A voice vote was taken. 6 - 0 motion carried. OLD BUSINESS: None. NEW BUSINESS: BLOCK EXAM: JORDAN JR., WILLIAM O. I IRRIGATION Mr, Jordan, 1855 34t~ Ave., Veto Beach, FL, was present and was sworn in at 7:05 pm. There was discussion with this applicant, CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF MARCH 9, 1999 MOTION by VCCecrle/Herbig I'd like to make a motion that we approve Mr. William Oscar Jordan, Jr. (Billy), for the specific trade of Irrigation, to take the Block Exam. ENRIQUE I ELECTRICAL CONTRACTOR Ban'em, 1033 Schumann Drive, Sebastian, was present and was swom in at 7:09 Mr. Ban'em noted that he has a problem with'the English language, and noted that There was a bdef discussion on the applicant's last name used for the credit report, Mr. Barrere mentioned working for an airport and some electrical work while in Maryland. Smith - yes Andrew AIIocco - no The vote was 5 - 1. Motion carded. Endque Barrera OMLEY, TODD R. I PAINTING Mr. Omley, 465 Columbus St., Sebastian, was present and was sworn in at 7:15 pm. VC Cecrle requested that, on page four (4) of Mr. Omley's application, the dates on line four (4) be verified with the original copy. ( The secretary checked this date the following day, and it is correct.) to take the Block Mr. pm. he had an interpreter to assist him. Mr. Ban'em stated that he is presently working in the cafeteria at Indian River Hospital in Veto Beach. He also clarified that he is applying f~r a master's license as he has about twenty (20) years experience. CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF MARCH 9, 1999 MOTION by VC Cecrle/AIIocco I'd like to make a motion that we approve Mr. Todd Randall Omley to. take the Block Exam for the specialty contractor of Painting. Roll call: Pierre Paquette - yes VC Cecrle - yes Chmn. smith - yes Michael Herbig - yes-' Scott Taylor(a) - yes Andrew AIIocco - yes The vote was 6 - 0. Motion carried. VIOLATION HEARINGS: 468 SEAGRASS AVE. I INTERLOCKING PAVERS JUAN JIMENEZ Mr. Jimenez, 230 S. Bay St., Fellsmera, FL, was present and was sw°rn, in at 7:18. pm. George Bonacci was also swom in at 7:18 pm. Mr. Bonacci gave staff presentation, and gave information about the violations. Mr. Jimenez noted that he was able to contact Ms. Schleicher only one time, ,and received only one message from her via his 7 year old son. He gave added information on why he failed to get in touch with her to finish the job, and' other issues he felt had a bearing on this violation. He also gave information on his attempt to get licensed through-Vero Beach and Fellsmere. He noted that he has a license from FellSmera and a receipt for $46.00, plus insurance and workman's compensation. Mr. Bonacci informed Mr. Jimenez that a'Fellsmere license is not accepted in Sebastian. He also noted that pouring concrete is a differentapplication and he is not licensed .to do that. It was also established that the receipt that Ms. Schleicher furnished could be considered a contract because of the information contained on it. There was more discussion on this issue. MOTION by Cecde/Herbig I make a motion that we find Juan Jimenez in violation in the following..codes we've got listed here; the first one is 26-171(a) - UNLICENSED CONTRACTOR; Code 26..171(c) - UNLAWFUL FOR A PERSON REQUIRED TO POSSESS, BUT NOT POSSESSING A CURRENT CERTIFICATE OF COMPETENCY ISSUED BY THE BOARD TO ADVERTISE TO THE PUBLIC BY ISSUANCE-OF A CARD; AND 26-172(1)- WILLFUL DISREGARD OF THE BUILDING CODES; AND 104.5, which has no referanca on this of the Standard Building Codes, and the motion finding him in violation of those codes just listed, and as far as - on base of finding, wa find, have a fine for the following ones: for Code 26-171(a) - I make a motion of a violation fine of one hundred dollars ($100); on 26-171(c), I CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF MARCH 9, 1999 would like to fine of fifty dollars ($50); and for 26-172(1), a fine of .f'fl~j dollars ($50). These fines could be much higher than what I've just quoted, but together they come to a total of two hundred dollars ($200), which is not :a lot of money as far as what the fines could be levied against you for each count - they are very small and insignificant, in consideration to what - that the codes were violation, find him guilty of these violations and these fines for each of the ones I've just listed. I'd like to make a motion of that. Discussion: Mr. Taylor commented that the fines should be higher, with a total of at. least five hundred dollars ($500) VC Cecrle noted that his reason for the f'me amounts was that the job was completed satisfactorily except for pulling the form beards, and the contractor did not intentionally harm the customer in any way, and the City finished up with the patch on the pavement and pulling of the form boards. He also commented that this amount would be similar to the expense incurred by the City. Roll call: VC Cecde - yes Pierre Paquette(a) - yes Chmn. VC Cecrle noted that the maximum fine could have been five hundred dollars ($500) for each violation for a total of fifteen hundred dollars ($1500). Questions by Mr. Jimenez were answered by Mr. Bonacci and Board members, BUILDING OFFiCIALflVlATTERS: Mr. Bonacci commented that the Building Department is having a banner year in residential construction, and there are a couple of commercial projects. BOARD MATTERS:.' There was discussion about home owners pulling permits for any type of construction 'or renovation. Mr. Paquette.suggested a letter be furnished to this type of applicant with an explanation of how to go about properly hiring a licensed contractor. Mr. Bonacci explained the process, along with some of the forms included in the owner- builder application, and indicated that there is information in that packet cautioning owners about unlicensed contractors. Mr. AIIocco suggested testing owner-builderS to check their ability. He agreed 'to bdng back information on this process for the next meeting. CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF MARCH g, 1999 Mr. Bonacci noted that a copy of the Flodda State Statute regulation governing owner- builder is included in the Building Permit application packet.
