MEETING WAS CALLED TO ORDER BY CHAIRMAN CAREY AT 7:30 P.M.

CHAIRMAN CAREY WELCOMED MR. KELLEY AND MR. HANEY, NEW MEMBERS
TO THE BOARD.
APPROVAL OF MINUTES:
MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER TO ACCEPT THE
MINUTES OF MEETING HELD 1/9/90 AS WRITTEN.
CARRIED.
THE BOARD SECRETARY REQUESTED THE APPLICATION FOR WILLIAM
HUNT, DRYWALL TO TAKE THE BLOCK EXAM IN GAINESVILLE BE
PLACED ON THE AGENDA.
MOTION BY VICE CHAIRMAN LAMAN, SECONDED BY MR. CAPP TO ACCEPT
APPLICATION FOR REVIEW FOR THE BLOCK EXAM IN GAINESVI.LLE BE
PLACED ON THE AGENDA. CARRIED.

ACCEPT APPLICATIONS TO TAKE THE BLOCK EXAM IN GAINESVILLE.

COMPLAINT AGAINST USE OF UNLICENSED SUBS - RICHARD O'NEILL
CHAIRMAN CAREY SWORE IN MR. O'NEILL.
CHAIRMAN CAREY ASKED MR. O'NEILL IF HE BROUGHT IN THE RECORDS
THAT WERE ASKED FOR. O'NEILL SAID HE HAD. MR. COOPER NOTED
HE HAD NOT SEEN THEM YET.
MR. NEUBERGER STATED THAT ON ll/14/89, SUNLIGHT HOMES WAS
BROUGHT BEFORE THE BOARD FOR USING MR. LINTON AND MR. ECKMAN,
EMPLOYEES OF MR. O'NEILL, NONE OF WHICH WERE LICENSED IN
SEBASTIAN AT THAT TIME.
MR. O'NEILL STATED HE DID NOT KNOW HE HAD TO BE LICENSED TO
WORK IN SEBASTIAN.
MR. O'NEILL DID COME INTO THE BUILDING DEPARTMENT TO PICK UP
AN APPLICATION TO OBTAIN A LICENSE IN SEBASTIAN.
CHAIRMAN CAREY NOTED THAT MR. O'NEILL'S LICENSE HAD BEEN
SUSPENDED AT THE JANUARY MEETING'FOR FAILURE TO APPEAR BEFORE
THE BOARD AS REQUESTED TO ANSWER ANY QUESTIONS THE BOARD OR
BUILDING OFFICIAL MAY HAVE HAD.
A LENGTHY DISCUSSION FOLLOWED.
MOTION BY MR. NEUBERGER, SECONDED BY MR. KELLEY THAT MR.
O'NEILL BE NOTIFIED THAT HE IS NOT LISTED AS A LICENSED
CONTRACTOR IN THE CITY OF SEBASTIAN AND THAT IF HE CHOOSES TO
BECOME ONE, HE WILL HAVE TO MEET THE REQUIREMENTS SET FORTH
BY THE CITY IN THE TESTING, TAKE THE BLOCK TEST FOR HIS TRADE
AND PASS IT WITH A PASSING GRADE AND BRING PROPER INFORMATION
AND STATE REGISTRATION BEFORE US. WE WILL THEN TAKE IT AS AN
APPLICATION FOR LICENSING.

DISCUSSION: MERCEDES HOMES
MR. COOPER TOLD THE BOARD THAT WHEN HE WAS NOTIFIED BY MR.
CAPP THAT THE HOUSE LOCATED AT 742 CAPON TERRACE HAD
COLLAPSED, UPON GOING TO THE LOCATION HE HAD TALKED TO ONE OF
THE FRAMING CREW WHO ADMITTED THE BRACING WAS NOT PLACED ON

THE STRUCTURE.
MR. DARYL FRDTH FROM DPR, UPON REQUEST, MET WiTH MR. COOPER
AND CHAIRMAN CAREY. A COMPLAINT WAS FILED AT THAT TIME.
FOR RECORD, RICHARD VAETH WAS LISTED ON THE PERMIT
APPLICATION FOR CARPENTRY. HE WAS NOT AND IS NOT CURRENTLY
LICENSED WITH THE CITY.
MR. COOPER PUT A "STOP WORK" ORDER ON THE JOB AND TALKED WITH
AN INDIVIDUAL FROM MERCEDES HOMES WHO STATED THAT MR. VAETH
WAS THE FRAMER ON T.HE JOB. UPON GOING TO MERCEDES OFFICE, HE
TALKED TO JEFF AND RICHARD WHO SAID MR. VAETH WAS THE FRAMER
NOT ONLY ON THAT HOUSE BUT TWO OTHER HOUSES. HE THEN PUT
"STOP WORK" ORDERS ON THE OTHER TWO HOUSES AS A PRECAUTIONARY
MEASURE.
UPON TALKING WITH DEAN BUESCHER AND THE TWO SUPERVISORS ON
THE CARNIVAL TERRACE JOB, MR. COOPER AND MR. BONACCI
DISCUSSED WITH THEM THAT IN THE HOUSE THAT FELL, THEY FOUND
THAT NOT ONLY WAS THE BRACING THE CAUSE BUT THAT THE NAILING
OF THE 2 X 4 FRAMING WAS NOT TO CODE.
WHEN THE "STOP WORK" ORDER WAS LIFTED ON CAPON TERRACE, THE
SAME FRAMING CREW RETURNED TO THE JOB, THIS TIME AS EMPLOYEES
OF MERCEDES HOMES.
MOTiON-BY MR. CAPP, SECONDED BY MR. HANEY THAT SCOTT BUESCHER
BE BROUGHT BEFORE THE BOARD AT THE NEXT REGULAR SCHEDULED
MEETING.
MR. NEUBERGER ASKED THAT THE PAPER WORK BE BROUGHT BEFORE THE
BOARD AS PROOF THAT THE FRAMERS WERE EMPLOYEES OF MERCEDES
HOMES.
SECOND WITHDRAWN BY MR. HANEY, MOTION WITHDRAWN BY MR. CAPP.
MOTION BY MR. CAPP, SECONDED BY MR. HANEY THAT SCOTT BUESCHER
APPEAR BEFORE OUR NEXT REGULAR SCHEDULED MEETING AND BRING
INFORMATION CONCERNING SEC. 7-100, SUB PARAGRAPH B, (1), (2)
AND (3).

IT WAS NOTED THAT SINCE MERCEDES HOMES HAS BEEN A CLIENTOF
ATTORNEY NASHES OFFICE, THAT ATTORNEY NICHOLAS TSAMOUTALES,
PALM BAY WOULD BE ASKED TO ATTEND THE MEETING.
MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER TO SUBPOENA
RICHARD VAETH TO APPEAR AT THE NEXT REGULAR SCHEDULED MEETING
AS A WITNESS TO THE MERCEDES CASE~

DUE TO THE MALFUNCTION OF THE TAPE RECORDER, I WAS UNABLE TO
GET ALL OF THE MOTION MADE BY MR. CAPP. THIS WILL BE BROUGHT
BACK TO THE BOARD AT THEIR MARCH 13, 1990 MEETING.
MR. JIM HIER APPEARED BEFORE THE BOARD ASKING WHAT CATEGORY
THE APPLICATION OF FOAM SEALANT WOULD COME UNDER. A BRIEF
DISCUSSION FOLLOWED.
MOTION BY MR. DERNBACH, SECONDED BY VICE CHAIRMAN LAMAN THAT
FOAM SEALANT NOT BE PUT INTO A NEW OR EXISTING CATEGORY.
CARRIED.
TEST SCORES WERE REGISTERED IN THE SCORE BOOK BY MR. CAPP. AND
MR. HANEY.
THERE BEING NO FURTHER BUSINESS, MEETING ADJOURNED AT 9:B5
