAT WE
WOULD NO LOI~ER BE TESTING THREE TIMES A YEAR OURSELVES. SHE
NOTED THAT BLOCK WAS TRYING TO SET UP SOME TEST SITES HERE IN
SEBASTIAN. THE BOARD STILL HAS THE CAPABILITY TO SPONSOR AN
APPLICANT TO GO TO GAiNESVILLE.
MR. COOPER ASKED THAT IN THE LETTER GIVEN TO THE APPLICANT
INFORMING HIM THAT HE HAD BEEN APPROVED BY THE BOARD TO TAKE
THE TEST, THAT THE LETTER ALSO STATE THAT THE TEST MUST BE
TAKEN WITHIN 90 DAYS OF APPLICATION.

MOTION BY MR. NEUBERGER, SECONDED BY MR. MOSBY TO ADD THE
RESIGNATION LETTER OF FORMER CHAIRMAN CAREY TO THE AGENDA.
MOTION CARRIED.
VICE CHAIRMAN LAMAN READ THE LETTER FOR MATTER OF RECORD.
MOTION BY VICE CHAIRMAN LAMAN, SECONDED BY MR. CAPP TO ACCEPT
MR. CAREY'S LETTER OF RESIGNATION.

CAREY IS SENT A NICE LETTER OF APPRECIATION AND A PLAQUE TO
BE PRESENTED AT A CITY COUNCIL MEETING.
